You would have to change your PoC - you can do this by submitting a new PoC with an N1 and an N244 - it will cost £35 - might be worth it.

Its only £35 if you obtain Egg's consent for the application. Otherwise it will be £65 and go to a hearing. This fee is also non refundable. What is the difference between the 8% and compounded contractual rate in money?

I dont think its worth it for an extra 50 quid, so I will ask them for charges plus 8% plus 30 court fee.

Sorry, I had forgotten the PPI.

 

I would write and accept as settlement of the charges claim but make it clear you are continuing to claim for PPI (mis-selling presumably).

 

You do not need to sign the Tomlin order anyway. In our claim against GE they sent a Tomlin order which we threw in the bin and sent our own notice of discontinuance to the court.

Had 3 or 4 now offering full amount, written back saying I will accept the offer but only with no strings attached.

I also asked them to allow me to change my POC and they have just ignored that request.

There's only one place for tomlin orders - in the bin. I insist on keeping charge of the case right to the bitter end. Every case I've won I've been sent a TO and binned it, then used my own notice of discontinuance.
