      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi, I am claiming the sum of £5412 from Alliance & Leicester. Can you tell me for your brothers claim, when completing moneyclaim which fee amount did you have to pay. Was it £120 or the £250 of which should I do??? Please help about to complete moneyclaim any day.

If your claim without interest is under £5000 pay the lower fee

 

If your claim without interest is over £5000 then you pay the higher fee

 

I would wish you best of luck but with A&L you dont need it :)

Thankyou for your quick reply. I understand the fees now, just need to file my moneyclaim as soon as funds allow me to. I have posted onto my thread (Paula 22) letter I received from A & L, their response to my LBA. Had you received such a letter, while helping your brother on his case?

 

Would like to know if you have chance to look at it! Many Thanks. Hope it goes as smoothly for me, as it sounds like you had no problems with A & L bank.

Paula22/RBrears,

 

I'm at a similar stage to Paula, but I understood that the charges for using money claim is £30 not £120 or £250 as you've mentioned. Could you confirm if it is the two higher charges?

 

I have also completed my schedule of charges ready for my Moneyclaim, I have added interest at 8% as per 'simple charges' excel template and also included (and deducted) previous refunds that A & L have deposited in my account (they've done this in an attempt to confude me and elay the case but that ain't happening!:) . I've deducted these refunds against my latest charges to mitigate reduction of interest.

 

Do I add the cost of moneyclaim on to the the schedule - or are all claim and court costs added afterwards i.e. during settlement?

With regards to your posting, hopr this info helps you, #1st if you go onto this adddress for the courts which is Her Majesty's Courts Service - Home then click onto online services then onto money claim online, this takes you to another window in GREEN then click money claim on line type in court fees on there search top right of page, this is the cost going through the country court system NOT THE SMALL CLAIMS COURT. uptp £300 is £30 fee, £301 to £500 is 350 fee, £501 to £1K is £80 fee, £1K to £5K is £120 fee, £5K to £15K fee is £250 and so on.

 

Withj regards to court cost as far as i am aware you fill in your total claim less court cost then if you win you get all your cost back inc court fee, i really hope this helps and if you click on above link in blue this should take you to the required court site.

I have been on moneyclaim but only briefly. Now I have sorted my claim schedule and revised up on case guidance on this website I can spend some time on moneyclaim.

Please stop hijacking this thread.
