  5. I wish it was that easy! I refuse to go through security, and tell them "WRITING ONLY" but they just say "WE WILL KEEP CALLING" they are often very rude and aggressive, which is why I am trascribing their calls now. cas
  6. Hi Jo unfortunately, changing my number is not an option as I run a business from home. If the calls continue I am going to take action and see if I can get compensation, I am tired of the way they speak to me.I have started to transcribe calls from them now.   7. hI They are trying it on! If you handed it in personally then of course you cant provide a receipt. When it comes to your contract - they cant just make up terms to suit them. Ask them to point out the specifice term in the contract that says you have to provide proof of them receiving it. I believe the letter you have received threatening court action (from TM) is the same as lots of us have had - JUST STAND UP TO THEM. They have been trying this with me since october - given up and passed it to Moorcroft now. It as been with DLC,ARC,TM, Moorcroft and all have threatened court action. cas I am no expert on this question but I think that when a new company takes over you arestill bound to the contract but the terms and conditions must remain the same unless they notify you of changes

  9. Hi tawnyowl I run a family business (building related) the past 18 months has been terrible for us. I cant afford to advertise much and am having to diversify. This week my 2 electricians have been cleaning and re-pointing a patio!! I used to use a web site where you pay for leads, but other tradesmen are doing anything to undercut each other and its not worth it anymore. I am not sure how much longer we can carry on - worst thing is I employ 2 of my sons. The kind of jobs we do usually mean the client has to raise finance for it - in the current climate thats very diffucult. Lets all hope things improve soon cas
  10. Hi if I were you I would open another account and then start a claim for unfair fees back. I hae been dealing with similar problem with Lloyds for my son. He cleared his overdraft, but they added another fee on, then fees on top and he now owes 1500 accrued from fees alone. Hi Imstillstanding I did all 3 of mine at the same time ( 2 cards 1 loan) you will need to be organised regarding signature - just sign it, put a line through it and put a highlighter through it. a while ago cds said that egg are now accepting utility bills as proof of id so it may be worth sending one to pre-empt their stalling tactics regards cas:)

  13. Hi as long as they have sent the terms and conditions and a statement of account they have complied with your request. However this is not proof that you have ever signed an agreement with them. I would send a SAR request. When you do, make sure it includes a "true signed copy of the cca". That is really the only way you will know if they have an enforcible agreement cas

  15. Absolute please dont worry- same thing happened to me with virgin active. They said they did not receive my letter(handed in at gym). Do you have a copy? If so, send ARC a copy of it and tell them you dispute the debt. Dont speak to them on the phone -they ARE bullies, and definitely not worth any tears. Only deal with them in writing - they usually send letters saying "you have failed to reply to us" or "if you continue to ignore us" I also got letters from their solicitor - Trevor Munn but they have given up and passed it to Moorcroft. I am sure you can come up with your copy of the cancellatiion letter giving the appropriate amount of notice- dig it out and send them a copy! Or print another one off from when you saved it on the computer My husband and I have both been contacted - but we took our cancellation letter in at the same time, so we both have a witness to it! They are trying to frighten you into paying up- I have never seen a case where they have gone to court - mine is from october last year. cas
  16. Hi Gerberalady my egg account has been indispute since jan - chances are they will pass to on to a dca and they are fairly easy to deal with. I have had DLC, ARC and now Moorcroft. If you refuse to go through security they will have to write to you. They dont like it but they will eventually get the message. cas

  18. Hi I am in a similar position - sent cca rquest and dispute letter. Received a letter " we have had a high demand for ccas and we are dealing with your complaint within 8 weeks" Even though I have repeatedly said I will only communicate in writing, they are still ringing me, and when I protest to their calls they threaten to keep ringing. I am now logging calls in preparation to sue for telephone harassment. After you have sent a reminder letter, you can leave it for a while. However, if you end up being taken to court, I think it will be in your favour to show that you have tried to resolve things. I am sending them a reminder letter after their own deadline of 8 weeks. I refuse to talk to their call centre when they are chasing for payment, but if it is not the call centre I tell them very politely, that they have failed to comply with my request under the CCA 1974 At this point they usually say they will look into it for me, but hear nothing more. I have noticed that a lot of lenders (especially dcas) create a false history by writing to you saying things like "you have failed to reply" or "if you continue to ignore" by writing to them every now and again, if it gets to court you can prove that you have not ignored them cas
  19. Hi imstillstanding when you send the cca reqests make sure you dont sign them. I have heard that some lenders are now refusing to comply without signature and id but when I sent mine in January I created a new signature especially for this purpose - none of them queried it even though it is nothing like my real/original signature! Or you can do as other caggers do and sign it but put a line through it so they cant lift it and use it on a fabricated cca Also, if you stop paying you will get lots of calls- just tell them you only wish to communicate in writing. When I sent my cca rquests I also sent a letter to that effect and when they started ringing me I just said "please write to me, I will not discuss it on the phone" they will try very hard to engage you in conversaton - resist!! refuse to go through security with them too.   21. They seem to like Egg and gym membership jobs. Chased me for Virgin Active after I cancelled my membership. They REALLY hate it when you wont speak to them on the phone - I had one 12 year old boy yelling at me! I thought he was going to cry when I said I wouldnt pay and its not my fault if virgin active are poor at keeping records. They gave up after a 2 or 3 letters and it has gone to another dca now cas
  22. Hi I also dealt with this situation with BS for my son. I contacted a barrister who told me the following: you can remove your goods and hide them BEFORE the baillif comes and does a WPO but if you remove them afterwards (including moving withou telling them) you have committeda "pound breach" the WPO is levied on the goods not the address and will apply. I got round this because my son was in rented accommodation and had a lease and inventory, whch proved that the goods levied on were not his. cas

Baillifs are not supposed to deal with "vulnerable peope" write to your council immediately, telling them of your problems and that you are a vulnerable person, asking them to take your case back and make a payment arrangement.     Lollipop VS EGG

    My Egg accounts are in dispute. First they went to DLC then ARC (who sent them back to Egg) and now I am dealing with moorcroft - I have just sent them the "account in dispute - go away letter" all of them have threatened me with court action, attatchment of earnings and various other things but nthing has happened yet. cas
  25. what about mine; I work from home - people ring me and invite me to their property. I take a small tool bag with me. I diagnose their problem and give them a quote. If they accept my quote, I arrange for the workforce to attend and rectify the problem. I guarantee the work.
