Hi

 

I have put one claim in for RBS, amount is just under £5,000 for one bank account. Paid £120 to Small claims court, have received a letter back last week to say RBS are now putting a defence in place and they have 28 days to do this, this is stamped by their Solicitor. Should I be doing anything at this stage?

 

I'm also concerned, when I put my claim into the court and paid £120, I only wrote a small paragraph explaining my situation. Should I have gone into more detail about my financial background? If I should have, is there anything I can do now to put a case forward?

 

I have another claim to make for £5,000 for another bank account but thought I'd wait to see how this claim turns out first.

 

Any advice and tips would be very much appreciated.

Hi - My bank charges are for £4,900 to the RBS. This is one claim for one bank account. I do have another claim but wanted to wait to see what happened with this one before I put in my second claim!! I've paid £120 to the Small Claims Court and last week received a letter to say RBS have entered a defense and the letter was signed and stamped by their solicitor. Can someone please tell me what happens next and what I should be doing?

 

Also, I have concern....When I filed the claim it asked for a paragraph on our situation, I didn't realise the RBS would see this paragraph and I didn't go into very much detail. Should I be addressing this and write to them/who? to give much more information on my financial situation, stress it caused my family etc?

 

I'd appreciate some advice on any tips please.

Hi - I am in exactly the same position as you right now. Sent standard letters to RBS, no response, sent chaser letter, no response. Filed claim through Small Claims Court, just when the 14 days was up, received an acknowledgement of service to say they have filed a defence, stamped and signed by their solicitor. I'm not sure now what happens next? Should we be doing something in the meantime? They have 28 days to respond but I'm concerned that I'm just sitting back and waiting!!

Dolphin,

 

its not your financial background you need for the N1, its on what grounds you are challenging the banks charges.

if your looks nothing like that, or doesn't contain something similar, then you should consider amending your details.

 

As sneaker says, let us know what your POC was, and also what steps you have taken leading up to that point. If you do this in the HSBC forum you will get some help.

Louis I think you mean RBS forums ?

Its normal for Cobbetts to defend and their defence is fairly well known and therefore nothing to worry about as long as your claim is ok.

Its likely that Cobbetts will say that you have not properly particularised your claim.....and they may ask for a case management hearing.

As suggested i think a look through the RBS forums will give you answers to these and other questions

Thank you so much for your advice. After reading your steps to reclaiming bank charges, when I put the court claim in, I didn't send them copies of my charges, I only sent this to RBS. Should I send my spreadsheets to the court now?

Yes with online claims it should have been posted seperately.

With open Court it should accompany the N1.

Send a copy to Court making sure that account details and claim number are clearly marked on them.
