      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Guys. I've just been watching this mornings BBC Breakfast news and there was a news bulletin stating that all claims against banks for unfair charges are to be scrapped, possibly until the bank do a test case in court. I'm now worried as I've just paid £250 to go to court and I'm worried that mine will be scrapped. Is that a possibilty?

Hello again...just a few questions really.

I've recieved a letter this morning from the Northampton County Court, with a notice that acknowledgement of service has been filed. I'm not entirely sure what that means......sorry if I'm being blonde but I need to be sure I understand everything properly. It also says that the defendant, has 28 days to file a defence from the 25th July 2007. Does that mean in 28 days I'll be in court??? Sechiari, Clark and Mitchel have also ticked the box...I intend to defend all of this claim, am I still likely to win? They've done nothing but ignore me so far! And now its all staring to get terribly serious! And another thing, why is it still in the hands of Northampton County Court??? I thought it would get transferred to Newcastle County by now!

I'm really sorry if these questions are pretty basic, but I haven't got a clue when it comes to all this legal stuff.

Stop worrying, it will be transfered to your local court and the bank will bottle it soon after they are required to enter a defence. Relax, sit back and just wait for their next letter saying can we pay you and you leave us alone but not tell anyone please!!!!!

And the lord said "come forth and i shall grant you eternal life" I came fifth and got a toaster!!!:D

Thanks threeamp! I'm also a tad worried about this whole test case thing. Some people on here have been recieving letters from Lloyds stating that they are going to suspend all cases until the test case has been heard. I hope to god this doesn't affect my claim. I've paid £250 for my claim as its over £5000 and if it gets shelved until further notice I won't be happy. I'm banking on having that back when I win. Ha ha!! And soon too!

You will have to seek advice from a mod but i would think that as your case pre dates the OFT one you could object to any delay with your court. Keep reading this site to see how others are going on with Lloyds/

Continue with your case as normal - it is not for LLoyds to say that they are suspending all cases - the matter is now the subject of a county court claim against them - it is only the court that can put a stay on proceedings.

Hi guys. Just thought I'd let you all know. That, Lloyds have settled. I've recieved a letter from S,C & M. And as a goodwill gesture they are putting £6324.38 into my account. What a shock. I didn't even go to court or get a court date. They've just settled it like that. My god. I'm shocked. Is that meant to happen???? Wow, I can't beleieve it.:D

Great stuff - when was the letter dated, out of interest?

Easy there tiger, it took me nigh on 15 days to get the money into my account, they will pay up but they do like to drag their feet when doing so. Check with [problem] to see how long it will be before the money is in before you inform the court it has been settled. Congratulations for the result though, i am delighted for you as i know exactly what its been like.

Hey guys thanks for all your responses. To answer your question Dolly its dated the 25th July. I'm hoping that they pay up quick as I know a lot of people have been waiting a while. But hey, I'm not too concerned as put it this way I could still be having to go to court and now I'm not so hurrah! But this whole site has been an amazing help and I couldn't of took on those twats without all the help and support of you lot.:oops:

hi all i we are so happy WE beat them recieved money today every last penny wooooooo can i be moved to the *won* section..
