    Sent my Prelim off and received an offer, which I refused. They came back and offered the full amount with a gagging clause which I also refused. Today I received a letter for the full amount without a gagging clause. Great!

  4. Great letter. I wrote something similar after I won my case to get back the charges they had added. Not heard anythng yet though.

  6. I started a new claim for the charges I had incurred since I began the first one. Mainly it was because I was paying a whole load of court fees!

  8. Can you send in the court baliffs? Or prehaps phone the court and speak to them? My local court have been great by telling me what options I have in recovering my money.

  10. Went to court last Friday. Lloyds TSB did not turn up so I won. Some of my claim was struck out as the charges related to 6 years before I had begun my court case. I was awarded traveling expenses and parking, interest to the date of the court case and court fees for the amount I won not the amount I claimed for. When I got home there was a letter from Lloyds TSB saying they want to settle and not to go to Court. Too late! An enjoyable experience.

  12. I wrote to the court as suggested by the kind replies. I have since had a court date and been informed that part of my case has been struck out as the charges relate to 6 years before the case was bought.

I have received a letter from the court asking me to clarify and 1) Does she accept claims for adjustment from 14th September 2000 now fall foul of the limitations act (see defence) and if not on what principle of law does she apply? I am unsure of how to answer this. My schedule shows my first charge on 1/7/2000 and I first wrote to them asking for payment on 26/7/2006 although my SAR letter was sent on 5/6/2006. Would I be okay to answer along the lines of When I first let you know I wanted my money back it fell within the time specified in the limitations act. Or is there something much cleverer I coud write?

    It is a temptation to settle for less. Especially when they offer you just below what you are asking for. It is very hard to turn down money! I've no doubt as your court date gets closer they will offer you the full amount.

    The lovely Christine called again today. She offered me £1700. I said I would need to speak to my husband. She called me back ten minutes later and I expressed my intention to go to court for the full amount. She then agreed to send me a cheque for the full amount. I'm getting my money back!!!

    I don't think it would harm to email them and saying the court is waiting for a defence before you can move on. I wouldnt put it past Abbey to be waiting until the 7th to enter a defence, just to keep dragging things out.

    Thank you all for your kind messages. She said she would call be back and try and get it all sorted before 4pm (then I pick up kids and take them to gym club). To be honest I am not expecting a call.

    Posted my court bundle to all relevant parties today with next day delivery (fully expect Royal Mail profits to be well up next year). Came home and the phone was ringing. It was a lady from Abbey's inhouse solictors who are taking over the case. Basically they want me to accept a lower amount and kept asking what would I be prepared to accept. I told her without knowing excatly what it cost the bank to bounce one of my cheuques or DD I would be unable to say excalty what I thought a resonable offer would be. She said that would be disclosed in court. They take issue with my figures, mainly the interest on the penalities (they are not called penalities you know), and she said the section 69 interest was discreationary and normally judges only awarded 5% of the interest. She said consumer action groups (what are they??) were misleading in what they were saying. I was very polite and ended up sending her my spreadsheet so we can negotiate futher. I asked her if the change in solictor would slow up my case (as I had just posted my court bundle to the wrong people) and she said no. Roll on 13/11/06.

    Court bundle completed, all 89 pages of it. I am going to photocopy tomorrow and post as well. I have a couple of cheap ring binders from tesco which I will use to keep everything together. I must say I am incredibly impressed with it, looks very professional and does not look at all like it was completed by little old incompetent me. Wait till the kids spill drinks and sneeze on it and it will more like something I would have done. Abby.
