It says that you can pay at the end of your parking session. given that you have ten minutes grace period the 35 seconds could easily have been taken up with walking back to your car, switching on the engine and then driving out. Even in my younger days when I used to regularly exceed speed limits, I doubt I could have done that in 35 seconds even when I  had a TR5.

    • Thank you for posting up the results from the sar. The PCN is not compliant with the Protection of Freedoms Act 2012 Schedule 4. Under Section 9 [2][a] they are supposed to specify the parking time. the photographs show your car in motion both entering and leaving the car park thus not parking. If you have to do a Witness Statement later should they finally take you to Court you will have to continue to state that even though you stayed there for several hours in a small car park and the difference between the ANPR times and the actual parking period may only be a matter of a few minutes  nevertheless the CEL have failed to comply with the Act by failing to specify the parking period. However it looks as if your appeal revealed you were the driver the deficient PCN will not help you as the driver. I suspect that it may have been an appeal from the pub that meant that CEL offered you partly a way out  by allowing you to claim you had made an error in registering your vehicle reg. number . This enabled them to reduce the charge to £20 despite them acknowledging that you hadn't registered at all. We have not seen the signs in the car park yet so we do not what is said on them and all the signs say the same thing. It would be unusual for a pub to have  a Permit Holders Only sign which may discourage casual motorists from stopping there. But if that is the sign then as it prohibits any one who doesn't have a permit, then it cannot form a contract with motorists though it may depend on how the signs are worded.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi sent off S.A.R for O/H 13th December .

 

Received a template letter today from Mr Udy...

 

'Thank you for writing to us about the fees we've added to your account.

It's going to take us alittle while to look into your situation and come back with a detailed response. We'll do everything we can to get an answer to you within four weeks of this letter.

If for some reason our investigations take longer than four weeks, we'll contact you to tell you why this is.

Thank you very much for being patient while we collect the information we need........'

 

What the heck is this? :x Is he serious. Collect what information??? :x He has been supplied the charges via spreadsheet and it is quite clear what is required??

 

Shall I ignore this letter and send a LBA? or should I send an LBA and add something concerning his letter?:confused:

 

Any help with what I should input extra in the LBA to address this would be very much appreciated:)

Good Luck Milly, the quicker you do it the quicker you will be paid. Mine got paid just in the nick of time before I could go for Judgement. So from the time the claim is deemed to be served you should if all goes to plan receive payment 26/7 days later.

 

WooHooo!!! cannot wait for that day:D :D :D

 

One thing though that is botherin me slightly is two charges, as they are a few months outside my prelim claim date, one being June and the other September 00 and my prelim was sent in December 06. I am wondering whether to take these off for the N1. Limitaions act and all that (nothings been said as CRap 1 have not replied to the LBA and the Prelim was a 'we need 4 weeks to investigate.....blah:confused:

Still have not received the case number from court or indeed if the papers have been served yet. It will be a week tomorrow since filed at CC. Is this normal. Should I get O/H to ring tomoz?

Milly a phone call wouldn't hurt - I am sure the courts are just very busy with this stiff ay the moment as it's not long since christmas etc.. and there has been lots of recent publicity and more people becoming aware of this stuff now as a result?? So perhaps courts just extra busy?

I totally agree because they have paid up all roughly at the same time it seems. Wasting more money repaying us court fees etc. I am surprised the judges allow this to go on with the banks and CC companies - pure waste of the courts time.

 

On another subject of wasting time, my O/H sent a S.A.R to goldfish for his closed account and they have stated that he has to contact lloyds as they were taken over by Morgan Stanley in Feb 2006 and his account was not transferred. The thing is how would Llloyds hold S.A.R information about him as he was never their customer and surely his Golfish CC number would not come up on their system:confused: I think they are just wasting time.

Right....naughty Capital One. O/H received a letter from Mr Udy today dated 19th Jan but postmarked 24-1-07. Me thinks they are trying to tell untruths about the fact they only really sent the letter yesterday!!!

 

Doesn't make any reference to what letter it is in reply to as it does not say 'in reply to your letter dated ...' he is offering a third of the charges.

 

This however is all too late as LBA deadline was 16th and O/H filed 17th Jan at CC. So lets presume it was backdated then they got the date wrong:D !

 

Decided to reply today and letter is sent rejecting offer and told them that as they had not replied by the deadline given in the LBA, so court proceedings have commenced, however O/H has given them the option to settle in full and the claim will be withdrawn.

 

So their stalling tactics have not paid off this time...naughty Mr Udy changing the date , though that may not be the case just my opinion:) !!!

 

O/H also told them they should be receiving notification from the court shortly...ha!

 

What game do you think they are playing?

 

by the way have Capital one filed adefence and has anybody ever had to reply to one??

DS and Elizabeth I agree totally they do not like the tables being turned whatsoever,I think of Mr Udy as 'the banker' on Deal or No Deal....hee hee:D or maybe Mr Bean:D !!!

 

The best thing we are both looking forward to,will be clearing the card completely and having a little left over to put towards another debt.

 

P.s on another subject are you having probs with searches being restricted and sigs disappearing?

Milly, I do not think Mr Uddy exsist, I have said this time and time again, he never answers letters on what has been written. I suspect if you just wrote anything, you would have the same basic reply. I am sure Mr Uddy is a sudo name. Hang in there and you will be paid.

About my O/H's claim number...the court clerk was telling porkys and it was not in the post....court of law and all that and TRUTH. LOL!!!!My O/H told them off for not telling the truth and they said a guy will ring him after lunch. :rolleyes:

 

I know their busy, however they have cashed his cheque and the court charter states 10 working days...so they have to post by Monday or they are not complying. tut tut!!!

 

 

 

Seriously though they need a contingency plan to cope with all this!!!

UPDATE

The guy called with claim number:D Delivered Tuesday 23rd deemed served 25th. Letter is following!!!!

 

This explains the 'dodgy' Udy letter backdated, yet postmark was 24th!!! It was sent as soon s they received notification of claim:rolleyes: Does he think we are stupid.. I would say they panicked there as its not asimple cross over of letters.

 

He is trying to show that he communicated fairly! Ha dodgy tactics!!!

 

Anyway that means acknowledgment by 9th feb!
