  1. or thinking about it, probably PO is better because if I get the CCJ set aside and there is no valid CCA then the debt would become unenforceable wouldnt it? I also think the debt "might" be SB as well!

  5. Thats great thanks. I have sent a letter a letter today requesting these charges and dates so that I can put in a claim - I guess they will know what I am up to! I am in the process of doing the same with Crap One so hopefully it wont get to court stage, but hey ho if it does then BRING IT ON!
  6. I never sign the letters or post RD to be honest and always send a postal order. I know they do not have a CCA for this debt BUT the debt is showing on my credit file, not in a bad way (at the moment) as they have not updated it since Jan this year when it has been in dispute. I just don't want them adding to it and making it worse which is why I want to get it sorted out and cleared off my credit file if you get my drift
  7. I had one of these letters and just sent them a do not acknolwedge letter. Given I am already dealing with them on another issue, I guess they linked the address. I havent heard back from them since, so that's another one in the file under B!

  9. Hi Can I ask why you CCA'd them and also didnt acknowledge the debt? Did you deny the debt first or CCA them first? Also, are your charges more than the balance owed?
  10. Thanks for your email. They have already confirmed they do not have a valid copy of the CCA as I have already been down that road. I have a current complaint going on with them at the moment as they are still sending me statements even though they cannot chase the debt and they are still adding £12 each month. The balance that is owed is made up of charges and I would need a list of these charges. They have asked me to SAR request them and send a payment of £10 - nothing to do with the fact they want a copy of my signature I wonder!

I contacted the relevant court in question but they wanted my current address to enable me to receive the paperwork - yet the other courts I have been in touch with have happily given me the details over the phone! At the same time Cabot confirmed this CCJ so at the moment I do not need the paperwork HOWEVER, the amount Cabot are claiming is around £4k OVER my credit limit that I had with them and the CCJ is again another £3k OVER what Cabot are chasing. Surely there cannot be £3k worth of charges on this account? Can I contact Barclaycard direct to get statements etc., or would I need to contact Cabot to get the relevant information so that I can find out where this huge amount has come from? Thanks LL
  12. Hi Are you able to claim back charges made on catalogues? I have a debt with Empire Stores with various £12 over limit and late payment charges which I am disputing and I wondered if I could get them refunded in the same way you can with credit card and banks etc? Would I need to SAR them or as I have a current complaint with them can I write to them and ask them for all the charges and dates made on the account? Thanks LL
  13. Hi, I am pretty sure that the whole deposit will be due if the holiday is cancelled - have they read the online T&Cs or perhaps the T&Cs they received? What would normally happen when you book a holiday is you pay the whole deposit, but now they do this special low deposit on the basis that the whole amount becomes due if the holiday is cancelled. As much as i want to get the CCJs sorted, I am not in a position to clear them straight away nor pay the fees to get them set aside especially as they probably wont be set aside. Do you think WW would mark them as settled if I agreed a repayment plan or is it a case of waiting until the debts are cleared by which time the CCJs will have probably dropped off my file anyway - well the 2002 one may have or do you think its worth paying the CCJ one by one to clear them quicker, i.e. pay the older ones first?
  17. I contacted them on their live chat on their website and asked them to remove the number, making out I didnt work for said company anymore and we would report them if they didnt stop sending text messages to my work number - touch wood, it worked!
  18. Hi, Just looking for a bit of advice please. I have recently entered into an agreement with my local court after sending my incomings/outgoings schedule to them and agreeing £30 per month to pay on an oustanding £13K loan with the set aside hearing in May. My question is this.... I have another CCJ (well two actually) which I am currently dealing with, now if the Court has stated £30 per month for the above CCJ how do they work out the repayments for the other two I am currently dealing with? Will I need to write to the Court to ask them to reduce the £30 monthly payment or will they just slap a £1 per month payment on the other 2 CCJ's? Thanks LL
  19. yes they did, three separate CCJs and yes I was living in the property at the time. One is for 2002, CCJ dated Jan 06 One is for 2005, CCJ dated June 06 One is for 06/07, CCJ dated July 07
  20. I have today found out that 3 CCJs on my old property are relating to unpaid utility bills! First off, they have confirmed the balance owing and when these were applied. It was at the stage my house was being repossessed and I buried my head in the sand with any post that came through my door! I am now dealing with everything head on and want to know if there is a way WW will remove the CCJs if I came to an agreed repayment plan to clear the debt? I don't want to go down the route of paying £75 per CCJ to get them set aside when I probably haven't got a cat in hells chance of doing so. This is my letter so far, any help greatly appreciated..... Thank you for your letter dated XXX in respect to the outstanding debts on the above property. I would like to point out that XXX was repossessed in XXX and I moved out of the property on XXX and stayed with a family friend before I moved into XXX on XXX. Please can you therefore amend your records accordingly as I was not in either property at this time and therefore should not be charged any water usage. I have recently obtained a copy of my credit file and would like to sort the CCJs out which you hold against me. You state in your letter that you are unable to combine the debts. If I set up a standing order for each of the debts, please can you confirm the bank details to which they are to be paid into, the reference number to quote and if you require the CCJ number to be quoted also so that you can allocate the funds? I would like to apply to have these three CCJs set aside. However, the cost per CCJ is £75. As a single parent, I do not have the liquid cash to enable me apply for this and would ask that you consider removing these CCJs upon my agreement to repay the debt or a suitable repayment plan. I would also rather use the £225 as part payment towards clearing the balance that is owed.
  21. Hi Tigger, Will gladly help! What you first need to do is get hold of all your statements and look for any PPI charges, over limit fees, non payment fees, late payment fees, anything like that really. Go to www.moneysavingexpert.com and go to the top of the page that shows the tabs about reclamining £1,000s. Scroll down and there is a court calculator. Put in each charge and the date you were charged, it will then work out the interest on top then you can add it to the spreadsheet and when you have finished print the spreadsheet and it will give you the total amount of charges plus interest to show you what to claim back. My charges were £856, by the time I had put in the interest it came to just over a grand so every little helps as Tesco says! I have also had my £55 of PPI charges refunded with no argument whatsoever so if you need me to point you in the direction of the letters, just let me know. You can PM me if you want, but do you know the balance of the charges applied since you have had the account? Would it cover the balance that is owed to Crap One? I should get £600+ if mine gets paid off. They offered me £138 last week so yesterday told them where to stick it and will sent court papers and/or report them to the FOS who are most helpful in dealing with this lol plus I am trying to get the Default remove.   22. Looks like you have joined the long list of Crap One! I was in the same boat, refusing to enter into more dialogue etc., etc., saying they enclosed CCA and didnt have to provide original one etc. Now I am at the stage of claiming my charges back and it might be in your interest to do the same. They passed my debt to Debtias and then to Frederickson and I think that's the norm! Good luck x
  23. I have today received a letter from CapQuest saying they are looking into my complaint and will respond in due course. I guess that has stopped the Stat Demand exercise they were threatening me with!
