    • wont go near it with a barge pole as its ex gov't debt.
    • Thanks, I've had my fill of this lot. What makes me so mad is that I had to take out student loan to get any DHSS help. And then when I tried to help myself and family they presented obstacles. Might be worth passing story to RIP off Britain?
    • there is NO exposure if you simple remove your name address/ref numbers etc from docs, over 10'000 pdf uploads are here. which then harvests IP addresses off of the people that then do so..which is why we do not allow hosting sites. read our rules and upload carefully thats exactly why we say capture as JPG, redact, then convert/merge to one mass PDF. then online sites to achieve that we list do not leave watermarks.  every once in a while we have a user like you that thinks they know better...we've been doing it since 2006 with not one security issue. thank you.
    • was at the time you ticked it  but now they've still not complied . if you read up, here , you'll see thats what everyone does,

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Does anyone know of Roberson Holbrook ? I downloaded and sent off forms from there website last December requesting them to act on my behalf to recalaim my bank charges.

I have been now trying for the last two months to contact them to see if anything is happening. They do not answer emails, they do not respond to conventional mail. If you ring them they put you through to an answer machine I dodnt know what to do now If I could find out if they are claiming would be just fine if they are not I could go elsewhere

Hi, I instigated a claim with Roberston Holbrook about 2 years ago - got nowhere and I checked to see if they are still trading - I contacted the claims regulation department and this was their response.

From: Claims Regulation

Subject: RE: Query

Ms C,

Thank you for your query.

Unfortunately, the business in question has been dissolved on Companies House and as such no longer exists. We are looking into rectifying our records as the business has not notified the Unit of the fact that the business has ceased trading.

If you have any further queries please do not hesitate in contacting the Unit on the contact details below.

Kind regards,

Kate Moore

Claims Management Officer

Therefore after all this time I'm back to square one again and had very little help or correspondence from this company at all and wouldn't have recommended them to anyone even if they were still trading!.

I Spoke to Robertson-Holbrook today they say that their accountants had failed to supply information to Companies House resulting in the name being delisted.

That has been addressed and they are to be relisted. I checked their web site (which was also down before) which is now robertson-holbrook.co.uk which is there and currently being rebuilt for 2009. They think that the issue of bank charges will be resolved by the end of January and are busy making preperations to settle their clients I contacted them on 01446 747238 as the other no 02920 4012 just has a message on it directing to the new one.

'I believe that banking institutions are more dangerous to our liberties than standing armies. If the American people ever allow private banks to control the issue of their currency, first by inflation, then by deflation, the banks and corporations that will grow up around the banks will deprive the people of all property until their children wake-up homeless on the continent their fathers conquered.'
