    • I have a debt that went SB in 2020, Capquest are still occasionally writing begging letters, i just chuck em in the recycling.
    • My Ebay account was permanently suspended for "buying activity" allegation. I literally have no idea what they are talking about.   It's literally impossible to contact them by email or phone if your account has been suspended. They owe me: 1. £400 for items sold which have been delievered to the buyer 2. £350 for a faulty computer screen I purchased , which I now can't return. It's unacceptable they should hold my monies under these circumstances.I have video evidence the computer screen is faulty. But its completely frustrating, because you cannot under ANY circumstances contact  them by email or phone if your account has been suspended. So I cannot find out what guidelines I'm supposed to have broken. I'm not prepared to accpet this. I have Ebay's physical address. I am going to go to the small claims court, and appoint bailiffs `if I win and they don't pay up. Do you think Trading Standards would be interested? Or is there an Ombudsman to go to? With literally millions of accounts, this must be happening all the time. Ebay must be retaining millions of pounds under false pretences. Is it not the law you can retrun a faulty item bought over the internet, whether from ebay, or anywhere else?

    • Hi I stupidly left my handbrake off,  and my car rolled down a hill and into a fence owned by a company. I am a part owner of the company that owns the fence. My car insurance (Prima) states they won't cover the damage to the fence, just the car as they state  "you own the land', although I don't and I did make that clear to them when reporting the accident.. I understood a company is a separate legal entity, so should be considered third party damage and car insurance should cover? The property has a £400 excess and I'm already going to be paying out the £500 excess on car insurance, so want to avoid paying both if I can.. Thanks for any advice you can give...

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

hi, l am new here, and l have found this site to be most informative! l have sent the first letter to halifax bos on 6 june, yesterday l sent one to the visa credit card people. does anyone know if you can use the same procedure with kays catalogue and independant finacial services. (scotland- Clydesdale financial services)

although my catalogue has not been used for over a year teh people at kays sent me a new catalogue, new account number and offerred me a load of credit! l would like to reclaim their late payment charges. can l do ths agains kays and clydesdale financial services?

Yes, and yes. You'll need to tweak the template letters for your purpose, obviously (Kays is not a bank!) but the process is the same.

 

I suggest you start one thread per claim in each relevant forum,eg Diamonddog (Bowie fan, are you? :-D) v Kays in the "other institutions" forum, DD v Halifax in the Halifax forum, etc, and use each thread for the relevant updates and queries, like a diary for each case, if you will. It will help you (and us) keep track of your progress and development in each case, right up to the moment where we write a great bit **WON** in your title! ;-)

well lets hope reclaiming this money will work out,

l am not holding out too much hope with the clydesdale

one cos l have lost and forgotten my account no. l don't know

if my adress and personal details will be enough to claim with,(?):confused:

 

(and on a lighter note, there is no probably about croydon college's most famous student! in fact; well done Croyden for letting him in in the first place! else we might never had known him!) :)

was in the bank today and told the girl l had sent the first letter. she said that there is a backlog and that the local branch just send all the letters to head office, l should have sent it there in the first place.

hi l got another 3 charges today cos l have a new job and my wages did not go in on time to cover the d.d.s and a lot of my wages and wftc money has been swallowed in last months charges. l phoned the number on the letter and spoke to a girl who cancelled the charges and registered me for telephone banking. Is telephone banking another route to getting your statements?

l would have accepted the charges before l discovered this site!

got an email from kays today sayiong that they only have access to past six months transactions and they are sorry for the inconvenience it may cause!!! as l have not used the catalogue for a coup;e of years l have no statements. is this reight enough? do they only keep data for six months? any help would be appreciated

I've dealt with Kays and they do keep statements going back six years. Have you just requested them to send them online without sending payment? if so, then this is why they are probably saying they don't have them. You need either to SAR them with £10.00 or CCA £1.00.

They won't supply these transactions free and as you are not using the catalogue the only way they will send them if you send a SAR with £10.00. Much the same as claiming from the banks but just adapt the letter accordingly.
