Hi all update on my daughters account, with LTSB the credit card have accepted her payment plan, (think the court claim helped):p and she has had £90 good will placed in her account. the claim was for £135.

She is happy with this, and we are not going to push on with the claim, I say we meaning ME, as I'm having to do this long distant, and being a teenager its hard work, so I think its for the best.:D

Is it me, or have the banks found another money maker ie: on internet banking, trial for £1 privicyguard so no-one can steal your identity.

One minute your told its secure, then when its found to be flawed, they then say they can now give you security if you pay for it.:confused:

Oh for the good old days, that mattress is looking very tempting:D

looking through my claim, and what I need for my bundle, LTSB defence is that my claim is insufficiently particularised, and is embarrassing, and that I should serve an amended claim, so they can defend the proceedings further.

I followed GaryH (star) advice, and in section G added The defendant in its defence etc + I am litigant in person.

draft orders for directions.

request for stay to be over turned.

Now my notice of allocation for the 25th July, the Judge has considered, it all going ahead, there is no mention of directions, (this is confusing me:confused: )

Has he dismissed my suggestion of draft directions, but more importantly,

LTSB request in their defence that as my POC was too vague, I should serve an amended claim so they can defend further. (is he being nice to me:) )

Should I ring [problem] and enquire, as I have not heard from them after sending my AQ,( with in section G the response to their defense,) how their skeleton argument is going? There is no mention in their defence of the charges being fair etc, which I keep reading on other posts.

Yep I'm confused:confused:

Any thoughts on the directions? or are the directions the 'each party shall deliver' etc, without actually saying the word Directions?

Notice of allocation to the small claims track (hearing)

 

DJ has considered the statements of case and allocated the claim to the small claims track

The hearing of the claim wil take place at.. on.. and should take no longer than 20 minutes

The court must be informed immediately i the case is ettled by agreement before the hearing date.

Each party shall deliver to every other party and to the court office copies of all documents (including any experts' report) on which he intends to rely at the hearing no later than 11 July .

The original documents shall be brought to the hearing.

The parties must file in court and serve on the other party written satements of all witnesses(including themselves) at least 14 days before the hearing and any witness whose statement is not agreed by the opposing party must attend.

The Defendant should file and serve a short skeleton argument no less than 14 days before the hearing.

Bank charges case.

This case has been block listed toghether with a number osf similar cases. Should the case proceed to a hearing, it may become necessary for the court to adjourn the hearing to another date.

Just found a letter which refers to Our 'Guide to Banking Charges' leaflet explained: When you go overdrawn without agreeing it with us first, or when you go over the limit you agreed with us we will charge you £25. We will charge this amount each day your overdraft increases by £10 or more. We do this up to a maximum of £75 each month.

It carries on about a higher rate of interest without agreement, charge of £32 for non payment of cheques dd's so's.

 

First line, "without agreeing/or agreed" have we not then broken the agreement?

 

Should this be included in my bundle? is it something GaryH is after?

Hi all, just doing my witness statement for bundle.

Q. what date do I put at the top? todays date, or the court date?

Q. 7. the defendant acknowledged service of the claim on... Sorry where would I find that date, court issued deemed served, then got LTSB defence, can't find any paperwork acknowledging service.

Also having trouble printing Mr Ortons letter (the computor closed down, don't think running out of paper did that:eek: still works though).

Any help gratefully received:D

Just spoke to [problem] as I sent my bundle yesterday, usual stuff not on file yet, we are behind. They have to have their skelton argument in by tomorrow, looks like I may be having to go down the strike out Judgement route thingy:( I want my money!:( :(

Hi anyone, printed the full scots law, ran out of ink, so had to put a lot of to follows (hope the judge don't mind).

Lady at the court said half of the block booking for the 25th had been settled, bet they weren't LTSB:rolleyes: .

Well panic over for the moment, bundle in on time, shame I sent LTSB a different one, will wait a while before I start printing out theirs:p

Thanks Pink, LTSB are notorious for taking you to the court door:rolleyes: defo scare tactics, still could do with the court costs, all this printing, and how come Lexmark ink costs so much? ink is ink surely!

By "THEM" do you mean bank employees?? That could be classed as fraternising with the enemy ;)

 

On a serious note, I'd be fascinated to hear what's happening inside the banks as I understand that even some bank employees are reclaiming their charges too. Still I doubt they aint complaining at all the overtime.
