I got the standard response from my Preliminary letter 'Sorry you're not happy - will get back to you sometime when we decide and here is a Brochure about our complaints procedure' I sent the LBA after fourteen days from sending the Preliminary. Fouteen days from the LBA I filed on MoneyClaim. Barclays made a pathetic offer (less than 30%) just after. I think the offer was on its way before I filed with MoneyClaim, I don't think it was anything to do with the court action. BTW every time I have had correspondence from Barclays it is from a different person and a different address. Cheers Spotty
  2. If you sent them the SAR for your statements it tells them they have 40 days to respond. It looks like they are beginning to take up this amount of time recently, before the statements were turning up in a week or so. As regards the offer don't assume the £500 they have offered is 50% in my case the offered less than 30%. I think you would be best to read the step by step guide and after you get your statements you can follow it doing things in the right order and at the right times. Spotty
  3. You need to read the step by step guide. You can send off the SAR letter straight away asking for the last 6 years of statements. Barclays seem to be taking their time at every stage now - so it will take some time for you to get your money back. I don't think that because you have often been charged for going over your limit will count against you. Also as others have said you need to set up a parachute account. Good luck with your claim. Persevere and don't take any nonsense from Barclays. It is your money and they must give it back Spotty
  4. If you read Mjanets excellent thread you will see that solicitors acting for Lloyds TSB were haggling over her court fees of £50. The banks have no common sense. I am sure solicitors acting for anybody would charge at least that much just to write a single letter. They are being driven by thinking that they can win win by procrastination and delay.

  6. Use the spreadsheet to list out and add up all the 'UNPAID OUTS, PAID REFERRAL, EXCESS OVERDAFT' fees. These will be round figures £20, £25, £30 etc. Put the date at which these charges were made, the Amount and what type of charge it was. You can add in the interest they have charged you on your account for being overdrawn but it is really complicated and doesn't make up a huge amount, most people don't bother with it. When you get to filing a claim with the court then you add in the 8% interest which Barclays owe you from their illegal charges. This Interest is also in the spreadsheet and is well worth claiming back. Hope this helps Spotty
  7. The bit in Green is fine. The bit in Red is for continuing interest from now till it gets sorted. It is a percentage (Multiply by 0.00022) of your claim not including the Interest (£765.26) or Court Fees (£120). Probably works out at 70p or so per day. Hope this helps =- Good Luck Spotty
  8. You should proceed with LBA. Barclays are just using delaying tactics. From what I can see Barclays wont pay out until after the court Allocation Questionaire is filed. Spotty
  9. Yes you can add on the charge. It is only when you have filed with the court that it becomes difficult to change. Spotty
  10. I think you should wait for your statements to arrive and do your total claim calculation. If they have offered you a Grand it is either a cock-up or will be way under what you are really owed. When you have your total then send them the Preliminary letter but modify it with an extra bit saying you have received their offer on ... date and will accept this as an interim payment but still want the full amount.   11. Derisory is not strong enough. They have the Audacity to offer you back ONLY SOME of the MONEY they have charged you! Is this laughable offer in writing ? It will be good ammo when you get to court I would think. Good Luck Spotty
  12. Just follow the step by step guide. Send the SAR then the Preliminary letter. Then the Letter Before Action (LBA) Then (probably) a polite thanks for your derisory offer but I want it ALL back. Then 14 days from LBA go to MoneyClaim On-Line and start the court proceedings. Good Luck Spotty

  14. Look in the library for the step by step guide, also read the FAQs and take time to read the other posts on the site. You need to send them the preliminary letter asking for your money back. This gives them 14 days to reply. You will almost certainly get back a standard response saying we are sorry you are not happy but you you agreed to our terms and here is a booklet about complaints. At your 14 days you send them the Letter Before Action LBA. Just follow the step by step and ask questions if you are unsure. Good luck with your claim Spotty
  15. Welcome to the forum As far as I know there is a legal requirement to hold 6 years of records. You would be best to only claim back and ask for 6 years worth of charges. This is what the library letter SAR request uses. All banks etc are still stitching us up with their exhorbitant charges. I have a Nationwide account and they are not too bad until you exceed your overdraft limit. I don't think changing your account will affect your credit rating. If you have set up a parachute account then it is up to you when you start using it. But if you intend to dump Barclays then why not start getting it up and running. It takes a month or so to sort out your Direct Debits and Standing orders. I don't know about the mortgage issue but as you can get a mortgage from anybody these days without necessarily already being a customer, I wouldn't think it should be a problem. Get your SAR sent off, as this process is going to take a few weeks - so the sooner you start the sooner you get your dosh. Good Luck Spotty
  16. I think the next stage is the court sends you an Allocation Questionaire (AQ) . You have to pay an additional fee and fill in the form and send it back. Look through the threads (try 'IceFall' who has gone the full distance and got his money back) I think Barclays are only going to pay up after this stage is complete. I am a bit behind you, they have acknowledged my claim and say they will defend but I have not yet received their defence. Spotty

    You need to read through the FAQs and then the step by step guide. You send off the Data protection act letter asking for your last 6 years of statements. (they must give you a reply within 40days) Send everything recorded delivery (it only costs a quid) You can send this one to your branch or the DPA address Barclays Bank plc - Data Protection Radbroke Hall Knutsford Cheshire WA16 9EU Work out how much they have stitched you up with in Unauthorised O/D fees Paid Referrals etc Then send them the Preliminary letter asking for your money back within 14days They will send back a letter saying you agreed to their terms etc and so its tough luck. Send this to the person who sent you the letter at Barclays Bank PLC Leicester LE87 2BB After the 14 days from your Preliminary letter (ignoring their response unless they pay up) send them the Letter Before Action telling them thay have 14 days before you start court proceedings. They may respond with a derisory offer of 50% or less of your claim - if they do send them a thanks for your offer which I accept as an interim payment but I am continuing with my claim for the full amount. These letters can also go to Leicester After 14 days from your LBA start court proceedings. You can do this with a form from your local court or do it via Money Claim On Line (MCOL) You will get more advice as you carry on with your claim. Spotty

  20. Seems to me that the Judge is going to do something as 10 days have passed without Barclays responding. Have you logged into Moneyclaim to see the status of your claim? It may be that you can get a judgement by default if Bayclays have not responded to the courts instructions. I think you can do this online. If Barclays have overlooked your claim or the courts directions it may not be a good idea to give them the opportunity by raising the issue with Mr Jeremiah (these are my observations only here as I haven't got past the AQ stage yet) I have lodged my claim and it has been acknowledged but hasn't gone any further yet.   21. Have received an Acknowledgement of Service from MCOL. No surprise, Barclays intend to defend the claim. Keith Jerimiah being the defendant. I presume I need to keep checking on MCOL for Barclays defence. Probably 28 days from now. Spotty

You need to list out your charges like: PAID REFERRAL £20.00 15 June 2006 PAID REFERRAL £20.00 9 November 2003 EXCEEDING O/D LIMIT £30.00 12 Jan 2004 and so on There is a spreadsheet in the library which is useful. If you take this all the way (seems the only way to get ALL your money back), you will need a spreadsheet to work out the Interest you need to add to your court claim Spotty
