      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What a shame !!! Just to let you guys know im doing my bit from March 1st by refusing to pay Welcome any more money until i get a copy of my original Credit Agreement and statements of all the payments made on my account...Ive been onto them since Dec 08 asking for a settlement figure on a personnel loan i took out June 07 (yes i know i wish id never set eyes on Welscum) my wife and myself have just come into (very fortunatly) an inheritance that will sort us out no end financially. Ive missed just one payment since Jun 07 but now for some reason they dont want to play ball and give me a settlement figure nor no paperwork....So time to play them at their own game !!!

he he they can get as nasty as they want....they aint getting a penny more out of me until i see some paperwork and if im not happy with the over -inflated settlement figure they are certain to give me ill tell them to go whistle......Lets hope we are witnessing the beginning of the end of Welcome Finance

No i wish id charged them for the four letters ive sent them so far asking for Credit Agreements, Statements etc.....I will do with the Subject Access Request in March.....i cant wait for the phone call asking "payment for march"....."Erm send me some paperwork and when i recieve it ill pay you"...until then dont phone me again cos i wont answer !!!

I guess they push the business sideways, get a percentage !!....i think with this loan repayment of £500million due in July and reading into the Telegraph report/link they dont have any real assets so my wild theory is that i can see Welcome going for administration ?(is that right) around May/June

Well they can throw my post in the bin from March 1st because they wont be recieving any money from me...i usually pay them via my debit card so ive been a clever boy and ordered a new debit card from my bank to cover my arse in case those slimey gits have got my card details written down somewhere.....after hearing of cases of Welcome just helping theirselves to money from peoples accounts !!!

Im not gonna get into a political debate on here...saying that i hate Labour with a passion, but getting back on track your right companies like Welcome Finance and their dodgy practices need to "policed" much better, but i like yourself was silly enough for one reason or another to sign on the dotted line with them, but the last year or so i have become a lot more sensible and smart with money and now yes i realise companies like welcome are just rip off merchants !!!

Not to mention all the letters, SAR's, they get sent...and "never recieve" !!!...Oh well if they dont for some reason "recieve my SAR" in March (along with the 4 letters) they mysteriously have not recieved then they will get no money !!!...Lets see how they react then.

Probably not but then again look at the "hidden charges" Welcome [problem] us with.....thats why we dont get statements !!!!...Im doing the same with my SAR this month charging them £25 for every letter i write to them and £10 for every time i have to give up my valuable time to answer the phone to the little loves !!!

Well i dont want to throw fuel on the bonfire, but the Welcome Car Showroom...yes i know (more like a second hand car lot than showroom) near me has been very empty in the last week and the showroom bit only has roughly 10-15 cars in it normally it has around 40-50 and the outside pound is totally empty !!

Too right Andy, i for one have been paying them for two years have never had a statement and have no idea what charges have been levied against me, hence why im SAR..ing em lol, and im gonna chance my arm and tell them to go whistle when they want some money this month, hopefully ill play a small part in this disgusting companies downfall !!

This is a great day, i cant wait for my monthly phone call asking for money !!!...Just been for another drive round by Welcomes Car Showroom/dump near me....you'll be pleased to know the warehouse....is totally empty.....Are we witnessing the last days of Cattles/Welcome ?????
