  1. I can't scan the item unfortunately as I do not have a scanner at work, but the letter bascially says this..... Thank you for your letter regarding the account details opposite (first letter I sent was a do not acknowledge letter) We can confirm that the account was opened on 16 March 2001. The account defaulted through non payment on 13 November 2002. We purchased the account from xxx on 18 December 2002 with a balance of xxx and we are the legal owners of the debt We hope that you can now recall the account. We look forward to hearing from you. That's all it says, but on the left hand side is a reference number, the original lender, the account type, account number and balanced owed Thanks

  3. That's what I have been thinking but I guess it means by credit file is stuffed for another 5 years! How much damage does each CCJ do? The one in 2004 will drop off next year so will that improve my file much or hardly at all?
  4. Thanks, I have already been on there but it doesnt actually say what the debt is for, merely the Court name, reference number and amount and the date its for. After Oct 07 my grounds are for the fact that I didnt live at that address at that time and never received any paperwork so was never able to defend any claim. Pre Oct 07 I don't really have any grounds at all

That's the problem you see, I don't really want to start digging them up BUT I want to improve my credit score and I think the only way I can do that is by trying to get the ones from last year set aside, BUT at the same time I don't want to add to my probems! Is it best just to deal with the 5 years and wait for them to drop off?
  6. I am 90% sure this is a CCJ but without contacting the Court and digging it all up, there is 10% of me that thinks it might not be, but my head is swaying towards the fact these two a related if that makes sense. I will send the SB letter to them and see what they come back with. Thank you.

  8. Is it worth sending the SB letter as the DCA hasnt mentioned the CCJ at all?
  9. I have a couple of CCJs, mainly credit card debt, catalogue debt oh and one for a water bill - does that help at all?
  10. Surely they would need to have produced a valid CCA to get the CCJ?
  11. Upon checking my CRA, the last payment made on his debt was July 2002, in Aug 2002 it shows as one payment in arrears, then Oct shows 3 payments, etc, and a Default was issued March 2003. The next time I made a payment was earlier this year before I accessed this site (Jan 09) so therefore 6 years HAVE passed between the two payments. I havent heard back from CapQuest since my last letter telling them to prove the debt is not SB!
  12. If the account was in dispute when they placed the default on my CRA can I dispute this with the CRA even though Crap One are refusing point blank to remove it?
  13. Ok here goes LOL..... The debt is from 2001, it was then a CCJ in 2004. The debt itself is SB as its over 6 years old however the CCJ relating to the debt is less than 6 years old (2004) so does that mean the debt is still enforceable if the can come up with suitable CCA (which I very much doubt it LOL!)
  14. When this CCJ was placed on my property I was one of those people that binned their debts and never opened the letters:oops: Now that I have found this website I am dealing with everything. The debt is from 2001 which is SB, however, the CCJ is on the property 2004 so if I obtained the details from the Court would they start chasing me for a debt that is over 6 years old or is it better to leave it and wait for it to fall off my credit file?

Hi, If you have a CCJ registered within the last 6 years, but the debt is say over 6 years old and no monies have been paid to this debt, does that meant the debt is still SB and the Courts cannot enforce payment? The reason I ask is because I have a few SB debts but have CCJs on my old property within the last 6 years and want to make sure that these are SB before approaching the Courts, thanks

Thanks for the reply, they may not be aware that this may be a CCJ on my old address - CCJ was placed on old address at the time of residence, but I am putting 2 and 2 together and assuming that is what one of the CCJ's is for. I have all the relevant numbers etc., so am going to ring the Court and find out what my CCJs are for and then go down the CCA route, but first I will be statute barring these beggers!
  18. Thanks for the info, the CCJ is a few years old so would the DCA ring and ask the question that far after the CCJ? I actually thinks "this" CCJ is one that Cabot are currently chasing but not 100% sure and the fact that the actual debt itself is statute barred so Cabot WILL be getting a letter:D
  19. Thanks, but if I do that and give them my current address will they then start chasing me for the debt or will they just let me get on with it?
  20. Hi, the CCJ was placed on my house whilst living at that address, I just choose not to open my post and ignore my debts during that time! Would I still be able to get it removed? I don't really want to pay the £75 fee though and its probably got another 2-3 years to run. if I got it removed how much does that improve my rubbish credit score?
  21. Received another letter from these idiots today stating that the debt in not in dispute in their eyes! Saying they have provided me with a copy of the CCA (yeah course they have!) and that they will continue to pursue the balance. Also said they will not remove CRA details - that's what they think! I made reference to Ellie Wreck your Credit and apparently she is on maternity leave and that is why she is never there when we call - oh these stories that they are coming out with get better don't they lol!!! And apparently the reason why the letters I have received have been signed by her is because she is the authorised signatory for the Executive Office. My account remains in default and they will defend any application I may wish to send them! And apparently they are not entering into any further correspondence with future letters that I send them. In order words they are now going to ignore me! Ok guys, what is my next step please?
  22. I sent a do not acknowledge letter to Cabot re a debt they are chasing me FROM 2001 for and have received this reply.... The account was opened 20 July 2001. The last payment made on the account was £22 on 5 April 2002. However due to non payment the account after the above date the account defauled on 14 November 2002 (now that clearly is bad english!) We hope this helps blah blah blah Again, another statue barred letter - am I correct? Also, this "may" be a CCJ on my old property within the last 6 years so am I able to get that removed as well?

We purchased the account from Associated on 18th December 2002 with a balance of £xxx. We are the legal owners of the account. We hope that you can now recall the account we look forward to hearing from you. Now clearly these guys need to receive a statute barred letter as detailed above, not only have I not made a payment in nearly 7 years but they are clearly trying their luck! Also, I think this debt "might be" a CCJ on my old house and dated within the last 6 years, am I able to get this removed please? Thanks
