    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You should keep to written communication so you have a proper paper trail for your case and, when necessary, proof of posting/receipt.

 

Emails will have changed because the BLT staff have changed over time.

Just an update - I posted off my case for hardship to Barclays on the 19th of May, as yet I have had no response.

How long do I need to wait for a reply and if I need to chase it up what do I need to say......any help greatly appreciated. :-)

Where did you send the Hardship claim?

 

If it went to a proper address, you should chase this immediately aksing for a proper reply within 7 days or complaints will be made to the FOS and the FSA about their failure to abide by the FSA Waiver conditions.

I posted it to Barclays legal department - along with my financial statement and this letter;

 

Dear Sir/Madam,

 

Notice of Consideration for Hardship Status

Claim reference Number xxxxxxxxx

Account number xxxxxxxxxx

 

 

Please find attached a detailed summary of my financial standing, as evidence in support of my claim/request, be treated sympathetically and speedily in view of hardship.

In making this request, I remind you of your duty to comply with conditions agreed in the waiver of July 2007 and continuation of July 2008 between yourselves and the FSA.

 

I look forward to acknowledgment of this, with an undertaking that you will proceed to process it, as per the requirements of the terms agreed within the waiver.

Hi Kashie,

 

Although you gave them 7 days to respond, you need to also be realistic about how such large organisations work. However, as your claim was sent in May, they've no excuse.

 

Send a letter to John Varley's office saying you're frustrated and angered by their failure to respond properly in a Hardship case. Put the letter subject as Hardship Claim - FORMAL COMPLAINT and enclose copies of the letters and schedlues sent in May onwards.

Update - had a response from the bank today they are investigating my claim and will be in touch shortly either by phone or letter. They said investigation could take up to ten working days, and in the meantime I was entitled to contact their debt management team who might be able to help me with my financial planning.

Do you have any idea what happens next apart from sitting back and waiting for a decision?? Should someone call from the bank is there anything I should be careful NOT to say??

They'll consider your circumstances and make a decision based on them. I doubt you'll have to do anything.

Barclays have been fairly good recently in that they are refunding a lot of charges up to August 2008. I hope you are one of the ones they refund to.

Barclays refunded £1252.50 which is roughly half the amount claiming.

No contact from them in bank account within 8 days of the 10 stated in letter.

 

Thanks for your help this will go along way to paying off some debts and sorting out kids uniform for september.

Can you confirm if they've told you exactly how the partial refund is broken down.

Under the waiver it would be the period in which the bank considered the person to be in financial hardship. They were reminded of this fact in the letter of 19th March 2009.

No there was no breakdown, just a letter to say that if I didnt agree with the amount that I could go down the complaints route, ie, OFT, and just stating that it will be deducted from the total amount of charges claiming for.
