  2. Please offer me some advice if any body has any experience or expertise. My problem is that I bought a chandelier from Chinese seller on ebay on 4/12/17. I received message soon after I would receive parcel between 4-11 January 18 but was not given any tracking number. Parcel did not arrive by 11th January. I assumed because of new year there would be delivery delays. By 20th still no parcel. On 21/1/18 I raised an issue with the seller. He sent me a message that supposedly Parcel Force had attempted to deliver four times, the last time being on 20/1/18. There was no delivery note ever. On 22/1/18 i contacted Parcel Force by phone and they told me there was no evidence of any delivery attempt to my post code. However seller insisted, and supplied a tracking number which effectively showed one attempted delivery before parcel being sent back to china. At that stage seller wanted to refund my money £167 ( minus postage fee £57). I did not agree intially and raised a complaint at ebay resolution centre. After many emails between me and Ebay, the latter stuck to their guns that the seller had supposedly kept to their part of the baragin and therefore Ebay could not compel the seller to refund anything at all. That effectively meant the seller gets to keep their chandelier which they confirmed that they received back and the whole of my money. Ebay finds this 'reasonable' apparently. Since then I have contacted seller again to accept their intiall offer of some refund but now they are ignsoring my emails. I am disgusted by Ebay. Kindly help me recover my money. Abdel

    Thank you for this very informative piece. With regards to risks I can't remember what they explained. However I would not imagine that causing damage to an organ i.e my tongue, which was not at all part of the operation would constitute acceptable risk. The operation was meant to be on the side of my mouth internally to get to my salivary gland. I would value your opinion on this

    Dear Caggers, Last year went for a simple operation on my salivary gland at St George's hospital, London which was meant to be a one night stay job. I ended up being in the hospital for nearly 3 weeks two weeks of which in an induced coma. The reason being that whilst operating inside my mouth some damage was cause to the underside of my tongue which swelled up and necessitated my return to operating theatre for a second time to repair my tongue. Then i needed to have a third operation to have a tracheostomy (neck) done to allow them to ventilate me through it. The experience was horrendous in terms of the psychological effect. I still suffer from this and feel it has marked me forever. I suffer from depression now. i was pumped full of all kinds of strong pain killers. yet no one mentioned anything to me in hospital abut the psychological effects or what had happenned. its only when i saw the surgeon in outpatient some weeks later, he explained that it was possible that they had hurt my tongue with a tool that they normally use to cauterise small veins or stop bleeding with. i have spent 3 months sick from work recovering from this and still have numbness in my tongue as well as being marked psychologically with depression. many thanks for reading. Any advice would be much appreciated
  6. please advise. After searching internet for a cheap legal company to do my divorce papers, i settled on legal &Co based in Wiltshire. I have already paid for a fixed fee divorce at a cost of £460 plus another £400 for doing a consent order. They have hardly started doing any work for me when i have been shouted this afternoon 11/714 at by the case manager (john) simply for requesting an acknowledgement email for receiving my docs posted to them two weeks ago. I find the man John hyper sensitive and rude and now blaming me for rudeness. He so far as went on to say that if i did not like it i could lump it and there would be no refund. After i threatened to report to law society he backtracked and changed his tone a little and then ask me to send further papers so he could move my case forward. I have since lost trust in this firm . i dont know what to do now as i have already paid close to £1000. I dont know whether to carry on or withdraw from them. please advise
  7. Dear Caggers, I have worked for NHS as a community nurse for nearly 30 years now. Last financial year (April 2013 to end of march 2014) I had two major operations. The first operation was in may 2013 and I took 4 weeks paid sick leave. Then I had a second more complex one in October which landed me in a coma for 10 days. I had 3 months sick leave. I went back to work on 20th January 2014. I was put on a phased return for 6 weeks ( which incidentally was pretty much full time work) . My Case load was very busy and no one at work mentioned to me I ought to use up my annual leave before the end of the year. Then around beginning of march I was asked to go and take up post in a different team that was short of staff to help out for a short period of time ( one year). I agreed to go and started in the new team on 7/4/14. On my part I assumed because of my special circumstances I would not have any problem carrying it over. Recently I have had my annual leave balance from last year checked. I was told from my yearly entitlement of 33 days I had only taken 13 days which leaves 20 days annual leave to carry over to this year. Well my new manager is not happy and is quoting Trust policy that if any one goes on long term sick (21 days and over)then the amount they can carry forward in the next year is based on a 28 day 'statutory' entitlement. However if they were able to take their full 33 days within that period of a year it would be fine. My case is, I argue, exactly that after returning from my sick leave in Jan 2014 I was put on 6 weeks phased return. After that I was then asked to go and help out urgently in a different team who was short of staff. As stated above I picked the new team on 7/4/14. I argue that no management person or occupational health ever informed me of this supposedly recent change and no one encouraged me to use up my leave upon me returning to work in January. On the contrary there was an urgency for me getting into a new team to help out. There was also very little time left for me to exhaust all of my 33 days annual leave from last year. I feel I am being penalised for being unwell. has any one experience any such problems? can anyone provide useful advice?
  8. Today they called again from collections and left a message. I called back. They tell me they are investigating my complaint of six months ago and has now passed my file to their compliance team. Said they have removed my name from the auto caller. About the threatening legal notice letters said these are computer generated and can't do anything about it. I have quoted the case mentioned by rebel11 and told them am preparing a case against them.

Thank you. i do have a worry that they may claim that i have led them to pursue a claim which was already settled and hence want me to pay their fees. as i said previously i did not actually ask them to work on this but they did so on their own after sending a DSAR and finding out there was a loan with ppi on it.
  10. Dear CAggers, wonder if any one has some advice. i have been harrassed on an almost every other day basis by Claims Guys ( CGs) for payment of 'due fees'. This relates to a case they pursued for me on a 'no win no fee basis'. In fact, this particular case ( a loan from NAT WEST BANK, which as it turned out had already been dealt with succesfully by a differnt company a few years ago) was 'dug out' by CGs after they sent a DSAR to RBS concerning a different case relating to some credit cards. I was pleasantly shocked to hear from Claims Guys over a year ago now that they had found a case with RBS who owed me over £4500 in PPI and that RBS had agreed to pay. They did not tell me that this was the same case relating to the 'previous NAT West Loan. So i assumed it related to some other loans or credit cards that i had had in the past. They sent me the authority form subsequently and i signed it and returned it to them. Afte some time a letter was indeed received from RBS to say that they owe me the sum of £4500 apprx. To which, soon afterwards, Claims Guys quite rightly sent an invoice for their fees. However the payment from RBS never materialised . For over a year I got pursued by Claims guys regularly for their fees and i received threatenning letters that my case is being passed on to debt collection agencies- hamilton fielding. I kept telling claims guys i will pay them as soon as RBS sends me my cheque. They contacted RBS last October 2013 and they came back to me saying the letter of authority was old and RBS needed a new one. so i gave them a new one which they forwarded to RBS. Still no payment but still continued calls from claims guys as well as their standard threatenning letter. Then last year I complained about it by wirintg, They have not answered my complaints yet many months later. However after some time- december 2013 they told me that RBS had gone back to them and told them that there was no case as it had already been paid before and it related to a loan with NAT West. I confirmed that that was indeed paid some years ago. Some of the workers there told me that they were going to speak to their managers about getting my name taken off their auto calling system as there was no case to answer. Yet i find myself in May 2014 still having to answer several calls per week from rude staff who do not know really whats going on with my case except that the auto caller had put them on me. They continue to request and continue to generate threatenning letters. This is gettting beyong the joke as some of these staff are downright rude .please let me know if anyone has experience similar and what can be done to rectify or stop these. I have already told them i will complain to ministry of justice but this does not seem to stop them.
