      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Initial claim submitted ....i am claiming £553 of charges and these are purely unauthorised over draft fees

 

does anybody know if yorkshire bank close the account once charges are settled ? i have read that certain banks have a tendency to do that

hi ozzy many thanks for the speedy reply . I already have a back up account set up ...just wondered if i ought to get in first and transfer my wages and direct debits over before the axe falls but i wont bother now thanks for the advice

Recieved my first reply today..charges are fair blah blah blah....incurred due to my actions , i'm responsible etc etc etc..about as convincing as elton john's wig .

 

will be posting my LBA (letter before action) tomorrow

 

oddly my first refusal was from my local branch...for some reason i expected it to come from the yorkshire banks leeds office ..although admittedly i did adress my letter to my local branch i expected them to pass it on ..has anybody else found this ?

I put my prelim in earlier this week to my local branch got a response within 24 hours, which really surprised me although the response didn't! Putting my LBA in this weekend.

 

Good luck, by the looks of some of the previous threads be prepared for the long haul!

yeah my reply was about 24 hours too...obviously desperate to quash such fanciful ideas quickly eh ?....well my LBA will be equally as quick in crossing the bank managers mock pine desk

A few days ago i got a letter from my local branch saying that since i wasnt happy the manager had passed on my complaint to head office...typical buck passing......Anyway yesterday i got a letter from some guy called neil mckirdy "customer relations manager"

 

dear mr *funboy*

 

I refer to your recent letter and as requested i have reopened the complaint and a further review is being undertaken

 

My understanding of the further issues you have raised are as follows:

 

*initial complaint not fully investigated

*no refund of charges levied to the account

 

I hope to respond to your complaint shortly . I will write to you as soon as possible , once i have had the opportunity to review the above .

 

please be assured that every effort is being made to bring your complaint to a satisfactory conclusion

Has anyboy gotten this response before ? i havent seen it mentioned in any of the other cases ......or could this be just another delaying tactic ?.....my LBA expires in two days so now i'm not sure weather to go to the MCOL stage or to await a response from them . What worries me is that they may just not bother to reply at all

I think the Financial Services Authority obliges them to keep you updated on how your complaint is being dealt with, quite a few of us have had similar, you will probably get others or indeed a partial offer from customer services, I've just had one from Clydesdale Bank Exchange because it's 8 weeks since i complained. Carry on with your time schedule, take the fight to them.

so you suggest i go to MCOL when the deadline expires ? should i send it to my local branch ? i dont want my claim to fall under scottish law after all

recieved a reply from the ever busy mr mckirdy . threatening to counter claim should i be successful blah blah..and enclosing a cheque for 276.50 tendered without admisson of liability and without prejudice . since my original claim was for £554..now bumped up to £595 due to more charges being added i have no intention of accepting this offer .

 

Should i accept this cheque as partial payment and then issue a MCOL for the remainder ? or simply return the cheque with a letter rejecting the offer ? and then issue a MCOL for the full amount ....my LBA deadline expires on the 24th so any advice would be very welcome

and then issue your claim.

 

Have you not thought about using the county court at Pontefract or Wakefield as it can be easier than using MCOL .

ok so now you have exposed a gap in my knowledge ..i thought MCOL was the first step before using a county court ? :confused: i know the small claims court is in pontefract but how on earth do i go straight through the small claims court ? i have no idea what the procedure is..but i shall return the cheque monday..recorded delivery of course :-)

Sorry to but in on you zebby but it is better to go directly to the local court in my opinion, in Funboys case this would be Pontefract.

 

You can use this form from the templates

Just replace your details and amend the wording in [red] to suit your own case.

 

It is far less complicated doing it this way and is easier to hand in documents etc. direct to the court.

 

This is my recommendation but at the end of the day everyone has their own preference and it is your choice.

recieved my notice of issue today so now yorkshire bank have until the 17 of february to repspond..but i guess i will have to wait right up until the deadline before they defend if the other case files are anything to go by ....i'll keep thei thread updated as and when events occur

Recieved a letter from clydesdale bank today offering to settle in full..interest plus costs :lol:

 

they have enclosed a consent letter for me to sign and have asked for the notice of discontinuance ..can i cancel my claim online ? or do i need to do it by phone or letter ?

 

Should i also refuse to sign and return the letter until i recieve payment or should i return the letter signed but not forward the notice of disontinuance ?
