  1. Would you mind posting it up please as I need all the help I can get with this! What is my first course of action - is it to apply to have the CCJ set aside?
  2. I have today received my letter confirming the dates the last payments were made on these accounts which have given me the CCJ. The dates of the last payments are March 02, April 02, July 99, April 02. These are all Statute Barred debts, however, the CCJ was put on my property in August 2006, therefore these debts are NOT SB - am I right? The only one I can see that is SB is the July as that one is 6 years and 11 months since last payment. Is there a way I can get them all removed and state that they are SB debts and go from there?
  3. Thanks for coming back to me, I have been told conflicting comments re which interest you can or cannot claim and whether you can claim both. I am going for both just like you did, so I am pleased that I am doing this right :grin: I have only just received my F&F offer from Cap One so now I can carry out the court paper issue over the BH weekend. Just one question........ they have offered me £138 (PAH!) in F&F settlement and asked for a signature on a form and agreement to close the complaint. Would I get away with accepting the offer (not signing the agreement) and saying in my correspondence that I intend to claim for the rest?
  4. I am very lucky with my rep as I give her 4 cheques a month to save her coming round every week, I post them to her with the relevant dates and she pays them in. Even if she did pay them in all at once she wouldnt be getting any more money out of me until the end of May LOL!
  5. thanks - I will be adding it to my bill. Do I add the interest from the date i paid that £200 onto their deposit account or from the date they used it to pay off my debt? Yes it is the charges they used it for - why do you ask?

  7. When I opened my credit card in Jan 05 I was required to provide £200 holding deposit. Now that my account is under default and I am in the process of claiming back my charges they have used this £200 to pay off part of the balance in August 07. What I want to know is, am I able to claim some form of interest for this money please? Thanks
  8. Think I might give it a go! Have finally received their letter of 21st April stating their F&F offer of £138 so now I have receieved that I can go to the courts and the FOS and write back to them and try and get them to accept this offer on the proviso I will be going for the remainder - wish me luck!
  9. Yes they do request a signature to agree to the refund and close the complaint, but I am thinking of accepting the monies in the form of a letter and not enclosing my signature and see what they say!

Just a thought..... but I have read on some threads who are claiming their monies back that when Crap One have made an offer, in my case £138, its has been accepted on the proviso that the remaining funds will be chased. Now can I do this? The reason I ask is because Crap One have made two offers, one for £64 and the other for £138 (still waiting for their F&F offer which apparently was posted last week, before I issue my claim!), but both of these offers state that the complaint will be closed if these monies are accepted. Obviously I do not want to close the complaint. Could I send a letter stating that I wish to accept these monies but I will carry on claiming the rest? Your thoughts please... thanks
  11. I havent applied for a set aside, as I have only just found out about this debt after getting a copy of my credit report. This is starting to get expensive getting CCJs set aside if I have to pay for this one as well. Is it worth contacting 1st Credit and seeing what it is all about and then going from there?

  15. I have now received the paperwork for this debt, however, there are no details to say who it is with or what the debt is for. The CCJ was placed on my old property in July 08 AFTER I had moved house. The Claimant is 1st Credit and the quote a reference number and an amount that is owed plus interest. I believe this debt "might be" SB, however, how do I go about finding out what this debt is for - will I need to contact 1st credit?

I have today received the paperwork from the Courts, even though Crapbot havent replied to my letter asking when last payment was made etc. It turns out the CCJ was placed on my old property August 2006 - I did live there at this time, but as above, ignored debts! Anyway, its a combination of 4 debts under one CCJ that has been purchased by Crapbot. 3 out of the 4 debts were bought in 2004 by Crapbot, one was purchased in 2002. However, if the last payment made is more than 6 years ago on any of the 4 accounts does that make them statute barred? So I need to SAR ALL the creditors under this CCJ AND CCA request Crapbot? Thanks
  17. I have today received a REPLY FORM from Crapbot with my signature on. It says COMPLETE AND POST YOUR REPLY TODAY! across the top It shows a VERY old address which they have then amended to show my next address, again going back some 7 years! The box marked TENANT is ticked which would be correct, EMPLOYED is filled in, my income, home and mobile number is completed. On the otherside of the page is shows a Credit Agrement which says I AM APPLYING TO PROVIDIAN NATIONAL BANK FOR A PRIORITY RESERVE CREDIT CARD etc etc etc. Bottom it says PLEASE REPLY BY 23RD MARCH 2001 I have signed and dated it - 26.02.01 Mmmm me thinks this is a statute barred debt and not only that it shows NO credit limit or anything!!! Any help from any one please?

Yes i have an agent that calls - but i post her 4 cheques a week to cover the month and we deal with everything via text and to be honest I havent seen her for months lol I was originally paying £40 a week but reduced it to £20 a week when we had to take a pay cut - can I get away with £10 a week do you think?
  19. I took out a Provident loan last summer (£2,000), payable back is double but had no choice as I have bu**ered by my credit file. I was paying £40 a week which was a nightmare after a few months. Anyway, a couple of months ago we had to take a pay cut due to the credit crunch and I reduced my payments to £20 a week which are more managable. However, just as a thought, if I were to ever default on this loan would the original cash loan be due or would they expect the loan plus the interest so therefore paying the full £4k back? I could really do without this loan at the moment and I am not sure if they will take further reduced payments to £10 a week.

Great thanks for clearing that up, I am as thick as you like when it comes to all this legal stuff LOL The link that I added in this thread is whereby they have succeeded in claiming for both and Cap One have refunded partial or most of it so I am going to give it a go. I have the relevant N1 form from this thread which I am going to use so will see what happens. I really hope this doesnt go to court lol, but if I win it will clear the £333 they think I owe them PLUS give me a few pennies to spend as I wish! FINGERS CROSSED!
  21. Ok I am starting to get confused again! I have claimed the APR interest from my card for one section and the 8% interest - that IS called compounded interest - am I right in thinking that? Where would the s69 interest come from or can you not claim both?
  22. PS is the compound interest rate also called STATUTORY COURT rate?
