    • I contacted Sanctury housing in August 2023 after informing them my father in law who had Dementia had moved into a Nursing home December 2022. We kept the flat for 8 months until such a time we could accomodate some of his furniture that my wife wanted to keep. I contacted them in August 2023 to let them know the situation by email as I was the named person that could speak on his behalf. I informed them that we had left it to late for POT and were seeing a solicitor for Deputyship of his financies. I asked them what information would they need in order to give notice on the flat and we could provide details of his condition and nursing home. This went ignored I left it a month and then called them October 2023. I was promised a call back from a manager over the next few days. This never happened and it was end of November when I contacted them again and they had no record of me calling them. I explained the email and again I was told the local manager to the area would call me. This never happened and I ended up emailing them in January 2024 with a copy of the email from August. Again this went ignored and I had explained to them that we couldn't just go to the bank and stop the DD as we had tried. This email again went ignored. I then had a letter written to our home address in February asking us to get in contact with them (local manager) as they were concerend nobody was living in the flat. He had an email address so I copied in the last 2 emails to say I had been trying to give notice since August 2023. I also stated that I would like the rent that was paid from August 2023 refunded back to his account as I had officially tried to give notice then and it went ignored. He replied to us about wanting to look at the flat then notice could be given once he had contacted the nursing home to confirm he was actually living there now. Notice was giving for the 22 March 2024 and this would be when rent would stop and no further payment would be taken by this point. The fact I asked to be back dated went ignored. I have since noticed on 2 banks statement for April and May that they are still taking Rent payments of £501 from his bank. Further to this which seems very strange. He was with Eon Next for his utility bill again we were having problems getting this stopped as they needed a named person on his account which there wasn't one despite me managing his online account for him. I didn't check the email address that often that I used to set it up and went to check as noticed the credit he had built up with not living there was all getting refunded in February. The email said £600 would be refunded to his account with a (sorry you are leaving us message) but how can he leave as nobody but himself had access to speak with them. I also noticed the lady in the flat above him had a letter from her bank sent to his address with his address details but his name which was dated 4th March well before we had given notice and it said (thank you for giving us your new address details) we have set all this up for your account.   So Sanctuary housing must have been aware he wasn't living there from the ignored emails for the lady above to start changing address details to move into his flat before the housing manager had even got in contact to ask if anyone was living there. What I basically want to know his do we have any legal standing to claim the rent back from when I first contacted them in August 2023? There is roughly £3000 to come back

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Well, after reading about all the successes on here, and being thoroughly hacked off with Abbey right now, I am sending off my request for statements. Just 6 years to start with. But if I enjoy it as much as you all seem to - back to opening the account in 1976 could be great fun.

If you send a properly worded SAR using the template letter from this site they are supposed to send you all info they have, this means back to when you opened the account, not just six years.

 

They'll try telling you they only hold six years but remind them you've sent a SAR and they soon agree to let you have everything.

Well at least it'll keep you out of mischief. ;)

 

And just think of how much you might be able to reclaim, and all that interest you'll get cos the muppets won't settle before you've issued a claim. It's the best savings account on the planet, where else would you get a minimum of 8% pa? :cool:

 

Keep us posted on how you get on, and good luck with the wading through, you'll probably needs specs by the time you've finished. :D

Sent off for SAR 2 weeks ago by recorded delivery - but not heard anything - not even an acknowledgement !! Rude I know - but unusual???

No, not at all unusual.

 

You should receive 14 months of copy statements fairly soon, then probably a useless piece of paper which is a spreadsheet of charges but only gives the number each month of each charge and a total per month.

 

You then write and remind them they haven't properly fulfilled your SAR request, they eventually get their finger out and send you the rest as phocopies of microfiche and then your work really begins.

 

That's been the format just recently, but don't let them off the hook, they've got 40 days to fulfil a SAR, so I'd remind them when it's nearly up. Put a heading on your letter that catches their eye otherwise you'll end up in the pile of 'to do' things that hang about a bit.

this section helps if abbey are non comliant with your data request, I sent a LBA (Letter Before Action) 7 days before the time limit was up:

Hi just had a quick look at this and wondering have I done something wrong!! Is the summary of bank charges no good?? I have statements back to 2005 and they have sent me some form of print off for 2001 to 2003 but 2004 is on one of these summary of bank charges. Do I need to request actual statements for this period? I didn't use an SAR I just phoned up and asked only just found this site.

If the print off is the one they're sending out at the moment it will be a spreadsheet style list, printed in landscape, with headings like 'Month of Charge', Total Cleared Transaction Charges', Number of Cleared Transaction Charges', in heading across the top and on the right hand side there is a heading of 'Refunds' with similar lists underneath it.

 

Don't panic though, cos within 2 weeks of getting that I got my microfiche copies.

 

The problem with the spreadsheet summary they send you is it's not any use when you need the actual dates of charges etc, which they ask for in their defence. On the basis that you might have to go into court, you need accurate information. You could just say that as your charges always came out on a particular date you have used that date in the absence of detailed information from Abbey.

 

I'ts nothing to get yourself worried about, use the summary to add up your charges and when the other stuff comes through you'll be able to put in the details.

Well, 3 weeks after sending SAR I have recieved a single spreadsheet page covering Jan04 - Mar 06 from Pam Speed, with the assurance I shall recieve other details within 5-7 days.

 

I am just preparing template 1 for non-compliance as the spreadsheet is not acceptable - is this correct???????????

 

By the way - charges in this two years are £1800 !!! Going back to 1976 and including the last year, this could be a biggy !!!!!

Sounds like standard their standard practice to me. Initially, I didn't even send statements, I pretty much just said 'give me my money!' - and they did, 18 months worth, anyway. Then I requested my statements (which also took ages to arrive, so nothing unusual there!), highlighted the charges, sent them off with a much more thorough letter, got rejected, started court proceedings... leading them to drag their heels even more.

 

Long story short - they'll drag their heels on everything, but it's undeniably fun and totally to be worthwhile sticking it to the man!

I do no thave the best credit score at the moment !!! And am also overdrawn with ShAbbey.

 

Can anyone suggest a Bank that I could open an account with, I would need one with a debit card as work takes me abroad a fair bit.

Hello again Martyn,

 

glad to here its coming along, I opened a bank account with Barclays. They gave me a overdraft matching my Shabbey account one and let me transfer my debt all without depositing a penny! Then they let me take a month or two to transfer my direct debits and pay check over. As you probably know these can take some time to organise.

 

I just went into the bank and saw one of their account managers, I took out an additions plus account which gives you:

Travel Insurance

Mobile Phone Insurance

Break Down recovery

Payment Insurance

Death Payment

and so on

 

It does cost 14.99 a month but I was paying more than that with all the other stuff.

 

And no I dont work for Barclays but they were helpful, they had just better never charge me! LOL

 

I would also recommend not saying the reason im changing bank is because im taking them to court.

I just said im fedup with the service Abbey have offered to me over the past 17 years!

 

Anyway its up to you I have heard Alliance and Leicester are very helpful. But they dont have as many branches.

Just got my statements through back to 30/01/01. Have had an account with them since the mid 70's, and although I asked for ALL statements since account opened, this is all I got.

 

I'm proposing to

1) treat 30/01/01 to today as 1 claim

2) bang off non-compliance letter for remainder of statements

3) new claim for pre-30/1/01

 

Does that sound right???

Hi Martyn,

 

Yep thats what I would do best to keep them seperate, that way you can focus on what you have and then proceed with a 2nd claim when you get all the statements which may take a long while considering the amount of them there must be!

 

So the next step is to tot up the charges and any charged overdraft interest for the last 6 years so best to go from 30/06/01 to Todays date as when you enter the claim it will be around the 30/06/07 the last 6 years.

Martyn please take a look at this from the FAQ's:

 

1) Overdraft Interest paid by you on the charges

This is the amount of interest the bank charged you for being overdrawn. You can only claim the proportion of interest charged on your charges, as opposed to any charged on spending. The Advanced spreadsheet will help calculate this amount. The Overdraft Interest figures should be included within your Preliminary letters to the bank.

 

Good luck I couldnt get my head round this bit on my claim!

Morning All,

 

Just going to Post Office to send my Prelim Letter and copy of spreadsheet to Pam Speed. Asking for £2966.50, going back to end of Jan 01.

Also chasing her up for statements back to 1976 !! That should be fun !!!:D
