Afternoon, Can anyone please help, i was driving home last night and crossed a swing bridge on Chester Road Warrington, when i crossed the joint between the bridge and the main carriageway i felt a crack from under my car. i inspected the car and found both coil springs have snapped at the same time. I have looked into the joint on the bridge and found they are not level and in fact found the bridge road 22mm lower than the main carriageway, i have reported the issue to the council who have replying stating its not there bridge and pasted me to Peel Ports, i have reported the issue to them as well. I have had my car inspected by my local garage and they have confirmed both from coil springs have snapped and need replacing, the cost of the work will be £180.00, my question is can i claim off Peel Ports ?
  2. I myself pay the rent and all the other bills its been challenging over the years we have never claimed benefits always try to pay our own way. My wife works hard as well only part time 16 hours we also have children living at home as well.

Afternoon, i did have bailiffs around to the house just after my bankruptcy relating to a debt which was listed correctly within my bankruptcy they left with nothing, i think that`s why she thinks they may come around to our house, personally i do not think they will carry out the threat as they will have to spend money and get nothing in return. just going t wait and see if they file as this will be best option to clear the wife's credit file.

The shortfall relating to our house and dates back to 2009 when the house was sold by G E money. i have explained that the bankruptcy will clear the shortfall and any our debts and the bankruptcy fees will be paid by the claimant. My wife has no assets and no saving, our family car is in my name with proof of payment, i also have a car but that has finance outstanding as well. Items in our home are nothing flash normal TV, fridge, and general household goods therefore overall in real terms she has no assets. but she is a little worried after the bankruptcy bailiffs will come knocking.

We have been chatting all weekend regarding this issue, i have a question regarding the process of paperwork relating to bankruptcy, the statutory demand is only a demand and the claimant must submit the main bankruptcy papers to the court and my wife and the Bankruptcy fees paid in full by the claimant. Once the papers have been sent to my wife can she added all her debts to include them within the bankruptcy. After speaking to another family member regarding this issue they have stated the only reason they have issued bankruptcy papers is not to get funds back but try to make us homeless as they think our landlord to cancel our tenancy agreement, i have read our tenancy agreement and there is no clause relating to bankruptcy coupled together we have been with the same landlord for over 7 years with no payment issues, however i have spoken to our landlord who we have a good relationship and he has no issues and this will not effect our tenancy.
  6. My wife did`t file for bankruptcy in 2015 as she was to upset to attend the court and we cancelled the appointment, the last payment was paid to the claimant was in Sept 2014 and nothing since.
  7. Yes totally agree, we need to send the form to have this set aisde on Tuesday when the court opens, which forms are required to complete this process.

  9. Yes, its states our local county court near our home address this is in the Part A form 6.1.
  10. It is strange that the demand is dated 06/03/2017 and issued on 15/04/2017 with postage date of 12/04/2017. Therefore can this be void due to the date errors ? once the demand is issued what paperwork is issue next is this by the court ?
  11. The demand was sent via royal mail post dated 12/04/2017 signed for but it was just posted by the postman ( The demand itselft is dated 06/03/2017 )

Part A - States details of the county Court Part B - States Solicitor details Part c - as well So looks very official paperwork, i have few questions regarding this paperwork 1, If we do not reply and bankruptcy is issued, My wife's credit file will be cleared of all outstanding debts including an old mortgage shortfall. 2, Who pays the fees for the bankruptcy ? 3, If issued will bailiffs visit and try to take goods from our home 4, We live in a private rented house rent full paid and been with same landlord for 7 years. By making my wife bankrupt will this mean an end of this matter.

URGENT HELP Well letter today, My wife has had a letter as follows: Issued today Statutory Demand under section 268(1) signed by the claimant on 06/03/2017 yet the demand envelope dated 12/04/2017 ? They forms state we have 18 days to have to bankruptcy set aside or pay a total of £21,000 in full, we cannot repay the amount and my wife will not go to court as she is too upset. With the form it states payable immediately, it also states property and goods can be taken away from you ?
  14. Hello HB, No nothing since September, we have been told by another family member they intend to drag this through the courts, as you an see our family has been ripped apart completely to the point my wife has been verbal threatened by another family member to get it repaid.

Well just wanted to add the detail from the letter which was sent on 6th April Re: Debt due to Mr & Mrs ABCD We refer to the above matter and did write to you some time ago but it appears no progress has been made to settle the debt due to our clients. We are therefore giving you notice that due action will now commence against you within the next 14 days and you will be served with statutory notices and action via solicitors. We: the clents have tried to settle matters without success and are left with no alternative but to take legal action against you. If need to contact then please correspond back or call mr on 01234 56789 Your sincerely signed by Legal Manager Once again the letter has come from person has sent the letter printed off home PC, he has added company details including all the directors names and the company registration of a company which according to companies house is active but filing dormant accounts thus not trading so potentially he must be committing fraud by using their details with or without there knowledge. I have told my wife we have nothing to panic but she is concerned about what they are going to do next if anything, i do have a few questions 1, Should i report this to the police statng my concerns and if how would i start with reporting this matter? 2, They state you will be served with statutory notices would this be in joint names, thinking this would be to obtain CCJ in joint names first with a view to bailiff action to recover the claimed debt. 3, If they obtained the CCJ who applies for bankruptcy as clearly we cannot repay the amount which they claim is outstanding 4, If they issue a statutory notice ( Demand ) this relates to bankruptcy if that`s the case who has to pay fee fort he bankruptcy 5, We have not assets and live in a private rented property same landlord for 7 years fully paid up rent with no issues i have read the rental agreement and there are no clauses relating to bankruptcy, we own a family car 11 years old, and i have a car on lease / finance which i need to get to work, apart from TV, fridge we have no other assets. Last question is should we write letter again stating our position as proof we are replying to there demands as if this went to court we would have a paper trail of proof. or just sit back and wait for there next move regarding this matter.

I have worked for a company now for 4 years with no issues and in fact worked hard and last year promoted to Help desk Manager looking after a team of 10 staff, since starting the role i have hit all targets and never had any issues. however without any notice the General Manager asked to change my role within the business and focus of the warehouse operation. From being a manager my new role is technical adviser so in reals terms a big change. The company have not confirmed any thing in writing and the only letter sent to my home address relates to a 2% pay increase but they have requested i sign and return accepting the terms of employment. My work has never been questioned and always worked over my hours to complete any work, i did find out my calls are recorded and emails monitored without any notice, i have nothing to hide any way. i have now returned my company mobile as not taking calls after working hours this has not gone down well. Do i have any legal rights and do they have to confirm in writing any changes of employment Any advice would be great

Well they make there own rules, advised not to drive from the Broker until the details are correct on the MID web site, unable to get to work now as train will take 3 hours, my boss is not happy just like me. Paid insurance and unable to drive the car, complete mess the only good point the policeman last night trusted me when i said its insured instead of towing the car away. Now playing the waiting game

  19. Well first time ever i was stopped my police for no insurance, which was a shock as have been paying the policy and not missed a payment. The policeman was great showed me MID detail and yep states no insurance. Spoke to Autonet this morning and they confirmed the policy taken on December 2016 was live and all payments up to date, I asked who informs MID and was told Ageas not the broker. Now left in the dark as unable to drive my car waiting for replies and getting nowhere fast. Dont want to drive the car as the next policeman may just tow it away :-x:-x:-x Has anyone been in this situation before totally confused

My wife has just had 3 letters today: Letter 1 from Payday Uk stating they have now sold the debt to PRAC Financial Ltd on 9th December 2016, giving a formal notice of assignment of the debt Letter 2 from PRAC financial stating they now own the debt of £349.77 & B W Legal will be acting as their Agent. Letter 3 From B W Legal stating as the agent for PRAC they are demanding full payment of a debt which was £100.00 and is over 5 years old. If this debt is over the 6 years is it classed as statute barred and are all debts over this timescale removed from a credit file

We moved into a new house 2 years ago and requested landline & internet from BT, the services were connected after waiting 16 weeks and when they started thats when all the issues come to light, phone never worked correctly, internet was very poor, so after many calls we cancelled the account and returned all the equipment as well. We never had any contact from BT for about year when out of the blue they sent a bill of £495.83, we wrote back refusing the to accept the debt, we have had letters from different collections firms and now a company called Lovell ltd have wrote stating they will reduce the amount to £123.96 !! They state on the letter " Pre Legal Assessment " and request that i call them back ASAP to avoid legal action, i have already checked and BT listed a default on my credit file regarding this account, can anyone help to my next move to bring this issue to a close, if i did pay would they remove the listing on my credit file.
