  3. Excellent. Well if they get in touch with more threats I will just sit it out until they vanish. If they get in touch and agree with me then thats great. If they just vanish then thats fantastic. Just half waiting for Meritforce to pay me a visit. Will chase the muppets right down the street if I have to lol. Thanks again for all your help. No doubt I will post on here again if I get anymore serious trouble off these clowns
  4. Thanks for the quick replies guys. So I just sit and wait and see what they say about the statute barred argument. From what I have read I'm not actually expecting them to read it and I'm just expecting more threat-o-grams off them. After that is it the Complaints line? Or is it possible to nip up to scotland with some of my friends and make a doorstep visit
  5. Hi, has anybody ever got a decent reply from Mackenzie Hall when emailing them? I have sent off the statute barred letter but today I thought sod it and sent it an email version of it to around 6 Mackenzie Hall email addresses (well I thought if they can fire loads of letters to me why cant i lol). Finally got a reply from a Mr. Michael Dorrans saying they couldnt discuss it over email but he would gladly help if i phoned him (as much i wanted to phone him and give him a load of verbal i resisted temptation). I did email back saying that the letter was on its way anyway and that I wanted a speedy reply to state that the account was statute barred and that they would close their file on this and wouldn't be in contact with me again. Still waiting a response (which I now doubt will come lol) Is this the usual response from them or has he just fobbed me off?
  6. Hi apples76, I'm in the same boat as you. Had Lowell's chasing me for a statute barred debt then all went quiet for 6 months. All of a sudden I get a threat-o-gram from Mackenzie Hall demanding the money. The debt is around 8-9 yers old so I have sent the statute barred letter recoreded delivery (which I doubt they will read lol) and I'm going to work on a nice email to East Ayrshire Trading Standards when the next few threats come in. Just keep your chin up and hopefully these idiots will dissappear back into the woodwork

  11. Good Morning I hope everyone had a great weekend. Over the weekend I recieved a lovely letter from the famous MacKenzie Hall. The debt they are claiming I owe is for 1st credit and ended up in Lowell's hands at first. I CCA'ed Lowell's January 2008 and to this day I never recieved the CCA agreement. The letters still came in demanding money then all went quiet (I do have the all this in another thread). Then the letter from MacKenzie Hall came through. Ok firstly if they send anyone to my door they will be told to go forth and multiply. Secondly how can Lowell pass this on when it is in dispute? Thirdly does anybody have a clue what a saction is The alleged debt is around 9 years old and is 110% statute barred. What is my best way to deal with these idiots all help is greatly appreciated

  13. Good morning, a friend of mine has asked me what can be done to get himself out of a problem he has. He lived in a property until 11th November 2006 when he was evicted. He left the property but never informed United Utilities that he had left (he put it down to as he had been kicked out that the housing company would sort everything). He recently recieved a letter from a DCA (Advantis Credit maybe?) demanding £73.40 for water used between November 2006 - 16 April 2007. Obviously he is a little shocked at to why they would be charging him when he wasnt in the house but I have a feeling he would be liable as he did not inform United Utilities of his departure from the property. Any help on this matter would greatly be appreciated Sploits
  14. Subbing. A friend of mine is going through the same fun and games with Barclaycard/mercers. He was going to try and cough up (he isnt working at the minute so was going to lend money from parents/friends) but he spoke to me and i got a CCA request fired off straight away. Still nothing back (only been over a week though)but after reading your post I think I know what will be coming............No CCA

  16. Hi everyone, My friend is currently going through a hard time with his bank Barclays. He is £400 overdrawn, currently out of work so doesn't really have any way of paying the debt off. He has been worried sick about this and finally asked for my help. As a frequent user to this wonderful forum I assured him I would help to the best of my ability. I told him to get his statements from the last 6 years and we would look at claiming back all his unlawful charges. We sat and worked it out to the sum of £600. We thought fantastic and he felt a lot happier. Today he recieves a call from a woman at Barclays and she is demanding the money that he is overdrawn by. He tells her that he isn't paying anything and that he is claiming back all his charges. She then informs him that Barclays have won the high court case and they don't have to pay back any charges to anyone. She told him to check it out on the Internet. Is this true or was she spinning my friend a little lie?
  17. well is been well over a month since I heard anything back from TBI. Im just wondering what I should do now. Should I just sit back and class this matter as closed until i hear something back (if ever), or do I write to them asking them to close their files on this. I really just want to see the back of it and even though I havent heard anything back from them it still plays on my mind from time to time. Thanks Sploits
  18. For a subject access request they do need alot of info from you before they can release the SAR but the CCA doesnt fall under this bracket (at least thats what I believe). They are in contact with you and vice versa so surely this constitutes as them being able to send you the CCA and you receiving it. They are in default of your request for the CCA and if it went to court you could use this as your argument. Plus I doubt they would be able to produce a CCA in the courtroom if they cant produce one to you.
  19. I have had the same problem with Lowell. They told me I owed over £9k. I asked them to prove it and demanded the CCA ( this by the way was requested Jan '08 ). They told me they would get a copy sent to me. I still havent recieved the agreement and even after the carried on threatograms from Lowell/Hampton/Red they all of a sudden dissappear. Last I heard from them was around August so hopefully they will give up chasing you for a debt they cant prove and crawl back under the rock they came from. Just keep your chin up my friend
  20. M1sterP If they can't prove the debt you could demand that they remove the debt/default from your credit file. I think thought that they would put Satisfied/Settled on your account which is neither use nor ornamant (I'm positive it still knocks your credit rating down) but again you could demnd that this is taken off also. Firstly I would get the CCA requests out pronto and see what you get back and then we can see what the next port of call is
  21. WorriedGirl I'm not entirely sure about this one. I assume the default would be removed off your credit file or expire but you would still owe the debt and as you have been making payments against it and this would be what the DCA would use as their argument. Hopefully I'm wrong and if so I'm also hoping that Cerberusalert will point you in the right direction.
  22. WorriedGirl, if you havent made a payment or acknowledged the debt for 6 years then you most likely have a case of Statute Barred.
