We have a claim against Capital One for £879 in charges, occuring between 2000 and 2004. They have offered £290 saying the OFT allows them to charge £12 for every charge. We wrote back saying with 8%interest & court costs claim will be £1039,does anyone know if this is correct?. We wrote back to say that we are willing to accept £800, they have now replied saying £290 is their final offer, We are thinking of replying with a claim including compound contractual interest but don't know if this is the way to go. Any advice would be helpful, thanks.

Firstly the OFT £12 is irrelevant - the OFT did not give anyone the right to charge this, they only said they wouldn't take action (yet). Forget the 8% interest for now too. Use Vampiress's spreadsheet number 13 (VAMPIRESS'S CHAMBERS) to calculate how much interest they charged you on the charges and then send them a proper scedule of charges and interest as a LBA. If they still refuse to pay up then start a claim against them in the county court.

 

I would estimat that a proper interest calculation will bring your claim up over £2000.

 

I think you also need to do a bit more reading around the site to understand the proven process that we use here
