    • Please see below for an extract from the letter more about my case.    You have been convicted of two matters of failing to give driver details linked to two speeding offences and been disqualified in your absence. You confirmed that you did not receive the court documentation and the first you knew about the cases was on 3/6/24. As you can make a statutory declaration it is possible that we will be able to persuade the police to accept pleas to either or both of the speeding offences as they were committed within a very short space of time and withdraw the two fail to give driver details offences as normally if you plead to one or other of the speeding or fail to give driver details the prosecution will withdraw the other related offence. If successful you would not face a totting ban. In respect of the speeding offences, it could be argued they were committed on one occasion due to the proximity of the time and location and we may be able to persuade the prosecution to drop one of the speeding offences. You are technically guilty of all the offences because you accept it was you driving when the speeding offences were committed and that you did not update your change of address with the leasing company when it was your responsibility. If the prosecution will not withdraw the two failures to give driver details offences, you will face a totting ban but will be able to put forward an exceptional hardship argument. This may or may not go ahead at the court hearing date, so we need to prepare for all eventualities. As a safeguard we have lodged the appeal and applied to suspend your ban pending appeal due to the time limit for being able to automatically appeal without getting leave of the Judge. The court have dealt with the matter very quickly and have actually listed your matter for an application to suspend the disqualification pending appeal on the above-mentioned date. We could actually use this date to make the statutory declaration in court having explained the situation to the magistrates and then see if the prosecution will agree to accept pleas to one or both of the speeding offences as a way of resolving the matter without the need for you to put forward an exceptional hardship argument. It is possible the case would need to be adjourned so that we can make those representations, or the court may want to go ahead and hear the exceptional hardship argument. The outcome of your case is always at the discretion of the Court.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Can you send in the court baliffs? Or prehaps phone the court and speak to them? My local court have been great by telling me what options I have in recovering my money.

The court ahve told me I can re-issue warrant.. and send baliffs in - but I ahve already done this once, and was hoping to get it settled before sending baliffs in again (as they didn't do much last time)

I have also incurred approx £800 worth of charges since filing the claim last year - that I wouldn't ahve got had I got the money when I won the case. Has anyone got any idea of how to ask them to pay up these fees as well.. or should I start a new claim?

I started a new claim for the charges I had incurred since I began the first one. Mainly it was because I was paying a whole load of court fees!

Thanks everyone... I asctually had a phonecall yesterday at 2.30pm.

 

She remembered my case, and said that a cheque should have been sent out a couple of months ago - she is going to see what ahs happened and cancel cheque so she can send a new one. I am to phone her at 2.30pm today to see whre things are up to... so fingers crossed - I might be getting a cheque very soon :D

They reckon it was sent out.. but spoke to her before. She's cancelled previous cheque (apparently) and processed new payment yesterday - cheque should be with me monday/tuesday :D

 

Then I need to ask about getting my charges back since putting in claim - she suggests I write a letter saying basically -

 

as you are aware - I won the case.. now can I ahve the rest of the charges back.

 

I'm a bit worried about tackling them twice though - I am going to pay off both overdrafts, but I still ahve a credit card and flexible loan with them. Can they close my loan account or credit card account?

i know, i would have some more charges to claim back. But don't really want to tackle them twice, as that would probably mean account closure.Apart from the charges i was happy with my account, so wouldn't really mind keeping it open. Although i do have a parachute account just in case. I also have a Flexible loan and Credit card with them. I don't think they can just close them because of your previous claim, they should be classes as different accounts. I hope! Because i still want to persue some charges on my credit card aswell.

I have incurred £800 worth of charges since claim filed though - it's a lot and it wouldn't happened - had they not put charges on my account or paid up when they should have done... I don't care about my bank accounts being closed, but didn't know if they could close c/card or flexible laon when I have a balance on them??

Wow, that is a lot more than i have incurred.Although £170 already is a lot of money which they charged me since then.

I would deff go for the rest of it if i was you. Like i said, loan and credit card are 2 seperate contracts i should think. And i wouldn't think they could just close them because of your claim on your current account.

But then, i don't know for sure.

I have claimed my credit card charges as well... Two current accounts and a credit card - but then if I get the £800 my card shoudl be payed off..

I will try and pen a nice letter asking them to give me the charges back seeing as I have already won a case.. I suppose I have a decent case for it seeing as they are 6 months late paying me ....
