      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi everybody!

 

Firstly, thanks to this site. I'm happy to donate 5% of £3098 when I get paid by Virgin.

 

I've done my first two letters (no need for reams of paperwork from them as the account all online).

 

I've finally paid the court and handed in the paperwork. I don't know how long it takes after this, but I'm hoping to have a summer holiday this year.

 

Since August, I've had another £1,000 of charges, so have just done the prelim letter for that and will mail it today.

Ok.....so if anybody is reading this (unlikely).... we applied to the court on 2nd March and they replied yesterday. Virgin has until 26th march to answer the court and my claim. Will let you know how it goes.

I sent my claim off yesterday. We only have about 3 years worth of bank statements, but have sent off for the rest.

Well well. I wonder if I've done this all wrong now. I read everything and stcuk to the letters. BUT..... because all of my info was online, I neglected to get paper statements. STUPID, I KNOW. :|

 

Virgin had to respond to the court by 26th March. This morning I got a letter from their solicitors saying that they are filing a defence for the whole claim. I'm not tooooo concerned about this and as soon as I get paid at the end of the month, I shall purchase a claims pack from the site for £9.99.

 

Meanwhile, I will be sending a DPA letter requesting my statements, so that if it does get as far as court, I'll have all the paperwork, although I do have details of every single charge they have made against me.

 

Additionally, I started a second request on 8th March for another £1,073 in charges since the first claim was started. They've offered this in full and I've accepted. :p I've sent an additional letter to state that I'm only accepting this as a seperate claim and if they are banding the claims together, than I cannot accept the offer. They have told me the two claims are seperate, but I am concerned that I may have been 'duped'. :confused:

 

I'll let you know what's going on as soon as I find out!

 

I hope everybody out there has a GREAT day.

 

Also.....mortgages...any advice welcomed: I had a mortgage, they witheld £5,000 for repair work. Repairs weren't done, mortgage was paid up, including the £5,000 which I had never actually received. I wonder if I should be chasing this up too??

I've only just registered and I take it ( correct me if I'm wrong?) that you are taking Virgin Media to court.

 

Would you have the postal code for Virgin Media. 160 GREAT PORTLAND STREET LONDON. It appears that Virgin Media have given me W1W 5QA as there post code and its not correct. Trying to find the correct P.C.

is a bit like looking for a needle in a Haystack!!

 

My claim is for just under £2000 for my time spent (I'm self employed) since

December till early March for NTL / Telewest /Virgin Media to get there act together. 5 site visits all unable to complete the installation to a straight forward 3 Bed Semi Detached house. I'll not bore you with the rest of the story. But like every one that works one likes to get paid? and if the Self employed can not work due to incompetence then I dont see why companies like Virgin should get away with paying.
