Your arguments are superb. What is less superb is the way you jump from one to the other and back again, so I haven't changed your words, but I have moved the paragraphs around and given each section a heading. New bits are shown in red. Crossed out crossed out in black is something you've quoted from the government Code of Practice, but that has since been withdrawn so unfortunately that argument has to go. Your paras 7 & 8 don't harm your case but to me are waffle and can go.  Keeping the arguments clear & concise will always impress a judge.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

i am now up to the court stage

  • claim issued on 21may
  • deemed served 1june
  • halifax has untill 15june to reply

phoned halifax today and the man i spoke to said he would email their legal team and took my phone number

i am now just going to sit back and wait

could really do with money soon though as our baby is due in 26 days

wonder what will come 1st, 6 years of bank charges or my baby ,anyone fancy a bet

no news to day from halifax, 11 days to acknowledge claim :(

been getting pains since last night, 21 days baby due looks like she might be early:D

can i phone the court to see if they have heard anything or should i just wait i am getting good at waiting Buffy x

phoned the court they havnt heard anything, couldn't get through to legal dept so phoned the complaints number they had no records of court case, so i kept trying the legal dept got to talk to someone and they said they would pass my details on to the person dealing with it and they would phone me, well they havn't rang yet so will have to wait another day, Tilly i am so happy for you can't wait for it to be my turn, hope you have a wonderful holiday

just got to speak to someone in the legal dept she asked my name and nothing else then said they had got the claim from the court and somebody will write to me in the next week i just know the are going to defend it and i will have to go to court i am having no luck at all today, my youngest has just got the chicken pox and i think i have it too not good with baby due in 18 days i am off to the doctors now

well i went to the docs they have sent of my blood for some checks got to wait till monday but we both have got chicken pox but we both feel fine, think once the spots come out your over the worse

have to wait till next friday for the halifax but by then baby will be due in 10 days so at least its not to long to wait now Thank you for all your help and support

sorry about this countdown thing i do but it makes it more real when i see it .

Halifax have 5 days to acknowledge my claim

Baby due in 16 days

doesn't time fly when your having fun right i need something to do today so i don't sit here all day waiting for 2morrow think i will go and do the front garden got to go and put cream on chicken pox 1st oh how exciting is my life

hi when i spoke to the legal team last wk the said i would hear from them in the next few days i know they will acknowledge it then another 14 days for me to wait for my money not going to phone them anymore just going to sit back and wait i am really happy for you bet you cant wait to spend some money

no i havent heard that before i thought it was when they got your stuff from the courts i dont really sure money or ssl might know more

post man has just been nothing from the halifax today going to phone the court soon my claim is stright forward i think havnt had no sleep so dont really know what i am thinking this morning
