      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hiya

I'm posting this thread as I need some advice on something.

I currently have a solo card with HSBC and the fact that I'm getting overdrawn with bank charges every month doesn't seem quite right.

I thought the main advantage of having a solo card was so that I wouldn't get overdrawn but the fact that every month I'm getting a letter through saying they are going to deduct from my account between £50- £80 cannot be fair.

I have been into my bank numerous times saying that I do not want an overdraft facility on my card and for it to be removed with them saying to me everytime " Sorry madam but you do not have an overdraft facility on your account, and we dont know why you have an overdraft".

For me to then get overdrawn time and time again when I APPARENTLY DONT have an overdraft is getting a bit tiring. I have even asked for an arranged overdraft to stop these ludicrus charges amounting up but i am getting " We cannot give you an arranged overdraft as it's a debit card- not a credit card!"

I have also asked them for a student bank account/ loan but I cannot have one because of my credit history and the fact I'm always overdrawn!

The fact that the geniuses decide to deduct my account these crazy charges at the end of each month when there is hardly enough for me to live on is plain stupid because when the money is taken out of my account I am overdrawn again and then I get a letter the next month saying I'm getting another £50 taken out of my account at the end of the next month!

The fact that I'm a student who cannot have a student bank account/ loan because I'm always overdrawn is pure madness because surely if I have a student Bank account/ loan then I can get overdrawn and not pay these stupid charges but pay it back in 10 years time when the interest has gone through the roof!

I thought the fact having a solo card was so that when my account reaches £00.00 I cannot withdraw anymore money not when my account reaches £-60.00!

If I can get some help on this then I'm definatley going to try and get my money back but I need some helpful words of advice to get the ball rolling!

Welcome to the forum.

 

It does seem a bit odd. It sounds as though 99.9% of your overdraft is thanks to the penalty charges. So you're amongst friends here!

 

The first thing to do is read the frequently asked questions (FAQ) page and have a damn good hunt around what other people are doing/have done.

 

The first "real" step is to write to the bank asking for a list of all your charges over the last x-years/months (either 6 years or since you've had the account). This is done using a Data Protection Act request (DPA - look in the templates section).

 

Once you have that info back (and it will take 2-6 weeks) you will have read even more of the site and know exactly what to do next!

Thanks for the info, you've helped me a little bit. Does it matter if I print off all my statements online or is it still imperitive that I write to my bank asking for a DPA. Been reading that it costs £10 but the thought of giving my bank anymore money doesn't make me a happy bunny!

Well.. I think I've read on here someplace that someone totted up their charges online and some of them were missing, so it's probably best to get them all through the data protection act.

 

Also, in most cases HSBC have returned the £10 as far as I know.

 

- It would be worth paying the £10 also, as you can request any notes on wheather or not people have physically been involved in issuing you charges, this info is quite important, as one of the main arguments on illegal charges is that in the majority of cases money is charged for sending out automated letters....

 

I could be wrong, I've only just starting reading the forum myself, so if anyone else has any info on this would probably be better!

Have you ever thought about checking your balance before you make a withdrawal?

How about regularly checking your account using internet banking so you know how much money you have in it?

What would you say if you were stuck in town late at night with no way of getting home other than using your solo card to go overdrawn?

I suggest you admit that you are in the wrong and accept that you deserve to be charged for being so irresponsible.

 

there is no room in these forums for your type of people, please go back to your bank office, because your going to have a lot of work on your hands in refunding charges in the months to come :mad:

you are right, the solo card does not allow you to take more money out of your account than you actually have, however that is not such an obstacle for the bank itself. Could it be that you had a d/d or a standing order that was missed , which in turn led to the merry-go-round of repeating charges?
