      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

received a letter yesterday from MBNA ! saying blah blah t&c's term 3b of my credit agreement.

 

how they don't agree with OFTs interpretation of the law, but they've now reduced there charges to £12.00

and they'd like to offer me a goodwil payent of £475.00 ? i thought they only owed me £180.00 ?? jesus how much do they really owe me ..

 

So .. what do i do now ? they've said they wil pay the money to link financial who look after the debt for them ? they've apparently already aranged this payment.

 

So....! do i write back and accept the £475.00 in partial settlement, I'm happy for it to go to link .. but ask that they still send me the statments for 6 years ?

 

help !! seriously confused.:confused: :o

I am happy to accept the goodwill payment of £475.00, and I am happy that you have arranged to send this directly to Link Financial reducing my balance with them, however, you have not addressed my request and therefore I cannot accept this payment as full and final settlement of this matter until I am in receipt of the requested documents and I have confirmed to you that I happy that this settles the matter in full.

 

1) You have failed to provide a complete list of transactions and charges as requested under the data protection request.

2) You have failed to provide notes, or documents relating to instances of manual intervention.

 

This is not an exhaustive list by any means, it is just an example of some of the information I am missing.

 

Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998.

haven't actually got it yet though ? did you work out how much they owed you i still have no idea.. ?

 

sorry they gave me £25 quid more i have no idea how they work it out... maybe they pick a number and go for it.

I didn't ask for the charges yet.. i suspect they are trying to pay people off before they find out how much they are really due.. costs them less in the long run.. used to work in customer service and we used to do it all the time..

 

joy of joys ! and i thought i was having trouble with Halifax god bless em !

 

anyway i've sent my letter above .. do have dealings with link financial if i don't get anyhting by wednesday next week i'm going to give them a call.. and give em some serious grief after all there call centre debt collectors were never the nicest to me .. my turn to get my own back ..

 

evil laugh and rubbing of hands together .....

I received my statements today. showing £495.00 in charges £20.00 they'd repaid me when I winged that I paid late because they didn't send my statement to my correct address !

 

good as sorted then.. ! I'm going to check Link have received the money and then send them a letter accepting the amount and cofnirming the matter as closed..

checked with link financial again - definately haven't had the money called MBNA and they say that link should be sent the money by the end of this week it's only just been authorised for payment - girl (Kate) confirmed that the total amount authorised for payemnt £485.22 ?

 

confusing as hell - I'm going to check again monday get nothing getting an LBA

Got a full refund plus some.

 

Charges totaled £475.00 - they paid me back £488.25 on Monday of this week to Link Financial whom I owe the debt to now.

 

now i only owe £295.23p wha hooooo!

 

I'll be making a donation when i get my halifax money through :lol:

very interesting thread this as at court stage with halifax plc and I was going to do MBNA next but was reluctant as over my limit at the moment, but after reading your thread and how easy they paid up, I will be sending them a letter requesting statements once the halifax claim is complete. Thanks very much for sharing this info with me.
