Hi

I have one set of terms & conditions only (1998 thanks to another user). Bundle has to go to Court tomorrow and I cannot get into Wayback Machine........

7.4 We reserve the right to pass onto you other charges to cover additional work involved in monitoring your account. You will be pre-notified of these charges by your relationship manager.

 

When did they become relationship managers?

Mjay - have you looked at http://www.shadeofblue.co.uk ? There is a scanned copy of T&C's there. Of particular interest is the following:

 

9.1 We provide you with your Card so that you can operate your Account more conveniently. The Card itself does not give you an automatic overdraft or any other form of credit. We will be entitled, under the terms of the Account, to charge interest at our standard rate for unauthorised overdrafts and to debit that interest and any resulting bank charges from your account.

9.2 If you do use your Card to create an overdraft we have not agreed to, or exceed an agreed overdraft limit, you will have broken the terms of the Account and you must repay the unagreed amount immediately.

So good evidence to include in your court bundle.

 

This would indicate breach of contract as opposed to fee for a service.

If you also look at the Calling all Lloyds - Urgent Call for evidence there are quite a few bits and bobs on there.

Hi

 

Sorry if this is a little late for your bundle but it may help. Its a link to archived charges for LTSB and states

Any unauthorised borrowing means extra work for us, we cover this by charging you the following fees
2003 & 2004 and the changed text in 2005. Its not full T&Cs but does show that it is not a service charge. look at post 57
