I also know that she changed her bank account so none of her payments would go through when she moved. I have sent the below to the police and solicitors again get told to pay it otherwise I will be reported and I have no idea what I can be reported for.     • Thanks guys. So, an update on this. One of the Directors called me earlier in the month. Not sure if they were pleading ignorance, but they genuinely seemed shocked at what I was saying about OPS. They said that once I was made Director, they wanted to discuss a way forward with me on this issue. I presume that meant putting in a solution that would mean that residents stop getting ticketed. Good result there, if so. Interestingly, a few days after, one of OPS's goons arrived at our site. One of my neighbours rang my doorbell, warning me that OPS were taking pictures of my car (which I left outside without a permit), and then were hiding behind one of our flats. I went over to confront said goon and basically gave them a piece of my mind; telling them that they were scammers and were trespassing, therefore should leave ASAP, or I'll take it further. Came back an hour later and was pleasantly surprised to see that they didn't ticket me, despite me not having a permit up. Not sure what this means, but maybe the Director and MA got spooked by emails and finally whitelisted me? I haven't heard a peep about my PCNs either, though no formal email to say they've been cancelled. Either way, very interesting results, which may indicate that my message is getting into their heads. I'll keep you guys updated as I hear more...
    • That sounds tough for you and I understand. But can you show us documents that have been sent to you please? People telling you things on the phone don't have legal standing. HB
    • So for statement of case I've just compiled all the documents already filed with the court (so claim form, defence and both WX) Would this be right? It's nothing new?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ive given quite a bit of advice over the past year on this site, and I'm praying I might get some back. Here's my problem.

 

I bought a suite from Land of leather 2 years ago and last year I ran over the "interest free" period. Fair play, my fault, so I had to pay the crazy interest rate.

 

Anyway...... About 5 or 6 months ago, my direct debit bounced so they charged me £30. I paid that. Then the next month they came in for more money than I expected, so again it bounced. Up til here it was my fault and I can accept that.

 

Having spoken with some very rude people at Open and Direct, I decided to let them contact me in writing if need be. I didnt hear anything.

 

I did however get some mail from Creation Consumer finance, which I treated as junk mail and binned, as I had never heard of them before. Big mistake. It turns out that this is the new name for open and direct!

 

Last week I got a letter from Greenhalghs solicitors saying there were now no repayment options and that they were taking me to court for the full amount. This morning, I got a letter from Wigan county court with details of their claim against me (form N1).

 

It is fair to say that I am now sh!tting myself as I have never had anything like this before. Help! what are my options? This has all happened over a 3-4 month period (from last payment to court letter).

 

Is there anything I can do to call off the dogs? They are claiming £2500 which I simply don't have, but could arrange some kind of repayment scheme.

The very first thing I would do is to make sure that the agreement is legal

1. Were you given two copies of the finance in the store to take away or was one forwarded by post when the finance had been accepted? One of these must be signed by the store to complete the finace agreement.

2. Did you sign all four copies of the agreement (one is sent to the finance company and one retained by the store) ask for copies?

3. If you took out a warranty or PPP is it signed on the finance form and the box ticked?

4. Is the pre contract box ticked?

5. Did you have it delivered to the address on the finance form?

6. Does the amounts and up to what is on your order form price of suite, delivery ect ect ?

The only way forward if it is 100% legal is to be honest is come to some arrangement with them to repay it is very clear on the documents what the payment date is.

Same thing happened to me. As you are in Scotland you can contest juristiction. In all the paperwork with the N1 form there is a bit to tick saying you intend to contest juristiction. Fill it out and send it off ASAP. You then have 14 days to submit your defence. (Basically that as you are in Scotland you want it heard in a Scottish court.)

I went to CAB, they told me to tick the form and send it off. However they never told me I then had to send off my defence. As I never did that the next thing I got was a CCJ for over £2000. I phoned Wigan court and told them about the mistake. They said CCJ would have still stood BUT as the judge is hearing a case to do with Scottish consumer law on Sept 28, they have put a hold on mine until then. My gripe with Greenhaughs is that I was paying through Payplan, they have all my income/expenditure, and can prove I am paying the maximum I can afford and taking me to court won't magic the money up out of thin air.

I know how worried you must feel, I was ill with worry, but it's not as bad as it seems. Go to your local court, they maybe can help you fill out the form. But you need to get it sent back, as they will go ahead in your absence and the next thing you know a CCJ has been issued. Good Luck!
