      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Jonat,

Wow £100 how generous of them..lol, well at least with their offer of a goodwill gesture, That normally goes to prove that they may be hiding something from you and are hoping that £100 will shut you up. lol

 

I challenged Firstplus over their Early Settlement Interest Charge that they kindly charged me when I settled the loan with them. The rule of 78 was considered by the FSA to be an unfair method of calculating settlement figures and the rule is no longer used in newer credit agreements. Of course they did state that their Legal Eagles considered my legal Arguements to be wrond and in fact Flawed..Funny they were no brave enough to stand up in court and challenge..But again as a gesture of goodwill they Paid up in full including Interest and court fees.

 

I am still fighting over that loan re the Mis Sold PPI, but in my case it is slightly different, Though it was on a Firstplus loan , the Loan and the PPI was arranged through Purpleloans (Part of GE Money), who at the time were acting as Agents/Brokers for Firstplus. I am fighting GE over the mis selling issue, which I hope to hit the courts with pretty soon.

 

I have been taking my time over the claim against GE Money, Getting all the facts and figures etc, They have shot themselves in the foot a couple of times too, so all that info actually might help when it goes to court.

I am just waiting patiently for the outcome of my Complaint to the ICO about GE Money, They are Investigating my compalint at the moment and I should get the outcome within the next 14 days or so.

 

The more info I have to present to court hopefully will at least let the court see that I have tried every avenue to settle the matter and most of the time GE Money just totally Ignore your Complaints.

 

The appearance on Trevor .. I think may have upset Lloyds a wee bit..lol, But strangely enough I will of Course be complaining about their Comments. I also got a free credit check over the weekend, and Have found 3 Lloyds loans during the past few years that I cant remember anything about.. Strangely they had no openning Balance and seemed to be cleared within a month or 2. So letter on its way or a visit to my branch to find out more about these mysterious Loans..I have some theries as to why they may be there, like targets need to met etc..But wont say too much till I get all the facts..lol

Evening Everyone

 

Just a quick update, I feel like I've hit a bit of a brick wall so any help and/or motivation would be appreciated....as always!

 

I have just recieved this letter from natwest the crux of which is below:

 

After a full investigation of all the facts regarding the inclusion of personal loan protection to your loan I do not feel that any form of mis-selling has taken place.

 

I would refer you to my previous letter in shich we state for the time you have taken to contact us and any inconvenience caused we will make a full and final offer to you of £100.

 

I guess my next step must be a compliant to the Financial Ombudsman but any help would be appreciated.

Good afternoon everyone,

 

My claim for mis sold PPi has been rumbling on since december and I have finally started having some success. This is the story so far:

 

1. Complained to my branch re the misselling of insurance.

2. Following 4 or 5 letter between myself and natwest they basically told me to sod off and offered me £100 as a goodwill gesture (the policy had cost me £2789.99 including insterest and this is what I was claiming)

3. Compained to the financial Ombudsman.

4. Recieved a 'final responce letter' from Natwest offering me £1394.63 (basically half of my claim)

 

So my questions are; Has anyone else been offered a part settlement? and if so what action did you take? Should I push my luck for the full amount and if so are there any examples of rejection letters out there?

 

Any help, advice etc would really be appreciated.
