  1. In my case, and it seems quite common, Barclays will acknowledge your claim within a few days of it being filed. This gives them 28 days to submit their defence. At the end of the 28 days they will send in their defence. The Court will send the AQ to you within a few days. You will get 14days to return the AQ. I think you need to file at the 14days after LBA. Their offer and your refusal is a separate issue from the timescale. Glad you are determined - you need to be with these bloodsuckers!! Spotty
  2. The 28 days starts from when the claim was served on the defendant. I think the Court assumes 2 days after they sent out the papers to Barclays. This is probably one day after you got your notification in the post - making it the 18th August. You need to go to MoneyClaim around the 14/15th Sept and see if you can file for Judgement by Default, if Barclays have not submitted their defence in time. They seem pretty good, however, at getting in their defence at the last possible moment, thus causing you maximimum delay in getting your money. Spotty

  4. Should you be talking to Barclays over the phone. Shouldn't everything be in writing ! I am sure they are panicking. What if you don't fax them the info before the baillifs go in ? Hopefully Dave or BankFodder will have some advice for you. Good Luck

  6. I don't think bargaining will work. They are trying to get away with giving back only part of your money. I dont believe you will get a significantly higher amount this way. Unless you are desperate for their derisory offer, tell them thanks but no thanks and continue your claim to your timescale. Spotty
  7. I am no expert , but I am running my claim with Barclays for my step daughter. The Courts seem to allow for a Litigation Friend to act for the claimant. I would suggest that you ring your local court and check it out - you may be able to get somebody to act for you in your absence if you wish. Other thinking of course says that Barclays are not actually going to get to Court so you will get your money without appearing in person Spotty
  8. I don't think the Bank holiday makes any difference. As you filed with paperwork directly to the Court, you should ring the court and see if you can get judgement by default as Barclays have not submitted their defence in time. I don't think it is an issue that you have given Barclays more time to respond and I don't think it is necessary to mention it on moneyclaim Look in the library and you will find the concise text that needs to go in the MoneyClaim form - you just need to change dates, account numbers and the amount you are claiming. If you are using the spreadsheet then claim the 8% up to the day you are submitting the MoneyClaim form. In the last part of the particulars of claim it says about using s69 to claim the 8% and after that you enter an amount per day for the continuing interest until you get settlement. The daily rate is 0.00022 multiplied by your total charges (before interest is added) on £3000 pounds it is about 66 p a day Spotty
  10. This is brilliant reading - although I would like you to get your dosh asap , it would be wonderful if bailiffs went to Barclays to demand your money. The press would have a field day and it would encourage loads more people to take on these bloodsuckers. Spotty
  11. themighty I too put in the 8% on my prelim letter. I am waiting for a court date right now. Only if Barclays go to Court can this be an issue and surely under S69 we are allowed by the court to claim interest on the monies owed. Barclays could only complain that I did not follow correct procedure. I am a layman not a lawyer , I can't see how this would screw up the judgement. Spotty

  14. If things go the usual way then after you file on MCOL you wait for Barclays to acknowledge the claim. They normally do this within a few days. By acknoledging they the get an extra 14 days to submit their defence. So at the end of 28 days (they leave it to the last minute) they file their defence. The court will the post you the defence and includes an Allocation Questionnaire which you have 14 days to fill in and return (needs £100 fee if claim is over £1500). When you return your AQ you can the send the list of charges with it. I sent copies of my AQ also to Barclays Spotty
  15. you say you had to get a new Bank Account. Is it still with Barclays? Can you continue to pay instalments on your loan ? Did you send any of the standard letters ? Have you put in a claim with the Court ? It would be useful to know at what stage in this process you are. Unfortunately, Barclays can delay things, so you wont get your money very quickly. It may be worth returning to the CAB and explaining the current situation. I hope someone here can give you some answers Good Luck Spotty

  17. You need to send a list of the charges you are claiming back to both the Court and Barclays solicitors.   18. On all of the threads I have read, Barclays put their defence in at the last possible moment. They are only interested in hanging it out as long as possible. If you really think that they will respond so fast - you can file with the court at the end of this week. If Barclays acknowledge next Tuesday the Court will still have to send out papers and Barclays have to submit their defence. I don't think any of this CAN happen within next week. So, you will then be back before the AQ 14 day limit will be up. Spotty
  19. I would suggest you file the claim tomorrow. Barclays have 14 days to acknowledge the claim and in doing so will get another 14days to send in their defence. They tend to file their defence on the last day tantalizingly making you think you will get a Judgement by Default - which you won't get. In short after filing you have 28 days before anything else happens. If you wait to file with the court it will simply add more delay - just what Barclays want Spotty
  20. Barclays are hoping that people won't go that far. It is your daughters money - don't let them keep it. You will have to go as far as getting a court date before they will pay up Spotty
  21. You posted your LBA on 17th August. That gives them 14days to respond positively before you take Court Action. Don't wait for them you should start Court action 1st September They are just playing for time. Don't give them any , it will take long enough to get your money. Spotty

  23. Until you get to the stage where you have a date for the Court Hearing it is unlikely that you will be able to barter with them. At this stage you have two options 1 Take their paltry offer (£500) 2 Follow the steps in the library and get it all back. Disadvantages of 1 is you only get half your money but quickly Disadvantage of 2 is you have to wait a long time but you'll get it all back. The choice is up to you. Spotty
