  1. The endowment policy belongs to the proposer (The person who applied for the policy) and may have been taken out by you on your then other half or yourself. Or by your then other half on yourself or himself. Sometimes policies may are taken out on a joint life basis by you both covering you both. The person(s) insured are refered to in the documents as the 'Assured'. Until a policy matures (Read comes to the end of the insured period), life assurance cover is provided for the duration on the Assured life(s) for a minimum sum assured (£'sss). The normal intention is that the termination date would have been set for the mortgage termination date and then the monies due paid to the policyholder in order that you could pay off the mortgage and pocket the surplus (Dry laughter for those pursuing shortfall claims!) Whilst no expert, some mortgage companies used to insist that policies were legally assigned to the mortgage company. However, this fell by the wayside in recent years. Had your policy been assigned it would probably not be you that the insurance company is approaching now. It seems likely that you or your ex have ownership. VERY OCCASIONALLY policy benefits could be held in a legal trust or similar. It's worth pursuing, but it might be necessary to liaise with your ex to conclude. Speak to the Company and find out, but in the event that they are already dealing with your Ex, you might like to make them aware that you do not want your address details passed on etc.

Without going into legal specifics, the general rule of thumb is you need Road Traffic Act cover (Similar to Third Party Only) if the area where you're driving is accessible to other members of the public. So a private farm that has a long access road used by the postman in his van having to deliver the mail, then you would need to ensure that your vehicle is insured if it used here. The large privately owned car behind the factory, that has an access route to a unit at the back, then you would need to ensure that your vehicle is insured if it used here. There are always exceptions, but...

Hi 100Mel, EOH - irrelevant. 100 Mel, yes all such charges are reclaimable, follow the standard bank charge reclaim process adapting the wording. 12 year Statute of Limitations apply, not 6 years (England only). Not sure if you are North of the Border. Abbey will pass to their Solicitors (DLA Piper?) at court stage and file a defence, probably making a counterclaim for an amount not exceeeding £5K. They will then settle in full and drop the Counterclaim. Went through all this in early 2007 - a worthwhile exercise! H

I had a mortgage with the sharks at PML from May 2006 until September 2008, extortionate interest rates, lost my job in the interim and got royally scr*wed by PML with charges. Obstacles put up by PML/Capstone at EVERY opportunity to all proposals, even down to refusing to prepare redemption statements when we finally sold up. I have now just discovered that the sh**s have put a default on my file, albeit never issued us with a default notice! Anyway I have sent them a nice little DPA SAR letter today, so they can look forward to getting that in the morning! Hey ho! H .
  10. I don't profess to be an expert here, but if the account is in your personal name then a CCA request is fine. If the account is in the limited company name then CCA proberbly does not apply. H

  12. By Barclaycard Commercial, do you mean Company Barclaycard? Was the account yours and held in your name as a private individual or was it held in the name of a Limited Company? If the account was not yours, did your Employer issue you a card on their Barclaycard account for your sole use? H
  13. Overdone, Baltic Pine Conservatories Ltd. went bust in Autumn 2006 owing staff and suppliers monies. The whole factory in Penzance was sold off at auction! Note that building name 'Courtleigh! Was it not Courtleigh Debt Collection Services who say you need to pay Conservatory Basics limited. I would check out the names of Directors of Baltic Pine, Conservatory Basics and Courtleigh Debt Collection Services on the Companies House WebCheck service. Also worth finding out from the Receivers of Baltic Pine (GRANT THORNTON UK LLP, 11-13 PENHILL ROAD, CARDIFF CF11 9UP) as to what is happening. I always thought that any debts to a Limited Company had to be paid to the Administartors/Official Receivers????? I posted the link above to the Preferential Insurance website, if you click on any of the policy document links, you will see that the actual insurance policies are administered by UK Underwriting Limited, but the actual Insurer is AXA Insurance UK plc. Prefential Insurance appears to be an Underwriting Agency who are 'fronting' another insurance company's policies. Sounds strange, but surprisingly common. H
  17. Interesting to note that ALL the policies are administered by UK Underwriting Limited, but the actual Insurer is AXA Insurance UK plc. I have to agree with the comments made here by others that the policy terms leave something to be desired insofar as changing policy terms after a policy is incepted - Unbelievable! But then again, what do I know, only 28 years in the insurance industry, 24 years working for a Company that I couldn't possibly mention (Doh!) (And a Cruise fanatic to boot!) Get that repudiation letter, formal appeal to the insurance company and get their final response letter and then a complaint to the FOS and/or a Letter Before Action and a County Court Claim? (and don't forget lots of adverse publicity) H H
  18. Jem, How long before the cruise did mum book her place? Did she buy the travel insurance at the same time as booking? Or is it it an annually renewable travel policy? Have the travel insurance company actually put the reason for the redpudiation of the claim in writing to you or mum? If so, what reason did they give and what policy term did they say that she had breached. If not, I would ask them to send you a formal letter of repudiation as a matter of urgency.

VT is Voluntary Terminate i.e. Give the finance company formal written notice (See template letter in the link that I posted above) that you are cancelling the agreement by giving them back the car and the arrangement ceases - WITHOUT any adverse credit markers.   23. The contents policy will probably have a 'Pairs, Sets and Suites Clause' to clarify this issue. Have a look at their policy wording. Who is the Insurer and what is the name of the policy type? H
