Scammed by Richard Hall (Capital allowances consultants ltd - Clavering House) investments into Cryoblast Limited 15/16 (Paul Huggins - Clavering House) and Eco Cooling solutions 16/17 (Anthony Fitches - Clavering House).    Mccuminsky - scammed by Capital Allowances after providing his details to Stefan Brown Alpha Tax Consultants (Clavering House) payment made to Eco Cooling Solutions.    Robson - scammed by Capital Allowances - 15/16 paid to Cryoblast 16/17 paid to Eco Cooling.    Myself - scammed by Allan Maxwell - MaxTax (other business Maxwell electronics) registered to Clavering House.   Cryoblast Solutions and Fast Tax - Alan O’Hara    Please note there are two Cryoblasts involved - Cryoblast limited (Paul Huggins and Clavering House) and Cryoblast Solutions Limited (Alan O’Hara also director of Fast Tax).    My return simply said “Cryoblast” another thing that should have been clarified as part of HMRC guidelines before paying out the claim.    Cryoblast limited was already suspected to be involved in fraudulent claims before my investment as Huntly had open assessments issued in November 2018.    Cryoblast Solutions, the same company director as Fast Tax where my money was sent was dissolved before my claims were submitted.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Jus sending my DPA request today. I am owed money by the Halifax bank and credit card too but Egg seem to be the most difficult and they also put a default on me due to excessive charges so its them first! I HATE THEM!

I changed address recently after being at uni so hope they dont ask for more security to check my address to slow the process up. We shall see.:)

Recieved a letter off egg on the 30th June, redirected from my old address which was strange, as they had sent me stuff in the post since changing address, saying they need proof of my address. However, my mam checked her bank and they had cashed the £10 dpa cheque immediately after recieving it. I rang them and told them the 40 days they had started when they cashed the cheque as they have my address and should not have charged me already if they did not have all the relevant information. I think I was right in doing this and surprisingly the man on the phone was very cooperative and agreed so wuhoo. So 40 days from the 19th June thats Sat 29th July unless its working days, ill check the faq about that. Cheerio.

DPA Countdown >>>>> 10 days to go

 

In the last post I reported that Egg had been cooperative on the phone, I thought that would have been an end to the address problem, no such luck. I have since had to contact them twice more to get them to change my address as they were still sending post to my old address and my internet banking address had not been changed. Twice more they have told me they have ammended it. We shall see.

Only 4 days to go and still no statements. They rang me a while back and the lady I spoke to e-mailed the department involved to remind them of the time limit so they know the deadline. Think Im gonna ring them to see whats going on.

When they eventually sent mine they were cut of on the left handside so that none of the transaction dates were readable. Three statements were missing!

 

I complained and Jenny Gordan who wanted me to send back the 128 documents in a small envelope that one would probably only get 4-5 statements in-But of course, if I had returned them, I would have lost my proof!

 

Humpty Dumpty really does need to be pushed off the wall-

Well they have 3 more days.

I actually managed to get a direct number for the London Head Office and have spoken to Jenny Gordon yesterday. She didnt sound too happy that I had got hold of her. At least I can pester the same person everyday now. Im sick of being conflicting info by different people. Yesterday I was told my DPA request and cheque had not been recieved which is utter rubbish. Because of this no action has been taken to retrieve my statements. Jenny is apparently ringin me back today after she has looked into the matter. Whats annoying is there doesnt seem to be any comeback on the bank for not complying with these requests, their getting away with doing this to everyone. Im going to ring her now to see whats going on. Ill let you know what she says.

He's on his dinner between 12 and 1 but he's the only person Ive spoke to that hasn't tried to fob me off and he gave me his extension so i could ask for him again.

Recieved my statements today (Day 40). It seems the phone calls to Jenny Gordon may have done some good. Might not have a chance to look through them properly today as they are a lot more confusing than the others I have recieved, many screen shots etc. From a quick flick Id guess at a figure of about £200 in charges.
