    • Today , after a lot of years i received a letter from this lot. Very friendly, "Were writing to remind you that we haven't had any contact from you in a while".  The velvet fist, followed by  a veiled threat to get their preferred debt collectors involved. Yep dead right. In 1992/3 I took out a Student load under duress from DHSS. up to 2000 I had successfully gotten deferment on low income. But rather than sign on as unemployed ,I decided to be self employed. I applied and they asked for all sorts of documents. I obliged and then correspondence ceased from them, circa 2001. To date I have had no correspondence from Student Loans. I was made redundant in 2009 and reached 65 in 2012 , at which age the loan should have been cancelled. Now , today, 12 years on retirement and 11 ( at least years after last contact) I get a letter with veiled threats. Do I , as I smell a scam a) ignore it and hope that Erudio will think that this phishing attempt has failed or b) respond with a statute barred letter or c) remind them of legal terms that loan should be cancelled 12 years ago or d) combination of b) +c)

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi

 

I am in dispute with creation finance over late payment.

Owed them 8 pounds 12 pence, payment was 2 days late, this was the only purchase owing as I always pay in full at each statment, charged late payment fee 20 pounds plus 3D premium added 13 Nov 2006. Then no statements till start getting phone calls on my mobile, 6 in the last 4 days. Have now received letter stating I owe 61 pounds 36 pence. How should I deal with this. The phone calls I feel are harrasment, as they are very agressive in tone.

 

I have now sent a harrassment by telephone letter.

 

All your FAQ's that I have read & the draft letters, non so far seem to relate to me, as although they are stating I owe them money, they have not taken anything, as I do not have any payment methods set up with them.

 

I really need to know how to tackle this problem. Over the phone I have offered to pay a late payment charge of 5 pounds, but this has been declined, they say I must pay as per the contract & that the calls will continue. All the time they are adding charges, that I do not owe.

 

I know that the amount is small, but still of concern.

 

Please point me in the right direction to a resolution.

The next time they ring advise them as per your recent text[?] that you will only deal with them by letter in future and not to call you again on the phone

as it is harassment. You will log all future calls made by them and report them

to the Office of Fair Trading as being unfit to hold a Consumer Credit Licence.

Then put the phone down and repeat every time they call thereafter. At first

it may be difficult to avoid getting into a conversation, but when you realise

how frustrating it is for them, you will soon get the hang of it and totally

ignore them-it's great fun.:D But do report them to your local Trading Standards office [they act on behalf of the OFT].

 

Next, read the FAQs on the first page of the forum [they are in red] and the

step by step guide. In the library [also on the first page ] in the bank templates there is a letter you can send that spells out to these guys that what they are doing is unlawful. what planet are they on-A £60 bill almost for

being two days late with only an £8 payment.

So do not pay it-use the information on the forum and fight it.

I am today sending the letter before action to Creation Finance.

 

There phone calls both to my mobile & my landline are continuing:mad:, although I am not picking up. The calls are also being received after 8pm which I belive I read somewhere on the site, means they are acting outside the banking code, is this something I can also do anything about:?:

This is dispite having sent a harrassrment by telephone letter to them :-x

Hi All

 

Good news Creation Finance have sent me a letter saying, while they do not agree with the OFT statment of April 2006, they have decided to reduce my balance to Zero, as it was made up only of late payment charges & fees they had levied.:)

 

I would like to thank this site for helping me to get my money back.

 

Now I only need to tackle the other bank charges on our joint accounts, see if I can have the same result.
