    • The last photo shows the overflow carpark looking at the block which our room was located. When we got out of the car my partner thought that the building was for staff accommodation.  The unsecured bedroom window opened onto this car park.
    • Also I see that you are doing a lot of this on the telephone – and without any written confirmation. This is a big mistake. You need to start taking this matter seriously and so everything should go in writing. If you have telephone calls then they should normally be recorded. Read our customer services guide. You should make notes about every telephone call and then you should send an email to your telephone correspondence confirming what they have said or what they have agreed. It is important that you keep detailed paper trails here. Of course we may be jumping the gun and maybe big motoring world will step up to the mark – but I'm afraid that they have a lousy reputation has you have seen and so you need to start practising survival techniques and protecting yourself. You say for instance in your letter of rejection that the mechanic told you on the telephone that the gearbox needed replacing. Do you have any other evidence of this conversation? This is going to sound a bit harsh – but other people will be visiting this thread as well for their own purposes. You conducted their research about this company before you bought the vehicle. You now are fully aware that this is a company which can be very difficult to deal with and causes a lot of problems for many of their customers and yet you are still taking a telephone/verbal approach. Do I need to say any more? Also one of the documents you put up is an email exchange but it is not clear who is writing to who or what dates. If you showed this email to somebody in a pub they would be asking lots of questions about who sent the first message, who sent the second message, what dates were they sent et cetera. Please think about this before you post things. Please can you clarify the details of that email exchange. Please will you present the information carefully. We are all volunteers here and we have to rely on you to do the spadework
    • I told the DM that the room was not acceptable because of the reasons already mentioned. He informed me that they were full that night and that they could move me to the room next door (would not solve my problem with the rooms location).       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi all, was wondering if anyone knew what my next move should be -

 

we are claiming back £8631 charges from the Halifax, but we are in Scotland so it exceeds that amount to claim it through the small claim court, so we are going to have to go to the Ombudsman to ask them to fight it for us. The bank have had their full 8 weeks and today have offered us £4700.

 

What I wanted to know please, is if anyone knows what my next move should be when refusing this offer? As I am a bit confused about what to do next, can I still complain to the Ombudsman if they have made me an offer which i consider is not enough?

You could accept the offer as part payment. I don't think they will actually give you it unless it's for a final settlement. If they did, that only leaves four grand to claim.

Don't be fooled into thinking you have to use the Scottish courts just because we live in Scotland. I've been through the English court system twice and two friends once each. All you need is an English postal address and there are various threads on here telling you more.

You will need to do some homework but would it be possible to split your claim into two that are under £5k and then proceed on MCOL? I don't know I'm only trying to give you ideas!

Only you can decide your next move. go to the library and read read read!

Thanks for all your suggestions I will go to the library and have a look there, I had been led to believe that because it was such a big claim the obudsman would be the best way to proceed with it. I could split it down into 3 year sections and claim it back that way, that would bring it under £5k - what is MCOL? Sorry am very new to all this.

don't split your claim if it's only for one account, the banks have caught onto this and they'll try to get get your second claim kicked out for abuse of proccess. theres nothing wrong with keeping it all together, if it goes fasttrack they'll have to do standard disclosure, and we all know how they feel about that.

i like the idea of using an english postal address, do you have friends in england? if not, could you use a PO Box?????? i know the banks do

No probs we were all virgins once! Read my first couple of posts I was shaking when typing!!!!!

 

MCOL = Money claim on line.

Something the English have over us! (That's only 1 - 0!) Scottish law is a bit antiquated.

Using MCOL you can sue someone etc for up to £5k. It's a piece of p.. You fill out a form on line and sit back and wait for the decision.

You can go into the website, register yourself (properly) then go about suing me for a million pounds for not spelling corectly correctly!

Nothing happens until you get to the payment page. Obviously if your suing me you cancel it and nothing happens. I know we shouldn't (it's an official website!)but you can have a good play with it so that you are comfortable on the day that you actually sue them. You can do a bit at a time and come back to it.

 

If you used the spreadsheets from this site you should be able to determine how many charges take you to the £5k threshold off the top of my head I think you will need one max claim then another to mop up the rest.

 

Regardless of what you choose to accept or ignore please please please take the time to read read and then read again all the advice in the library and on the announcements at the top and of course all the threads. It's not difficult, can't be I did it!

I have an address in England that i can use, my Mother-in-law lives in Carlisle.

 

I am now off to read as much as I can before calling the bank back tomorrow to refuse the offer.

Hi all

 

Just to let you know that I won!!!!! I still can't believe it :) :) :)

 

I phoned the bank back to tell them that i wasn't accepting the offer and that i would go to the FOS and they said that they would let me have the whole amount and I received the letter this morning confirming it!

 

Should be in my account in 2 weeks, onwards and upwards with the next 3 accounts that i have :)

 

Thanks to you all for all your help and advice - I will donating to the site as soon as my money comes through

HI i have 3 other accounts with the Halifax, which were closed down last year as they were overdrawn - with charges !?!?!

 

They are not as much as this one but are still worth claiming, now that i've got the bug! :)

 

But wouldn't have been able to do it without all the info and help/support on this site, it really is a godsend, so will be def donating as soon as the halifax pay out
