  4. In summary, this means that any tenancy which does not go periodic MUST then be protected under the new Tenancy Deposit Protection Legislation. Seems it is supposed to Sheddy, unless the tenancy goes periodic which it hasnt
  5. Well mine was 'apparently' my own fault for not notifying them of my new address when i wasnt even on Income Support anymore, i was actually back at work and still working for the same agency. Nowhere as far as i know does it say ' you must keep the DWP informed of changes of address etc when you're not even claiming benefits any longer' I was evicted and couldnt give the post office a months notice to redirect my mail and my 'friend' didnt pass on my post although she knew where i was living. The whole thing stinks!

  9. If your tenancy date is 14th september then you can leave on the 13th without giving notice After the 14th it goes onto the rolling contract whereby you will need to give your 1 months notice not 2 You need to be more specific regarding the tenancy start date
  10. Sounds a bit dodgy to me, there is no real rule for what someone can charge in fees but as none of this £600 seems to be a deposit i would say this agent is ripping you off. Most fees are refundable except the referencing fees and admin fees Why are you paying a contract fee and an admin fee, surely they are one and the same?
  11. As far as i'm aware you can leave the day before the 12 month anniversary date, if you stay past that then you will have to give 1 months notice to the landlord. It doesnt become a statutory periodic tenancy (rolling tenancy) until after the anniversary date, when is it by the way?

If you have a tenancy agreement for 12 months then you cant leave before then (well you can but you'll have to pay the last months rent) although you can leave on the day before the anniversary without giving any notice at all, as your assured tenancy has then come to an end. Although most people do give notice that they will be leaving I'm not sure what initial term of tenancy is unless its the same as an assured shorthold tenancy Is this in England?
  13. Ouch i know this is gona hurt! but i have put things up for sale on there with this on and ebay has removed it! I dont think they do allow it as ive always had a message to say i'm breaking their t's & c's, i also lost the fees on one occasion and i think i got them back on another! I think the exception is cars etc. Sorry!
  14. If you have sky sports you'll even have to give 30 days notice to downgrade from that now. They'll do anything to make a bit more money off you so dont expect much in the way of sympathy from them
  15. I'm all for getting what you are entitled to but for goodness sake that stretching it a bit, i think the OP decided he didnt like the bed after all so has tried to get a full refund on everything. Some people arent happy unless they have something to moan about :/

  17. Yes ignore the cheque, infact post it back to them with the rejection letter and tell them you are going for the 3x the deposit back. Refuse to pay the bill until they can substantiate which portion of the gas bill is yours Did you ring british gas? In my opinion if the landlord is supplying gas to two flats off the same meter (i'm no expert but it may well be illegal to do so) the gas should be inclusive in the rent (which its not) Please ring british gas and get their advice on this and let us know how you get on

Short answer is yes he is breaking your tenancy agreement on two counts 1, obviously the deposit is not protected, you could if you wanted to sue him for 3x the deposit amount 2, he is not allowed to just turn up on your doorstep and certainly not allowed to just let himself in (you could've been naked or feeding the baby or something) whether you're there or not!, he has to give at least 24 hours notice Write to him telling him it's not acceptable to visit you without giving notice and that you require your deposit to be protected within 7 days (as required by law) or you will take further action
  20. Well i would be having a word with the landlord asking him to let you know what deposit scheme your deposit is in and asking him for a new tenancy agreement. Do it in writing and keep copies
