As far as I know they have never attended a hearing

Sorry about the delayed reply welshcakes,work and all that stuff,I have been reading throu lots of other threads as I far as I can see The Woolwich wait until the last moment before they settle.

Thanks Advoc8 I think I'll wait until they have settled the first one then.Another question please,can my wife claim back charges from Cap One even she hasn't got an account with them more?

Yes she can, the process is identical. Does she still have the account number? If not she should be able to retrieve the data from Cap1 but may need to provide more proof of ID and address than usual.

If she no longer has an account with them when they settle as I'm sure they will ,will she sent a cheque for the amount owed? what rate of interest do we charge them is it the same as the banks?

If the account is closed she should get a cheque. Out of interest this happened to me (but not Cap1). I got a cheque then a couple of weeks later got a statement from my 'closed' account showing a credit then debit (the cheque going out).

 

You'll need to find the contractual rate of interest charged on the charges, hopefully that detail will be on the information cap1 will send you, otherwise you'll need to ask others here to see what it was at the time your wife had the account.

Does anyone think it would be worthwhile phoning barclay's now my claim has been acknowledged and seeing if they will settle as they must know that I mean to see it throu to the end?

they wont want to know im afraid until you have a hearing date. you can try by all means but i doubt you would get anywhere.

Hi all,I got written acknowledgment from the court saying that all docments reguarding this claim should be sent to a Adrian St John Legal and Compliance Level 29 1 chuchill place well that's a very posh name I thought,well I can't wait to see what their defence is.

Hi all I have a question please,the woolwich acknowledged my claim on the 22nd of march is it right that they 14 days in which to offer a defence to the claim?If so the time is up I am right?I have been on mcol and there is no mention of any defence being offered, what do I do now please.

Claim Timetable:

Your claim will generally be deemed served 5 days after filing . The deemed date of service will be on the Notice of Issue sent to you by the court.

 

The bank will have 14 days from the deemed date of service to acknowledge. If they do, a Notice of Acknowledgement will be sent to you

 

The bank will then have an additional 14 days in which to file a defence, ie 28 days from the deemed date of service.

The deemed date of issue was the 11th of march so their 28 days expires on the 8th of this month,that is sunday are they able to offer a defence now or are the courts closed until monday if so surely that takes it to 29 days?

Bank holidays are not counted as part of the 28 days. Therefore they have additional days. If the 28 days including BH falls on a weekend then they have until the next working days to file.
