    • HI   Ah that little lets downgrade it to a Stage 1 Complaint so it looks like wee dealt with it properly if the Regulator looks at our books/files.   It's a tactic Housing Association use even my own recently tried that and I refused to let them get away with it.   So you respond to the Customer Service Manager NOT BY PHONE unless you can record the call.   To Customer Service Manager   Following our telephone conversation on XX/XX/2021 reference my Formal  Complaint you informed me that my Complaint was being dealt with as a Stage 1 Complaint.   I find this unacceptable as this Complaint was made via T&C online Portal with Acknowledgement receipt from T%C of my Complaint in July 2021 and T&C have now only decided to deal with this after I recently had to Hand Deliver (16th Sept 2021) that Complaint to your Office which is  unacceptable.   Therefore T&C have had from July 2021 to resolve this Complaint as per your own Stage 1 Complaint procedure and I quote:   Stage 1: Your complaint will be allocated to a member of staff who will contact you within 2 working days to discuss your complaint and understand the problem. We aim to resolve complaints within 10 working days, but sometimes investigations can take longer. In this case we’ll let you know, keep you updated and agree a timescale for our response with you. As the above has not been carried out and was only acted upon as previously stated when I hand delivered  my Complaint again on 16th Sept 2021 to your Office this is not a Stage 1 Complaint as T&C have Failed to carryout the above Stage 1 Complaint Procedure since July 2021 therefore my Complaint should be Escalated to a Stage 2 Complaint as per your own Complaints Procedure. If T%C refuse to escalate this Complaint to Stage 2 I require full Clarification as to why.
    • Hi guys, I have recently found this website and have been reading a lot regarding Hermes scandals. Thanks a lot to all the people running and supporting this forum. Doing lord's work. Here is my case, hope I can get some help. On 07/08/2021, I used Hermes service to ship my laptop however the laptop never reached its intended destination.  On 16/08/2021, I had a chat with their representative over the phone to get an update on the situation. I was told they will start a brief investigation to find my laptop. After a long wait, on 14/09/2021, it was confirmed that my laptop was indeed lost. On 25/09/2021, I filled in the compensation form.  On 27/09/2021, I received compensation of £20 + postage of £5.80. On 28/09/2021, I asked them to review their compensation and reimburse me in full. (Formal complaint) The laptop was purchased on 02/08/2021 priced at £1049. Do have a PayPal invoice for it. I did not use Hermes insurance as I didn't have any trouble with their deliveries in the past. The parcel was declared as a laptop. I have prepared a letter of claim to send them as soon as they reject my request to pay in full. Few questions, I couldn't find answers about: Do i need to send email to Hermes with letter of claim or post? Next steps: Wait for formal complaint's response..  Submit letter of claim, wait 2 weeks, then register and issue complain on money claim county court website? Hope i can get some feedback on my letter of claim.   Letter of claim1.pdf

    • Funny you should mention it-I have today got a letter from the court telling me the judge's comments 'there is no record of an email of 23 July 2021 with the Help With Fees application' 'the Help With Fees code was not generated until either 21 April 2021 or 18 August 2021 and so cannot have been included in an email sent on 23 July 2021'.  'If you want to set aside the order of 2 Aug 2021(I assume that's the one that no-one vhas received, vacating the case) you must make an N244 application  and pay the fee of £255 or submit a Help With Fees application'.   They don't even know when the code was generated and have no idea whether this was before or after the email was sent to them...

Hi All,

I have defected over here from the Lloyds TSB forum having gone as far as I can with another claim.

I now need to get used to the A & L sneaky tricks.

I have read somewhere that they like to close customers accounts down, is this true?

Do you get advanced warning so you can sort out direct debits etc etc & also, I have a loan with them which finishes in March ( although if I win I intend to use my refund to pay it off). My loan payments come out of my A&L account & to get the low rate of interest on my loan I have to have this premier account. What happens if they close it & I also have a savings account linked to my current account- will they close both?

I have no arrears on the loan, are they likley to call it in when I start my claim?

Sorry to bombard you with questions, just want to know what i'm, getting mnyself into this time around. I think Lloyds TSB seem to be quite straightforward compared to this lot- at least Lloyds tell you they are going to be underhand!!

Thanks all

Jody:confused:

Hi jodybuk.

The banks can close an account at any time. Although some banks started doing this, it rarely happens now as to close an account because of a claim is against the FSA guidlines and the bank could end up paying you compensation.

Having said that, they will almost certainly close an account if you make a second claim for charges.

Carry on, should be no problem.

Regards, Rooster.

Thanks for that rooster,

Do you mean a second claim for charges on one account?

I only have one account that has incurred chrarges with them & to be honest, I only have this account until the loan is paid off for the favourable interest rate.

I intend to open another account i just don't know where coz reading this forum i wouldn't want to deal with any of them!!

Is there a sar letter template on this forum anywhere?

Thanks

Jody

Grrrrr!! I'm so angry with A&L!! I looked at my account online to day & discovered that they have returned a chq ( despite the guarantee number being on the back) and charged me £34.00 for the pleasure, they have also charged me £25.00 for going over drawn - presumably for the nano second the funds were out of my account before they whipped them back AND, I paid in cash to cover that cheque & more on the day it got retuned.

They are adamant that they have charged me correctly because the cheque was processed before my deposit was processed.

Is this right?

If i was ever in any doubt (which I wasn't ) about persuing them i'm certainly not now.

I'm soooooooo angry!!!

Sorry - rant over, how you all doing?

Nothing seems to move quickly with A&L ... be prepared for the long haul:rolleyes: Got my statements at the beginning of January and it's still going on, though hopefully not for much longer.icon12.gif

  • 3 weeks later...

What a busy week I'm having!

I have arrived home today to find an offer from A&L, I am claiming £2316.00 & they have offered me £572.00!! Needless to say I will not be accepting this & am going to file a claim through mcol today. On my schedule of charges my last charge date was 21/05/2007 , since then I have incurred another £150. or so, when I file my claim can I add this on & just send a revised soc or do I have to start again from the beginning and have a whole new claim?

Also - aswell as getting an offer from A&L l ( however ridiculous it may have been ) I also checked my Lloyds TSB account & discovered they have refunded me £3228.75 into my account!! I have not even had a letter to say they are doing this yet!!

Yippee!!

In addition to the above, I have had a look at the rejection templates & none of the apply eactly to me so I have chopped & changed thins so they do apply-

Is this ok to send & can I fax it or do I have to post it?

Response to settlement offer.

Dear Ms Riley

Thank you for your letter dated 19/07/2007. I respectfully decline your offer of £572.00 as a full and final settlement.

I shall be commencing court action on 26/07/2007 for the full amount claimed.

I trust this clarifies my position.

Yours faithfully

I do wonder, given the crappy nature of their offered settlement to me whether they knew the OFT was planning to moratorium all the cases.

I'm suing them anyway. I really can't hold my language back on this one. The OFT and A&L are a complete bunch of ******s. How dare they interfere in me getting my money back. I shall write the OFT an (incredibly) angry letter should my case be stayed.

  • 7 months later...

Morning All,

I have just been poing through all my paperwork etc for my claim & I have noticed that A&l have taken huge amounts in charges since my case got stayed.

Can I start a separate claim for these or will it be automatically tagged on to my existing claim.

Is there any point in me making this claim until the outcome of the court case is announced?

Thanks
