You can write to KJ but I very much doubt it will make a blind bit of difference. It just helps if you write saying here is an opportunity to settle without wasting the courts time for your own case. Barclays dont give a hoot and will only be interested if you offer to settle for less than the full amount (i.e. something to their advantage) You cannot speed up this process - Barclays will only pay in full when they have to , in order not to appear in Court. I think you can put all the accounts together, just make sure to put all the account numbers in all correspondence. The Leicester Address is a good one to use. If you are strapped for cash you can ask for a proof of posting from your post office (this is free) Spotty

There is no definite time at this stage it depends on how busy your court is. My AQ was returned 2nd August and I don't have a date yet. Just hang on in there - you will get your money Spotty

This is astandard response from Barclays - you sould get your 6 years statements within 40 days. You will have to wait. Please take the time to read other threads in the forum, it will give you a better understanding of how things work. You will get your money but it takes a long time and you need to follow the step by step guide and read threads while you are waiting. Spotty -

If the 28days are up you should log on to MoneyClaim or ring up the Court and try for 'Judgement by Default' it worked for NightStar Spotty

I think you cannot add this latest charge on as far as the Court is Concerned. In the usual turn of events Barclays will settle before court anyway. You could tell them you want it all back plus the latest charge when you get their offer to settle. However, you may get more fun from leaving out this latest charge until they have settled the full amount and then, tell them they have just settled and give me back this latest charge immediately or you will go through the whole process again. Look in the templates library and you will see how the MoneyClaim form looks. You need to put in your name address contact numberts etc and you need to put Barclays Bank plc as the defendant and use the Churchill Place Address in London for them. This is the text you need for MoneyClaim just change the bits in Red to suit your case. ************************************************** *** The claimant had a contract with the defendant (a/c Your A/C Number) from Year which was conducted on their standard terms and conditions. The claimant claims the return of £Your Amount levied by the defendant in the way of charges. The charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. Further,as a disproportionate penalty they are invalid under the Unfair(Contracts) Terms Act 1977s.4 and under the Unfair Terms in Consumer Contracts Regs 1999,Para 8 and sch.2(1)(e). In the event that the charges are not a penalty, they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. The defendant has been asked to justify the charges but they have declined to do so. The claimant claims interest under s.69 of the County Courts Act 1984 at the rate of 8% a year from Start of 6 years to end of 6 years of £Your 8% Interest from spreadsheet and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of £Your Amount x 0.00022 ********************************************** Spotty

You should wait. Do not contact Barclays - especially by phone ! Just before the 26th August see if you can file for 'Judgement by default' on Moneyclaim. Keep trying as there is a slim chance Barclays will cock up submitting their defence in time. Most likely the defence will arrive and Moneyclaim will tell you it has been passed on. You will then get a copy of the defence and an Allocation Questionnaire from your local Court. There is good help on filling in the AQ in the library. Spotty

Just to update my thread. Barclays have submitted their standard defence at the 28th day. (Bummer didn't get to file for Judgement by Default, although I tried many times in the final hours) AQ and defence received AQ returned and copied to Barclays 2nd August ( 14th August was the deadline) Now waiting for date for Court Hearing Spotty

I think you need to wait until you get your statements. Then go through them carefully. If you end up with more than £240 in charges when you go through your statements, it will show that they didn't send a letter every time they charged. Good Luck spotty

I sent mine on 2nd August and am still waiting. I did ring the Court and now think I may get an answer in the next few days. Something tells me that the Courts may just be having a few extra cases to deal with so will take abit longer to reply. It is also possible that they are trying to bunch together Bank claims into one day of hearings. Spotty

It is the standard rubbish - continue with your claim. You will get the Allocation Questionnaire (AQ) to send back to the Court and then get a date for the hearing. Spotty

OOOh this is all so exciting !! So he sounded smitten - he works for the bloodsuckers! As I said before, I know you want your money and no more delay - but it would be WONDERFUL if the Bailiffs and Press get involved because the Mega Barclays are p**sing about over £175. As far as I know none of the banks have gone to Court. But Barclays are not going to pay in full until you have filed a claim, paid the fees and got a date for your hearing. They pay up just before the hearing date. They will still try to haggle and not pay court costs and interest unless you are determined to go take them to court. If you are weak you will lose out. Look at MaisieLou and Nightstar's threads for some recent successes Spotty

Jas 4 Bookworms paragraph is enough. Section G is for directions about your case NOT particulars of your claim. It is if you need a translator, wheelchair access, you are deaf and need a signer , that sort of thing. Spotty
