  2. It is up to you - if you are not confident, use the N1. All I am saying is that a lot of people, thousands, have used MCOL successfully. And I was pointing out that Crustygit's reasons why not to use it was very lacking in detail as to why his was stuck out. In fact, it is the only one I have heard of being struck out in over 12mths of using this site.
  3. Many, many people have used MCOL successfully, You need to follow the guidelines and send a schedule of charges to the court offices and to the solicitors at the same time you issue a claim. Crustygit - I remember your post very well. You never did say what your Particulars were in order for the claim to be struck out, despite numerous requests from people who wanted to help you. Instead, you struck panic into people.   6. When the 14 days are up, send your next letter. It's a standard stalling letter.Then when the 14 days are up on that, issue your claim regardless of what nonsense they give you
  7. You do have to make a payment whether online or in your local office if you are not in receipt of certain benefits. As for the £100 transferring to local court, that is incorrect. There is no fee for transferring to a local court, it is done automatically. It may be that his claim was over £1500 and he had to complete an Allocation Questionnaire at the defence stage. That costs £100.

  9. I have done MCOL and sent a copy of the charges to the MCOL office and SCM with the case number on at the same time. Also, Lloyds are paying up around AQ time at the moment with a lot of cases (not all though), so theoretically it could be in around 6wks ish from filing. And you weren't nervous with Nationwide cos you had me and I told you it was dead easy Lloyds are certainly easier than they were, so it is a good time to do it.
  10. Sorry to ask, and I know it might seem silly, but you did include the charges PLUS the interest in the Total Amount Claimed box didn't you? It's just that some people haven't included it in there by accident, just in the wording in the particulars section.
  11. I don't know why you think you have blown your case - that is the standard 'sod off' letter from Lloyd. They are trying to worry you into giving up......it obviously worked! But you are here now and we can tell you they are talking rubbish. Ignore it and carry on :)
  12. I am confident - my sig is not working but I claimed back from the Nationwide in summer last year, with the help from this site, before many people even knew about the charges issue. I have also seen hundreds, if not thousands of people get their charges back. I have always meant to do Lloyds for my hubby but I was pretty ill towards the end of last year so have only just really started to get going again. Personally, and what I plan to do, is file the AQ as late as possible as Lloyds have been paying out on some occasions around this time, so I shall keep my fingers crossed and keep checking the account. If they don't, we will do the AQ and wait for a court date, knowing that we WILL get our money back.
  13. Aah, will be fine - mine is same amount and although they have defended, not got the forms yet. To me, I can't wait as I know we are on the home stretch now and we will get our money soon. Nothing to worry about.

  20. You can't do anything until you get the AQ. As far as time scales go, Lloyds are so unpredictable. They could pay out next week or in 6mths time! Some occasions they have been paying around the time the AQ is due in, others aren't getting money until the day before their court date. There really is nothing you can do until you get the AQ and their defence.
  21. That is the one major thing we have over MSE - everyone wants to help and it is a very detailed and thorough process. Although my sig is not showing (for some reason), I, along with many others, have claimed from other institutions and stick around to help others as I got help with mine...a kind of 'pay it forward' kind of thing. Also everyone is very helpful here - you won't get people berating you for running up charges and wanting them back like you do on MSE. Or if they do pop up, they are soon exterminated!!!
