      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everyone,

 

Have started this thread to update as i progress with my claim. Its mostly in the signature but here it is in full...... hopefully have some more news soon......

 

Abbey Joint Account claim for charges.

03/07/06 Data Protection Act request letter sent 1st class recorded

13/07/06 Data Protection Act fob off letter received from Abbey stating microfiche records are not under the Data Protection Act, dated 10/07/06 from Pam Speed.

13/07/06 Data Protect Disclosure Request letter sent 1st class recorded back to Pam Speed

14/07/06 Some statements received

19/07/06 One months microfilche records received- waiting for the rest

21/07/06 letter received reply to 13/7. stating again that microfiche is not covered under DPA as its not a current filing system so will received it in due course, advised 4 - 8 wks.

04/08/06-non compliance letter sent- 7 days to reply

FWIW

 

In my opinion if you have statments and they cant or wont comply with the SAR then I would send an estimated claim with a rider that ytou reserve the right to amend or alter the claim amount and period when and if the other statments turn up.

 

It may put you further ahead, this is effectivley what i did but i started my setimated claim before waitng out the 40 day period for the SAR.

Just purchased the small claims kit- think i'm going to need it!!! Am getting a bit fed up of waiting for the postman these days especially when he doesnt't bring what anything i am waiting for! Any one else feel like this?

Have sent off 3 more DPA letters (with 3 x £10 postal orders, all getting a bit costly!) and there is still a few more to try and recoup charges from. However it all gets confusing the more claims you have on the go. Should be good at the finish line tho as i have 3 ccj's tied with an admin order and they are all for charges i am claiming back. Clear credit report here i come!

 

Rambling over , reality calls i'm needed to referee the kids!!!!

I see you got a few going on, well done and keep it up.

I would like to start on my credit cards, as I have a few, do you know if I need to submit a spreadsheet like I did for the bank chgs?

Also how did you up date your notes at the bottom to keep track?:confused:

finished my hsbc claim now its time to file a claim against abbey for non compliance (incomplete records received- only last 2 years) with claim for the charges known about- does anyone know how this should be worded on the claim form? thanks in advance for any advice.

the cheek of abbey- they have just called me asking when i will be crediting my account as its serious overdrawn. i told them i am in process of filing a claim against them for non-compliance of dpa act and claim for charges recieved pending more when i get the microfilche stuff. the woman said that not all the balance is charges and that i would have to pay them something. rude abbey.

received notice of issue (specified amount) yesterday however some of it is not filled in.... 'Your claim was issued on 16th aug 06. the court sent it to the defendant by 1st class post on and it will be deemed to be served on . The defendant has until to reply.

 

i found this very helpful!!! NOT. I actually got 2 of these forms one for abbey and one hsbc and the info is missing on both of them. Can anyone advise me the timescale and fill in the missing blanks! thanks in advance

ok- today after loads of waiting i received a letter from DLA Piper Rudnick Gray Cary it includes abbeys defence to my claim- it sounds pretty scary. They are maintaining the microfiche excuses and also say that as i operated the account in such a bad manner, 'the fees relect and are proprtionate to the defendants administrative expenses incurred due to the claimants breach of contract and are a geniune estimate of the damages suffered by the defendant' ....

Do i just sit tight and wait to hear from the court? What should my defense include? Please help.

ok found out i was fee excempt and have taken the allocation questionnaire and other from to court today. should receive letter within 3 weeks from court advising of hearing date. Fingers crossed.

no word re claim but have received a letter from shabbey today informing me that they intend to register default information against me in 28 days- this is signed Allan Betts head of unsecured debt management. what should i do?
