    • I have just read the smaller print on their signs. It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

just like to congratulate you all on a great site:D , and ask if anyone has any info on how to retreive your past banking information after you have closed that account (yorkshire bank)

 

i am wanting to claim against yorkshire bank - current account and visa for charges incurred, but have closed those accounts approx. 3 years ago which still leaves me with 3 years to claim for?:confused:

 

The story: - when i closed the account the balance was at zero!:eek: however, it was due to have some charges which i told them i wasnt paying because the charges being applied to me were knock on from previous charges incurred - a chrge for being overdrawn, and then a fine for doing so, and then another fine for being more overdrawn etc..... it continued - therefore it was a self-replicating series of fines!!! (are you following?) - so off i went - then nearly 3 years later i was approached by a solicitors requesting £400 to wipe clear my YB bank account:evil:- which i paid - cant remember the name of the solicitor but was legitimate

 

but now i am wanting to jump on the 'beat the bank' band wagon and get back what is owed to me! hopefully....

 

but my first question still stands - how can i acquire my bank details when i dont have an account there? help pls:D

If you have the account numbers then you can just send the S.A.R to the branch where you held your account. If you don't know them then I'm not sure how you would need to proceed.

They have to keep your details for a certain amout of time. This is to do with the Data Protection Act 1998. I know people have claimed when they have closed their accounts down so go for it and good luck :p

They have to keep your details going back at least 6 years. Complete a SAR (Subject Access Request), and if you don't have account numbers just give them details like name and address at the time you held the account. They may ask for identification, but they should have good enough systems to find your records.

I have a similar situation, in which my account was effectively closed in 2003 though I am still paying back YB charges via a debt management plan with the Consumer Credit Counselling Service.

 

Last week, I sent a letter to the head office in Leeds with a £10 postal order requesting statements of my account, and today I received a letter from a local branch stating:

 

"We thank you for your letter dated 22nd February 2007 with regards to your Data Protection Act disclosure request and note that the account has been closed for some years.

 

To enable us to process your request could you please bring into the branch some form of uptodate identification e.g. driving license or passport, after photocopying this document, we can then proceed with your request."

 

I have taken in proof of ID straight away, and so now play the waiting game. Do I give them 40 days from today to send me the info, or 40 days from 22nd February?

 

Do I need written proof from the bank to indicate that they have now received my ID? I forgot to ask for acknowledgement of this when I called in today. If so, should I write to them and ask for this?

 

I have found some old statements for YB dating between 1993-1998,. Could I try to claim any of the charges from this period, or is it strictly within the 6 year timescale?

 

Any comments or advice would be appreciated.

Stick to your original deadline.

I wouldn't worry about an acknowledement, but if you are worried you could write them a letter confirming that you have been into the bank at whatever date with your id. and expect your statements by your original deadline.

That is entirely up to yourself read around a couple of threads going over the 6 years Mcouth onthe RBS site and Hydra on RBS site are two that I've been following.

I'm in exactly same position as you. I managed to dig out my old account number though! Sent off my statement request letter a few days ago. I'll let you know if/when I receive them. 3 years is better than none I figured!

I closed my account in 2003, and got my money back last month as you can see from my sig below.

thanks for all your advice and support ;) - i think i will go into the branch (the one i originally banked at) with a pre-prepared SAR form and some ID to acquire my Acc. No. and get it stamped as notification that they have received all info required. - woo hoo - lets get that money back

 

also have Halifax on the go aswell - will keep everyone updated:D

Can you help me? I've sent off my cheques for the 2 accounts I held at Yorkshire Bank. I received a letter from them saying, "Within the terms of the Act we have 40 days in which to provide you with the information we hold...blah blah blah". Now I gave them 40 days and they say THEY have 40 days...when do I start further action? Lets say I sent this to my local YB branch on the 3rd does the 40 days start from there or the day after? Also, can I claim back this £10 cheque (s) that I've sent to them for every account I've had or not? Any help would be appreciated.

You only needed to send them one cheque as this will cover all the accounts you hold as the information you ask for is about you as a person, not each account number. The 40 days should be from when they would have received your letter. So if you posted it on the 3rd then I would start the 40 days from the 4th. The £10 is claimable.

Wow thanks for the speedy response. I'll claim back the £20 anyway so no worries and I'll do as you asked and start a thread. Tis a nice feeling though getting one back on them as they bullied me relentlessly when I owed them money. Ended up closing the account down but since that time and now unable to get a Switch Card :(
