    • Ok, I don't necessarily want to re-open my old thread but I've seen a number of such threads with regards to CCJ's and want to ask a fairly general consensus on the subject.   My original  CCJ is 7 years old now and has had 2/3 owners for the debt over the years since with varying level of contact.  Up to last summer they had attempted a charging order on a shared mortgage I'm named on which I defended that action and tried to negotiate with them to the point they withdrew the charging order application pending negotiations which we never came to an agreement over.  However, after a number of communication I heard nothing back since last Autumn barring an annual generic statement early this year despite multiple messages to them since at the time.  So at a loss as to why the sudden loss of response from them.   Then something came through from this site at random yesterday whilst out that I can't find now with regards to CCJ's to read over again.  Now here is the thing, I get how CCJ's don't expire as such, but I've been reading through threads and Google since this morning and a little confused.  CCJ's don't expire but can be effectively statute barred after 6 years (when in my case was just before I last heard of the creditor) if they are neither enforced in that time or they apply to the court within the 6 years of issue to extend the CCJ and that after 6 years they can't really without great difficulty or explanation apply for a CCJ extension after of the original CCJ?.  Is this actually correct as I've read various sources on Google and threads that suggest there is something to this?.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Have banked with nationwide for over 20 years (although don't have my original contract - more's the pity!) Have sent off DPA request today. Charges back to 2004 are already £300 plus.... Will keep this post updated as to progress.

Yes. Point to them that you have supplied them with a DPA request (copy enclosed) you requre only full compliance with the request.

Thats sort of what happened with me and Nationwide, I got a fob off letter, rang them up and they said talk to the branch, I said No, you talk to the branch and when I rang back later to find out I got an annoying little girl telling me that they were sending me a letter.

 

After asking her what the letter was about, and getting no were I told her I didnt want a letter, I wanted a list of charges, she said it was the list of charges. :roll:

 

They dont play hard ball so much as annoying ball.

I have confirmed with our Data Protection Officer that the reason we advise Members to visit their branch is for confirmation of their signature, as required by the Data Protection legislation. They advised me that if asked them they would need write to you to advise you of this as well and to reply by letter with your signature..

 

They confirmed that you are welcome to write a letter directly to them, including your original signature to the Team for disclosure under the Data Protection Act at the following address:

Either Nationwide are very up on their DPA requirements or they are getting a lot of requests for 6 years worth of statements! On their online banking page for ordering duplicate statements there is a standard information line which states that they can provide statements for 6 years.

Have sent the following message today as I have not received a response to my last message via secure messaging:

Dear Sirs

 

Further to your message of 14th March, I have now posted the letter below to the DPA Controller as requested (although please be advised that as I origianlly made this request on 7th March, I am still using this date to calculate the 40 day time limit in which you are lawfully obliged to provide me with the information requested). Being that by tomorrow morning, (and the fact that you have had this request, and the DPA section are aware of it) I would expect them to be working on collating the information requested which can then simply be posted out to me once they receive my letter and check my signature. However, I am surprised with the level of security required to access the online messaging site that you do not accept messages on here as authority to carry out these requests (especially as you accept this medium of communication for every other convceivable banking request).

 

I await your response no later than 11th April.

Hopepfully I have covered all bases here, by keeping them informed by their secure messaging service AND following up with a written letter. Will wait and see. Oops - I think they actually have to 16th April! - Oh well lets see if they pick up on that one! :wink:

Received a response today from Gary Parkins from the Data Protection team thanking me for my message of 24th March - (that's funny because my message was sent on 7th march) saying that they have ordered my duplicate statements and will comply within 40 days - actually Mr Parkins you now have until precisely 16th April to comply - NOT 40 days from 24th March!!! - Talk about bending the rules!!!

I believe this to be innaccurate. There is NO requirement in the act for a signature. The controller only needs to be satisfied of the identity of the person making the request. You could write it on an envelope, and show the person in the branch a copy of your passport (for example) and proof of address. You can get thousands of pounds in credit this way, I don't see why a few sheets of paper should be treated any differently. Also worth mentioning that the controller is THE BANK, not some person on the DPA team. Therefore IMHO it should be sufficient for the person in the branch to be happy with who you are.

 

I understand why they say these things but it reality none of it is required.

 

They also asked me to say Nationwide routinely do not charge and waive the permitted fees for this service.

Ok received by Special Delivery this morning my statements for the last 6 years, all professionally bound and with sections at the back detailing all the DPA marlaky... However, on the front of the pack (also bound with a nice plastic cover!) is this letter (I will reproduce it in full as I haven't seen this sort of response on here before)...

Has anyone else received this letter? Seems they are now attempting to address the "Manual intervention" argument...however, they have not been able to tell me who has intervened manually on my account....

Just need to go through about a 1,000 statements now and tot up my charges!
