  1. I have received a letter from Horwich Farrelly acting for Barclaycard, it states: We have been instructed by the creditor to claim from you full payment of this account. Can this be called a termination notice? Thanks
  2. If an OC has agreed a monthly payment plan, can they still increase the amount of the arrears each month i.e. on starting the plan you are £400 in arrears which is £200/mth, after 5 mths paying the plan is it possible that the arrears can be £1400 Thanks
  3. I'm trying to establish if the amount of arrears on the default notice can be challenged, thereby rendering the default notice invalid. I was on a payment plan with them for 2 years, it seems that they were adding about £200/mth onto the arrears during the time I was on the plan. Can I argue that the default notice is invalid because nothing should have been added on to the arrears amount while I was paying the £4/mth payment plan. Thanks
  4. I've had over 70 phone calls from Lloyds, despite telling them every time to only contact me in writing. I've exchanged letters about the calls with their complaints dept and received an offer of a free gift by way of an apology. The calls still continue. I’m thinking of writing to the overall boss of Lloyds and my MP about the calls. Question is who is the boss and where do I write to. Thanks
  5. They said they wouldn't apply any interest or charges when I started the payment plan in June '06. But since Sept '06 I haven't received any statements.
  6. In June 2006 I went on a payment plan with Cap One paying £4/mth. The debt was over £6K. After June I only received a couple of statements but I noticed the amount of arrears was going up in big chunks. I asked for a copy of my agreement in November ’08, which they failed to supply. They defaulted me last week, I noticed the arrears amount was over £6K only a few pounds less than the balance. Could this be correct? If they keep adding to the arrears it will be more than the balance this time next month.
  7. If a creditor sends you a threat o gram saying pay the full amount owing in 7 days or blah blah. Does this mean the account is terminated without a default notice having been served? And what are the implications? Thanks

Just had a call from Link, after the usual preliminaries i.e. I won't go through security - we need to discuss a payment plan, contact me in writing only - we are a telephone based company, etc etc. "I'll put you on hold so I can see what we can do if that's ok", go ahead I say, the music comes on, "yesterday all my troubles seemed so far away".

  15. Intrum Justitia have contacted me 4 times, each one was a threat that they didn't or couldn't follow up.
  16. When they first rang the phone display said it was an international call. The guy had a trace of a dutch accent. He said he was calling on behalf of Halifax, when I asked him the name of his firm he said Global International. I've had the usual DCA calls before and just told them to put it in writing, no problems. But this guy was like nothing I've experienced before, he was rude, threatening, aggressive and persistant, he called 6 times in 3 hours. I haven't made a complaint before but I will against this lot, and I will take it as far as I can. Question I'd like to ask is, where, how and with whom do I get started? Thanks

  20. I've got 3 at the moment chasing an alleged Am Ex debt, RMA, UCA (United Creditors Alliance) and Westminsters Solicitors. Surely someone has more than 3, lets hear about it.
  21. Mr G Fearn of RMA has kindly sent me a card saying he is calling on 2/3/09. I live in Durham, has anyone else received a card from this nice Mr Fearn saying he is calling and where in the country will he be visiting on that date.
  22. Apologies if this is so simple I should know the answer, but I don't. Some DN's have the full amount of the debt on them, yet others only have the amount of the arrears. Why is this and what are the implications for the debtor. Thanks

  24. This is an area where I feel us caggers could be more organised. CAG could have a record of cases where caggers have been to court and the creditor has made false statements or produced false paperwork, only for the judge to say on the balance of probabilities I don't think a big bank would come to court and tell lies. If the defendent could then produce a list of cases were the same bank has done the same thing, the defendent could then say do you think on the balance of probabilities that all defendents in these cases or the bank was telling lies. Something along those lines anyway.
