  3. Incasso could apply for a re-determination hearing, they could then ask the judge for a charging order. That is what they did with me, trouble was the clowns didn't take into account I live in a rented house.
  4. I've received a letter from a DCA titled Notice of Collection Visit. It says someone will visit, not may, but will. Bit of background info. OC have a CCJ against me, they tried to get a charging order but failed on account of the fact I live in a rented house. The judge ordered that I continue with the small monthly payments I was making. This I have done without fail. Without any NOA a DCA wrote saying I had missed payments, I phoned them to say I was still paying OC as instructed by the court, I said I wouldn't deal with them until debt was legally assigned to them. I also told them on no circumstances to send a doorstep collector. Assuming someone does turn up what would be the best way to handle the situation and cause the DCA the most pain. Thanks
  5. I wonder if individuals can get a civil restraint order against a bank for continuing to phone after they have been asked not to.
  6. If a student goes to uni and has their course fees paid by the local education authority, but doesn't complete the 3 years, can the LEA claim back the fees that they paid? thanks
  7. A while ago Link Financial were throwing default notices about like confetti, I received one dated 26/9/08, I was asked to pay up by 10/10/08, is that 14 or 15 days? I read somewhere that you should add on 2 days for postage time. I'm asking is it valid or not taking the dates into account. I received it 6/10/08 but there were no date marks on the envelope. Thanks

  9. I'm aware that say Lloyds credit card company can take money from your Lloyds current account, it's not nice but I know they do it. But can they take payments for your credit card when the current account is already overdrawn, thereby increasing how much overdrawn you are.

  11. Thanks Wouldn't they just be able to print off and back date a NOA, I was thinking of ways of putting the onus on them to prove that they sent it and that I received it.
  12. I've received a letter before proceedings letter from Westminster Solicitors on behalf of AM EX. Previously I'd already informed AM EX that I lived in rented accomodation and was unemployed. After 3 mths they haven't complied with my CCA request either. Surely they can't seriously be taking me to court, this has got to be just another threatening letter, right?
  13. If I get taken to court by a DCA, and I haven't received a NOA, how do I prove, I know I shouldn't have to, that I haven't received the NOA. Is there anywhere that I can print off a hard copy of rules/regulations that show that the OC should have proof of posting.
  14. How many times do you think Cabot will phone me to be told, put it in writing I won't discuss it on the phone. So far it is 30, and I still haven't received anything in writing.
  15. If you make a full and final offer which is accepted, and you then make the payment, what can you expect to receive by way of a receipt? Will it say something like, paid in full, account closed, or what exactly.
  16. 3 mths ago Tesco personal finance took me to court for a re-determination hearing, basically to ask for a charging order. When I told the judge I lived in rented accomodation he dismissed the application and said payments were to continue at £7/mth. Today I received a threat 0 gram from intrum justitia saying since the court hearing I haven't been making the payments and they were going to do this and that etc. I have been paying and can prove it. Should Tesco and intrum have made some contact before now to say that the debt had been sold? Can intrum take me to court again to try to get more? Will the fact that I haven't been informed about the sale of the debt have any bearing on a possible court hearing? Any advice would be appreciated Thanks

I read, I think a judgement, somewhere on here that if the prescribed terms aren’t on the signed agreement then the agreement is unenforceable and the money that was lent should be classed as a gift. Has anyone else seen this judgement and could you post up a link please. If the above is correct and the money is a gift, then surely the “creditor” can be made to remove all adverse references from the CRA’s. What do you think?
  18. Personally I have just sent them an account in dispute letter, not the formal one like in the post above, but my own simple one. Then I have sat back and done nothing, if they want to try their luck in court then I'll deal with that at the time. A lot of people on here get involved in sending them letters and pointing out their errors. If that's what turns them on then fair enough, it's not for me I prefer the sit back and wait approach.
  19. If you are being persued for a debt that hasn't an enforceable CCA, and the creditor threatens to and then issues court papers against you. Would you be able to counter claim, saying your credit rating has been ruined by them putting a default on your file with a CRA, and sue them for damages. If you can do this could you claim legal aid to do it. If so how do you go about getting legal aid? Thanks
  20. If a creditor has failed to supply a copy of an enforceable agreement and the account falls into dispute can the creditor add interest to the debt? If they can't is it a law or just a guideline, either way could someone kindly put a link up to the law/guideline. Thanks
  21. I CCA'd RMA about a month ago and haven't heard anything untill today. They sent me a letter saying as I was such a good customer if I phoned them I would be entitled to a special settlement offer. Wonder what's going on.
  22. I've been reading the thread with interest and I'm now going to go for my charges back. I'm not trying to hijack this thread, I just thought I'd ask for some advice and get started off in the right direction before I start my own thread. I had a card with Citi who sold the debt to Hillsdens, they got a charging order and the house was sold 4 months ago, the debt was paid off in full including the unfair charges. I'd like some advice on who do I chase for the charges back? How do I get started? and which would be the best forum to put my thread on? Any other advice and suggestions would be vey much appreciated.
  23. Under the following circumstances is it possible to claim back unfair charges on a credit card account. I had a Citi card, the debt was sold to Hillsden who got a charging order put on the house. The house was sold 4 months ago and the debt was paid off in full including any charges that were added on. Is it now possible to get the unfair charges back, if so how would I go about it? Thanks
