  2. M1sterP I would get a CCA request sent off to all the DCA's. you may find the CCA's to be unenforcable or they may not have them altogther. I agree in what you are saying that people are in debt and they should be paying it back. But why should people pay back debts that have been purchased for 10% of the orignal value? Why should people pay back all the unlawful charges that these idiots add on to the debt. Why should people be bullied into paying back increased amount of debt. People CCA DCA's/creditors to find out if the DCA/creditor in question has the right to request the debt. Alot of the time DCA's hound people to pay debts that the seriously dont owe. Wrong name, wrong address etc so I would always strongly advise the CCA gets sent off. People shouldnt run away from their debts but if they cant be enforced is it wrong not to pay??? I have had Lowell and TBI pester me for over £10k and Lowell couldnt provide the CCA so I have told them basically to get stuffed (plus alleged debt is 8-9 years old so statute barred) and TBI have gone quiet on me after horrific threatograms after i told them i was claiming all unlawful charges back. It worked out that they now owe me about £40 well thats my little rant over, hope i have made sense in my dribble
  3. I still dont see what the problem is for them to send you the CCA. If they are sending the post out to you and you are replying back to them then why cant they send the CCA? Especially if you have sent them the £1 postal order. you have requested the CCA, you have paid for the CCA, you have proved you are getting their threatograms so the problem is???? Smells like they dont have a CCA to send to you but yet they still want you to cough up with the cash they say you owe.
  4. If you requested the CCA and they could not provide it I personally would want a final settlement amount of £0.00. Why give the idiots even more money on a debt they cant prove without a valid CCA or enforceable CCA. Well thats my thoughts anyway
  5. I agree totally with lickthewallfatboy. They have no dodgy come back if you have proof that they have recieved the letter via recorded/special delivery.
  6. Get the letter from the template letters and send it out with a £1 postal order to each of the companies you are involved with (who you supposedly owe money to). Do not sign the letter and put in big bold letters I DO NOT AKNOWLEDGE ANY DEBT TO YOUR COMPANY

  9. Hi, I always thought that for a CCA they didnt need a previous or anything from yourself unlike the Subject Access Request. Plus if they are sending you the threatograms to you at your current address they why cant they send the CCA to you. You will of sent off the request with the £1 postal order so unless they dont have a CCA I dont see the problem of sending it out to you. Also if they are going to take you to court how can they do that when it is looking like they dont have a CCA thus they wouldnt be able to prove the debt? Forgive me if I'm wrong and I'm sure there will be better people in the know in here pretty soon but that is how I read your situation. Who is the company that you are dealing with? Regards, Sploits
  10. Well look what was waiting for me when I got home from work last night I'm looking at this as good news At least I will have a worry free Christmas without these clowns bothering me. I will keep you all posted as and when I get the letters from these muppets (I'm guessing some idiotic response will come through next year). Thank you for all your help so far.   12. Hi Lowwill. I had the same problem with Lowell over an alleged debt. I sent a CCA request in to them and I got the same letter saying they would request it and send it to me in due course. A few weeks later I got the letters again sayin I had to phone them to make payment. I got the letters from Hamptons and Red (all part of Lowell's). Then all of a sudden it went quiet. I actually sent the CCA request into them January 2008 and as yet still haven't recieved the CCA and even though I haven't had the letter stating they are closing the book on this debt it has all gone quiet. I think you're on to a winner with Lowell. Just don't worry about them and have a great Christmas. All the best
  13. Hi, while I'm no expert on this sort of thing I noticed that the reason you took out these loans was due to bank charges. Have you thought about claiming these bank charges back at all??? What where the bank charges for?
  14. Well the letter went last night (recorded, signed for). So I guess its just a waiting game now for them to tell me some bull about how I cant claim back the unlawful charges. I will keep you all posted

  16. Hi, So what will be the best way to word a letter back to them. Do I just do a basic letter saying that I want to claim my charges back from TBI and this is the breakdown? Or is the breakdown more for if it goes to court? Thanks again

Ah right I am with you now. so I need to individually put every fee that I'm claiming back seperately into that claculator and I will end up with the final figure that I want to claim back. do I then send it to TBI? Do I say that it is the money I am claiming back from them in unlawful charges. I really appreciate your help.

  20. Thank you for your responses. Do I send a letter back to TBI. Sorry I'm just a bit frustrated here. I'm going to be more or less debt free come June next year (apart from my mortgage and my car loan). When I think I'm getting my head above water all this happens again !!!
  21. Hi, well last night I have my bank statements waiting for me when I got home so I got my pen out and started looking through the statements. The dates and payments amounts are correct. I had been paying this thing off!!!! The payments where stopped in 2004 so I'm completely lost in what to do now!!! Do i just cough up or is there something else that I can do ?????

  24. Billy I fully agree with everything that Al27 has said. Unless this goes to court (which I very much doubt it will) then you have nothing to worry about. Did the sign say that you would be fined £80 if parked here with out a permit? I believe that realistically they can only claim for money lost with you parking on the land. If they dont have payment meters in place then the amount they have lost with you parking there is nothing. Plus IF it did go to court the penatly they have given you is a bit high isn't it? They can only really give you an invoice for parking where you parked and i don't think they can hand out penalty notices (they aren't the police or the council). I got a ticket for parking on private land while I unloaded my DJ equipment. That was back in July. Its now December and I never heard anything after that Just don't lose any sleep over it.
