  3. I used to hate the postman coming. I lived with parents and hated the thought that people were going to turn up at my parents house and start taking things (which I believed would happen at the time later to find out it was a load of tosh). I once had a calling card off a DCA saying they were coming to see me at my home on 25th December. Imagine the panic of that thinking they were gonna turn up on the door at my parents house on Xmas day. I lost weight (went down to 9 stone, I'm a skinny lad anyway so being skinnier didnt help) and could never sleep. I then found the power of the internet and googled the DCA. Amazingly CAG came out on top and I had a snoop round there and asked question in which i got helpful and lifesaving answers from fellow CAGGER's. Now I'm up to 13 and a half stone, sleep soundly at night and have bombed off around 6 DCA's. I love getting letters off them now (which are few and far between unfortunately) as I know its all empty threats and I know how to handle them and kick them where it hurts. It may seem bleak at the moment but trust me, use the advice you get off here and you will find life just gets easier and easier

  6. Just been looking through some forums and the blockbuster membership agreement and it mentions that you will be charged 0.90p a night per item on new release DVD's. It is called extra night option fee. So if my sums are correct: 4 DVDs x 3 nights x 0.90p = £10.80 and not £35 in which they are hounding my friend for. He would of had to of had 13 DVDs to get a bill like that. I will go down to the store with him and tell Blockbuster that they can go forth and multiply sploits

  8. Good Morning fellow CAGgers, A friend of mine has asked for my help on a problem he has. He rented 4 movies from Blockbuster in our town. Unfortunately he got them back 3 days late due to some family problems. Blockbuster had sent him a letter demanding £35 as late fees. He ignored this and now he has a DCA on his case saying he has 7 days to pay up the £35. I havent found out which DCA it is yet (will post hopefully tomorrow at some point) as he is at work. How does he stand on the matter? Thank you in advance Sploits
  9. I think the chance is miniscule to nil. If they ever did turn up (which i highly doubt they will) then stick your head out of an upstairs window and tell them to go forth and multiply.I am yet to see a "doorstep collection agent" turn up for anything like this so dont worry about anything Sploits

  12. Hhhmmmmm let he who has not sinned cast the 1st stone. Everybody makes mistakes. I'm sure at some point in your life you will have made a mistake that you probably regret. The guy has made a mistake, got caught and will now deal with the consequences. I'm sure he will accept these as a responsible adult and then try and get this part of his life into the past. The advice that you are offering isn't helping anyone
  13. After receiving 2 letters from Roxburghe Debt Collectors over unpaid parking INVOICES from APCOA, I decided to start get in touch with them. I noticed they had an email address so I setup another email address and sent them an email as follows: Hi, could you please email me a copy of your complaints procedure? I plan to do something about your harrassment to me for chasing an unlawful and unenforcable pathetic APCOA parking INVOICE. Also the letters you send out seem to be breaking alot of rules. Maybe you should do some reading up on websites such as consumer action group or pepipoo. I can send you links if you cannot GOOGLE them yourself. Can you email me this ASAP so I can proceed accordingly. Failure to do so will result in me contacting Trading Standards, my local MP and the OFT. I await your response, Well that was sent yesterday and no response so I thought I would get back in touch with this: Good morning, Well you have yet to reply to me regard the below email.   14. This sounds like the Morrisons in my town. The Sport Centre is right next door and people always park in Morrisons and hop over the wall and go in. Just had this sent through from checkmyfile.com Consumers attempting to get credit card or loan balances written off by exploiting legal loopholes are facing the unwelcome choice of either repaying their debt or severely damaging their credit rating. A test case in the High Court saw a judge rule a £17,000 RBS loan as unenforceable - after the lender was unable to produce the original credit agreement within the required 12 day period. More importantly, he also ruled that although the loan is unenforceable within the meaning of the Consumer Credit Act 1974, the obligations of the original contract were still valid, clearing the way for RBS to continue to pursue repayment. If a loan is judged as ‘unenforceable’, lenders aren’t allowed to take the usual legal routes to recovering debt, such as obtaining judgment, sending in bailiffs, obtaining charging orders and so on. Instead, they will be within their rights to continue to press the consumer for repayment, including the use of debt collectors, to lodge the record of any default with credit reference agencies, to claim any credit balances held under rights of set-off, and to rely on any security they may hold such as mortgages or guarantees. Around 100,000 claims for ‘unenforceable debt’ are believed to have been lodged with the courts to date. Over 3000 Claims Management Companies (CMC’s) have sprung up as a result. The majority of claims are based on the notion that original documents are not legally enforceable, especially in cases where the lender is unable to produce original copies. As we’ve reported previously, most claims stand very little chance of success, and a number of CMC’s have actually been banned from operating due to misleading advertising and over-inflated charges.   18. Good morning, my mother used to insure her building and contents with Aviva. When it was coming to an end she found a cheaper deal with Nationwide in which she decided to go with. She thought that the Aviva insurance would just finish at the end of the 12 month period and she cancelled her direct debit to them. A few months later she recieves a nice letter of Westcot. They say my mother owes Aviva £100 for unpaid insurance cover for a few months. My mother was obviously a little shocked by this as she was now with Nationwide. She contacted Aviva who have told her to send them copies of her Nationwide insurance details to prove she is insured with them and they will waive the cost. She is sending the letters out today but she is still getting hounded by Westcot. The usual threats of we MAY take you to court, we MAY come round and kipnap your dog etc. I have told her not to worry but she is a worrier and wants this all sorted out and Westcot to disappear. What is the best course of action? I know the golden rule is not to phone them but i am tempted to phone them (acting for my mother) and tell them the story of what is happening and back off but will they actually listen??? Once Aviva have the relevant forms from my mother and waiver the cost will Westcot still send demanding and threatening letters? It wouldn't be so bad if she wasn't such a worrier over things like this and its the 1st time in her life she has had to deal with anything like this so again the worry kicks in.   20. If the CCA is enforcable then yes they will keep pestering but then again even if its not they will keep pestering too. Best thing to do is learn to laugh at these idiots and have fun with them. If they haven't got the statements you want (which they should but this is a DCA we are talking about) then I would personally S.A.R. crap one and everything would be in there. Also as babybear suggests the statements should be available FOC so you could always ask crap one for them direct. Have Lowells stated that they bought the debt or just trying to collect it on crap ones behalf? If they have bought it then they SHOULD have all the paperwork including your statements.   21. Well I always send in the CCA request to see if they actually DO have a CCA. 99% of the DCA's I have fought have never had a CCA and soon disappear under the rock in which they came. The other 1% I then hit with the unlawful charges route and again they disappear. I would always ask for the CCA purely to find out if they have an agreement and if it is enforcable. If its not enforcable and court is on the cards we just pray for a decent judge who knows the law Sploits

I would just send them a short and to the point letter saying somethign along the lines of: I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY Can you please provide me with all statements relating to account (ref number) in which you alledge I owe. Regards, Print name don't sign. If that fails then you could S.A.R. Crap one to get everything from them which will include the statement of account. Hope this helps

Ok Cant find the original letter but i have found the reply that i used when i found out there were unlawful charges on the account: I DO NOT ACKNOWLEDGE ANY DEBT TO YOUR COMPANY I have looked over the breakdown of account that you sent to me and I have noticed numerous charges on the account which are unlawful to common law. I have attached a breakdown of the unlawful charges in which I am claiming with this letter. I hope that you will enter into a sincere dialogue with me about this matter and I am writing this letter to you on the assumption that you will prefer to do this than merely respond with standard letters and leaflets. I will give you 14 days to reply to me accepting, unconditionally, my request in principle and letting me know a date by which I will receive payment. We look forward to your reply.   24. I had a problem with TBI financial and i basically just asked for the statement of account. This will be your account activity and should show what has been spent on the card, what you have paid on the card and what charges have ben added. Will have a look through my paperwork and see if i can find my letter. Also if anybody else has some correct wording for requiring the ststement of account from Low Lifes..............
  25. Why are the signatures out of line and why does your signature look like it has been photoshopped on it. Look at the top line of the box. Where the signature is it looks like its missing. That wouldnt happen on a hand written CCA would it?
