try asking them for information about ALL accounts held in your name, as they will have upgraded your account when you were 18 as you say. send them another SAR asking for this and if they do not reply within the 40 day limit report them to the ICO. at least that`s what I would do. and just follow the advice that the three musketeers are giving you THEY ARE BRILL!! anyone care to help me fill in the N1 form. i stuck on the daily rate of interest. how on earth do i work this out? each charge is from a different date over a period of years so what do i put when asking 'when did the interest on the charges begin' at what point do i work the interest dates out. are they all in one? ive already worked out the interest for charges til tomorrow when i wanted to submit to courts.

 

please someone give me an idiots guide. ive read through and through and through the template but it doesnt explain when or where to apply daily rate.

 

ive downloaded and .xls Ssheet but its all dutch to me.

 

anybody care to help me on this or any of the other queries i got?

 

 

If i remember correctly it is from day N1 submitted (dated) daily rate worked out ( total charges + spreadsheet interest multiplied by £0.0022) = daily rate. if wrong no doubt somebody will correct me you can include the £10.00 for S.A.R - (Subject Access Request) as well. Might pay you to PM Seasidelady cos I`m sure she can help. a fount of knowledge that one

the number doesnt work and now ive wasted 40 mins going to the phone box with a number that doesnt work.

I know that large organisations do get it wrong cos it has taken me three years to the the NHS Pensions unit to put their number on their letters and not mine

The Halifax are known for changing their numbers, what can be a working number today, could be a dead number tomorrow, so what ever number people post on here, it is always hit and miss wether it will work. It is always a case of try it and see.

criticise?! all i did was point that either information given to me is wrong or that i have no idea of what is being said or that links provided have no meaning to me without an explanation. im trying to keep to a deadline with my claim and on weds/thurs things got a bit tense for me with me wanting to submit court claim.

 

so your kind of saying that if information is given to me that is wrong then i should say nothing and carry on?!

 

ive pointed out the correct number after id made a 40min journey(of course i was annoyed), maybe it was my mistake for not checking to see if the number supplied was correct.

 

if i gave you a map of directions from bedford to luton via inverness youd have an idea maybe.

 

ive not abused anyone here, if to criticise is to point out peoples mistakes then im sorry.

 

i cant express how much i do appreciate the help you guys give me, but that said that is all i want from you 'a little help'.

Just re- checked phone number again and THEY have transposed last 2 digits in area code 01652 and should 01625. now sorted. I would have had same cr*p as you on Monday. Rant-Off.gif

OK, i apologise if i did misconstrued anything said and also if i offended anyone. ill try and be more selective with my wording maybe, like said net chat cannot always be expressed in the manner its meant.

 

lets start afresh then.

 

earlier today i received the reply from the bank post dated for the 1/8 (deadline date) but post stamped for 3/8.

 

there reply says basically that 'the case being taken by the OFT is in hand and that all claims are suspended from the normal timetable of dealing with this situation' until the case is settled. they also say that if i execute a court claim they ask for a stay.(as expected) and they also continue to say that they will KEEP ME INFORMED of the situation.

 

After speaking with Financial Ombudsman yesterday afternoon i received today from them the complaint form reguarding their failure to supply me with T&C's as requested under protocol etc.

 

i will be filling in the complaint form over the weekend and then posting it monday morning.

Legally no, as it is the states money but they do. There is a method called appropriation which is something you can use if you are on benefits and they are taking charges off you presently.

I'll also post a link for that tomorrow.

p.s. Got a freebie off Tesco express saturday night. was out for my Bday heading up north for a night out. put £12 petrol in and bought a cpl of sandwiches on offer at 40p each and some crisp. total was £13.54, so gave the cashier 2 x £10 notes. Cashier gave me a £10 and a £5 and some change with the receipt. so i got out of the shop as quick as i could and left their property. On inspecting the receipt the cashier had rang in a £10 and a £20 note giving me £16.46 change.

oh how i laughed up the motorway. Cheered me right up. :)

Got my papers back from the courts yesterday and i assume Halifax received theres also.

 

Do i hear again from the courts regarding a date for the hearing? or do i wait for Halifax reply to the courts? or do i wait another 14 days for a reply of some sort?

 

had a good browse through various threads but cant see which one of these options is correct. i dont want to sit here waiting for a reply from halifax/courts if i shouldnt be.

 

I assume i wait for second contact from the courts but just to confirm please, thanks.

 

They have 14 days to reply from date "deemed served" on letter from court, check with court then to see if they have acknowledged service. if they have they have a further 14 days from date deemed served to file defence. If they have not acknowledged you can file for judgement. Use bottom half of letter from court.

Hi Foo, hope you enjoyed hols. have you rang court to see if they have filed defence there, if they have not you can immeadiatly file for judgment. They do make mistakes sometimes, so it prob worth a phone call. If case is stayed by bank or court you can use fact that charges are from benefits to have stay set aside. I am not sure how you submit "further Info" but I am sure some one here will advise on that, you can also ask court when you phone them. I would hazzard a guess that you have to use N244 application form, but this is only my opinion, which is prob wrong.
