Ive won my credit card claim!!!!!!!!!!!!! Recieved a letter yesterday so should have it soon. Thanks to everyone who has given me help and I will make a donation to the site as soon as I recieve some cash. Thanks again. Now just two more to go, my Halifax bank account and egg card. -
I sent a dpa request off to capital1 for my brother on the 14th August and rang them up today to see wether it had been actioned as we had heard nothing from them. I was told on the phone that we sent it to the wrong department and it had not been recieved by the right one until the 16th September. I told him that this was unreasonable and would be taking the 40 days they were legally allowed from when the letter was recieved. The mistake we have made however is not to send it recorded delivery. Any ideas what I can do about this?

I didnt add any costs other than interest and court fee. Thanks for letting me know about my CC no. I didnt even notice. Perhaps anyone in future wanting split payment or a certain payment method should mention this in their particulars of claim. -

A quick question, although no-one seems to be responding to any questions I ask its worth a try. As you can see Ive just put my claim in and am hoping Halifax are going to pay me soon. However, from what I understand from reading other threads they have been paying up without notice and putting the money into the account that is being claimed for. I do not mind the bank charges paying off some of my credit card debt however I have borrowed the money for my court claim and do not want it put into an account where it cannot be accessed. Is there any way of specifying I want my court fees returned in the form of a cheque? Please someone give me some advice, I have asked other questions (see above) also. Am starting to think Im invisible. -

Recieved an acknowledgement of service today saying Halifax are intending to defend all of the claim. Could someone please look at my particulars of claim above to see if I have made a mistake I am slightly worried Halifax are gonna be able to defend due to a mistake made by myself and could do with a bit of reassurance. Just checked out the second one and cant even find a section 2.1.e and paragraph 8 doesnt make any sense to me. Heres my full particulars of claim: Claimant has credit card account ************ with Defendant from 14/7/2003 conducted on their standard terms and conditions. Claimant is claiming the return of £775.00 taken by Defendant in charges over 3 years. The Defendant's charges are a disproportionate penalty and therefore unenforceable as they are contrary to common law. They are also invalid under the Unfair Contracts Terms Act 1977 s.4 and under the Unfair Terms in Consumer Contracts Regulations 1999.Para.8 and sch.2.1.e. In the event that the charges are not a penalty they are unreasonable within the meaning of the Supply of Goods and Services Act 1982 s.15. Defendant has declined justification of charges despite repeated requests. The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from 21/04/2004 to 6/09/2006 of £61.94 and also interest at the same rate up to the date of judgment or earlier payment. -

I used particulars of claim from another thread and am just looking into the acts it mentions: Unfair Contracts Terms Act 1977 s.4 Unfair Terms in Consumer Contracts Regulations 1999 Para.8 and sct 2.1.e. Supply of Goods and Services Act 1982 s.15 The Unfair Contracts Terms Act 1977 s.4 applies to contracts between 1 business and another. Have I made a mistake by including this? Should have read the act before including it but its so confusing. Can anyone give me any info on the others also. Thanks a lot. -

Just a quick question. I have clicked NO when I was asked will my claim include any issues under the human rights act 1998. I have seen no mention of the human rights act in any threads so hope I have done correct. -

MoneyClaim filed today for my Credit Card. It has cost me £80 but with that and interest Im now claiming £916.94. Lets see where this goes. -

My girlfriend signed an 18month contract with '3' 8months ago for £35 a month. Now, her financial circumstances have changed and she just cant afford it. Ringing up to ask 3 to lower the tariff/put the contract on hold have yielded nothing, they just wont give her any options other than to pay. She has never had credit or been in debt before and it scares her thinking that she cant get rid of this contract and that she may be pursued by DC agencies if she stops paying them. After moving out of home and having bills to pay (rent,council tax,water and electric) she has nothing left to pay 3. Obviously she has to prioritise and 3, quite rightly, come at the bottom of the list. Does anyone know what options she has regarding this?? Be very glad for some advice. Thanks.
