  1. I am sorry you got a claim form. I am no expert here, but I know the experts will need the following information, so please can post up the following? 1. The date of the claim. 2. The issuing court (probably Northampton). 3. The Particulars of Claim. Word for word, but removing identifiable information and rounding the amount up. 4. Are you a home owner? 5. Did you get a letter from MKDP entitled "letter before action" or "notice of litigation" or similar before now? This is the second thread today I have posted on regarding a claim by MKDP.   3. hi smugorwhat i had a tough day in court as BH put a barrister in against me and she pulled all kinds of tricks but in the end I wo n !! on two points and won costs against BH not a lot but i walked away with my car and BH were refused the right to appeal as well so job done. now i intend to challenge them for entering data with credit agencies without having an enforceable agreement in place if you are in a similar position you are welcome to my skeleton arguments and defences if you need them joe

  5. Generally the rule of thumb nowadays is if you are deemed to need a car then the value allowed is around £1000. If you current car is worth £2500 it would be taken and sold and you would be allowed £1000 of the sale price to purchase a new car. Alternatively someone else other than you can buy the benefitial interest in it, so would pay the OR £1500 or similar figure so you could keep it. Sometimes the OR will deem the car as unecessary and that it would be cheaper for you to use public transport when needed so would not allow you expenses to run a car.

  8. fine! i'd write back to whomever sent you the SAR inc a copy of the CRA report and ask why they have not supplier the info as if the default is within the last 6yrs then surely the data must still exist if the data does not exist then demand they removed the defaults and seek compensation. dx

  9. NO one SAR covers all accounts state you require ALL data relating to ALL accounts held with HSBC at any time, give as much detail as possibe all previous addresses if any.

  10. goods levied must cover all bailiff fees including removal fees storage fees auction fees and a portion of the debt if the value of the goods wont cover this then they should not be levied
